HomeMy WebLinkAboutSP-01-61 - Decision - 0090 Ethan Allen Drive#SP-01-61 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, site plan #SP-01-30 of S & N Properties to amend a site plan for a 9500 square foot light manufacturing building. The amendment consists of minor parking and coverage alterations, 90 Ethan Allen Drive. On the C/i day of August 2001, the Director of Planning and Zoning approved the request of the South Burlington School District for site plan review under Section 26.10 of S & N Properties based on the following findings: 1. This project consists of amending a site plan for a 9500 square foot light manufacturing building. The amendment consists of minor parking and coverage alterations. 2. The owner of record of this particular property is S & N Properties, LLC. 3. This property located at 90 Ethan Allen Drive lies within the IC District. It is bounded on the north by undeveloped land, on the east by a residence, on the west by an auto repair shop, and on the south by Ethan Allen Drive. 4. Access/Circulation: Access is provided via a 20 foot curb cut on Ethan Allen Drive. No changes were proposed. Circulation on the site is adequate. 5. Coverage/setbacks: Building coverage is 11.5% (maximum allowed is 30%). Overall coverage is 36.9% (maximum allowed is 70%). Front yard coverage 28.5% (maximum allowed is 30%). Setback requirements are met. 6. Parking: A total of 7 spaces are required and 17 spaces including two (2) handicapped spaces and a bike rack are being provided. This is a four (4) space decrease from the previously approved 21 parking spaces. 7. Landscaping_ The minimum landscaping requirement, based on buildings costs, is $11,400 which is not being met. The plan should be revised to include $5385 of additional landscaping and increase the size of the Red Maple trees to 2 '/Z inches. 8. Sewer: The sewer allocation required is 300 g.p.d. The applicant will be required to pay the per gallon fee prior to permit insurance. 9. Lighting_ Exterior lighting will consist of five (5) building mounted lights with incandescent lights ranging in wattage from 65 to 120. These fixtures are downcasting and shielded. 10. Dumpsters: A screened dumpster storage area will be provided. The plan should be revised to note that the dumpster will be screened from the road. 11. Traffic. This project is exempt from the road impact fees. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves site plan #SP-01-30 of S & N Properties to amend a site plan for a 9500 square foot light manufacturing building. The amendment consists of minor parking and coverage alterations, 90 Ethan Allen Drive, as depicted on a one (1) page set of plans, page one (1) entitled, "Thomas Mechanical South Burlington Vermont", prepared by W.E.F. Wall & Assoc., Inc., dated 4/11/01, last revised on 8/20/01, with the following stipulations: All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The site plan shall be revised to show the changes listed below and shall require approval of the Director of Planning & Zoning (hereinafter Director). Three (3) copies of the approved revised site plan shall be submitted to the Director prior to permit issuance. a) The plan shall be revised to include $5385 of additional landscaping and increase the size of the Red Maple trees to 2 '/z inches. b) The plan shall be revised to note that the dumpster will be screened from the road. c) The plan shall be revised to relocate the Red Maple trees at least 6 feet from the edge of the parking lot. d) The applicant shall revise the plan to illustrate a more salt tolerant species than the proposed White Pine trees in consultation with the City Arborist. 3. The applicant shall post an $11,400 landscape bond prior to issuance of a zoning permit. The bond shall remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving. 4. The building shall be sprinklered and include a fire alarm. 5. The Development Review Board approves an additional sewer allocation of 300 g.p.d. The applicant will be required to pay the per gallon fee prior to permit issuance. ►a 6. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the Zoning Regulations or this approval is null and void. 7. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to occupancy of the building. 8. Any change to the site plan shall require approval by the South Burlington Development Review Board.
