FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Findings of Fact, site plan application #SP-01-33 of Ethan Allen Holdings to construct 6,475
square foot warehouse building, 86 Ethan Allen Drive.
On the 19th of June, 2001, the South Burlington Development Review Board approved the site plan
application of Ethan Allen Holdings under Section 26.10 of the South Burlington Zoning Regulations
based on the following findings:
1. This project consists of constructing a 6,475 square foot warehouse building.
2. The owner of record of this particular property is Ethan Allen Holdings, LLC.
3. The property is located within the IC District.
4. Access/Circulation: Access is proposed to be via a 30 foot curb cut on Ethan Allen Drive.
Circulation on the site is adequate.
5. Coverage/setbacks: Building coverage is 15.62% (maximum allowed is 30%). Overall coverage is
39.44% (maximum allowed is 70%). Front yard coverage is 26.9% (maximum allowed is 30%).
Setback requirements have been met.
6. Parking: A total of 16 parking spaces are required and 17 spaces, including one handicapped
space and a bike rack are being provided. The plan should be revised to note the correct parking
requirement for office space which is 1 space/250 square feet.
7. Landscaping; The minimum landscaping required, based on building costs, is $5,828 that is being
met. Plantings will include Red Maple, Rose Glow Barberry, and White Pine. The plan should be
revised to provide a 15 foot green strip along the property's frontage as required under Section
25.107 of the zoning regulations. Coverages should be adjusted accordingly.
8. Lighting: Exterior lighting consists of three 12" wall mounted fixtures with 1.00 watt metal halide
lamps. Prior to issuance of a zoning permit, the applicant should submit details of proposed building
mounted lights to the Director of Planning & Zoning for approval.
9. Dum ster: The dumpster will be screened by a 6 ft. high stockade fence.
10. Traffic: This project is exempt from the road impact fees.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board approves
site plan application #SP-01-33 of Ethan Allen Holdings to construct 6,475 square foot warehouse
building, 86 Ethan Allen Drive, as depicted on a two (2) page set of plans, page one (1) entitled, "Belter
Park Lot 11 Ethan Allen Drive South Burlington Vermont", prepared byO'Leary-Burke Civil Associates,
PLC, dated 8/27/99, last revised on 12/1/99, with a stamped received date of 5115101, with the following
stipulations:
1. All previous approvals and stipulations which are not superseded by this
approval shall remain in effect.
2. All exterior lighting shall consist of downcasting shielded fixtures. Any changes
to approved lights shall require approval of the Director of Planning & Zoning
prior to installation. Prior to permit issuance, the applicant shall submit details of
the proposed building mounted lights to the Director of Planning & Zoning for
approval.
3. Prior to the issuance of a zoning permit, the applicant shall post a $5,828
landscape bond. The bond shall remain in effect for three (3) years to assure that
the landscaping takes root and has a good chance of surviving.
4. The building shall be sprinklered.
5. The Development Review Board approves a sewer allocation of 225 g.p.d. The
applicant will be required to pay the per gallon fee prior to permit issuance.
6. The applicant shall comply with the requirements of the South Burlington
Water Department as outlined in a letter dated 5/23/01 from Jay Nadeau to
O'Leary -Burke Civil Associates PLC.
7. The applicant shall obtain a zoning permit within six (6) months pursuant to
Section 27.302 of the zoning regulations or this approval is null and void.
8. The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer prior to use of the building.

9. Any change to the site plan shall require approval by South Burlington
Development Review Board.

Please Note: You have the right to appeal this decision to the Vermont Environmental
Court, pursuant to 24 V.S.A. § 4471 and V.RC.P. 76, in writing, within 30 days of the
date this decision is issued. The fee is S150.00. If you fail to appeal this decision, your
right to challenge this decision at some future time may be lost because you waited too
long. You will be bound by the decision, pursuant to 24 V.SA. § 4472(d) (exclusivity of
remedy; finality).
