FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
RE: Findings of Fact, site plan application #SP-02-25 of S&N Properties, LLC to
amend site plan #SP-01-61 to add a 288 SF garage for storage and two Red Maple
trees at the northeast corner of the existing building, 90 Ethan Allen Drive, South
Burlington.
On the 9t' day of April, the Director of Planning & Zoning approved the site plan
application of S&N Properties, LLC under Section 26.10(b) of the South
Burlington Zoning Regulations, based on the following findings:
1. This project consists of a site plan application to amend site plan #SP-01-
61 to add a 288 SF garage for storage and two Red Maple trees at the
northeast corner of the existing building at 90 Ethan Allen Drive. The
plans note the garage will have an overhead door on the south facade
opening into the parking lot.
2. The owner of record is S&N Properties, LLC.
3. This property is located within the IC -Mixed Industrial Commercial
District.
4. Access, circulation and parking: No changes to access, parking and
circulation will result.
5. Coverage/setbacks: The proposed garage will add 288 SF of building
coverage on the site. This brings the total building coverage to 12.2% (30%
allowed) and total site coverage to 37.6% (70% allowed). The east side of
the garage is 24 feet from the side yard line, which exceeds the required
setback of 15 feet. All setbacks are met.
6. Landscaping: The proposed amendment will add two Red Maple trees
between the proposed garage and the stormwater detention pond. A
caliper of 1 1/2 inches is specified on the plans.

DECISION AND CONDITIONS
Based on the above Findings of Face, the South Burlington Director of Planning
and Zoning approves site plan application #SP-02-25 of S&N Properties, LLC to
amend site plan #SP-01-61 to add a 288 SF garage and two Red Maple trees, 90
Ethan Allen Drive, as depicted on a plan entitled "Thomas Mechanical, South
Burlington, Vermont," prepared by E.F. Wall & Assoc., Inc., dated 3/27/02, with
the following stipulations:
1. All previous approvals and stipulations that are not superseded by this
approval shall remain in effect.
2. Any exterior light fixtures installed on the garage shall be the same fixtures
as approved for and utilized on the building. Any other fixtures to be
installed shall require approval of the Director of Planning & Zoning.
3. Prior to issuance of a zoning permit, the applicant shall resubmit the plans
with an updated land use table that accurately reflects the addition of the
4. The applicant shall obtain a zoning permit within six (6) months of the
date of this decision, pursuant to Section 27.302 of the Zoning Regulations,
or this approval is null and void.
5. The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer.
6. Any change to the approved site plan shall require approval of the South
Burlington Development Review Board.

be lost because you waited too long. You will be bound by the decision, pursuant
to 24 V.S.A. § 4472(d) (exclusivity of remedy; finality).
