PUBLIC COMMENTS/PUBLIC HEARINGS Written public comments on the proposed authorization to discharge are invited and must be received on or before the close of business day (7:45 am - 4:30 pm) January 13, 2011, by the Agency of Natural Resources, Department of Environmental Conservation, Water Quality Division, Attention Vicki Hill, Building 10 North, 103 South Main Street, Waterbury, Vermont 05671 or send via email to Stormwater@state.vt.us. If sending by mail, the general permit number should appear next to the VANR address on the envelope and on the first page of any submitted comments. If sending by e-mail, the general permit number should appear on the subject line. All comments received by the above date will be considered by DEC prior to issuance of an authorization to discharge under the general permit. FINAL ACTION/APPEAL At the conclusion of the public notice period and after consideration of additional information received during the public notice period, the VANR will make a final determination to issue or to deny an authorization to discharge under the general permit. Pursuant to 10 V.S.A. Chapter 220, any appeal of this decision must be filed with the clerk of the Environmental Court within 30 days of the date of the decision. The appellant must attach to the Notice of Appeal the entry fee of $250.00, payable to the state of Vermont. The Notice of Appeal must specify the parties taking the appeal and the statutory provision under which each party claims party status; must designate the act or decision appealed from; must name the Environmental Court; and must be signed by the appellant or their attorney. In addition, the appeal must give the address or location and description of the property, project or facility with which the appeal is concerned and the name of the applicant or any permit involved in the appeal. I call your attention to condition #3 on your 12/20/94 site plan approval which reads "There shall be no vehicle display or parking of vehicles on any grassed area on or along any access drive." A recent visit to your property revealed that you had three (3) vehicles parked along the west side of the building in the access drive, one (i) vehicle parked on the lawn in front of the building and five (5) cars and one (I) trailer parked in the front of the building in the access drive to the former loading dock. The site plan approved on i/9/96 allowed only one(i) vehicle in front of the loading dock. Another violation which was brought to my attention involves the pavement for the eight (8) spaces along your westerly property boundary. It is my understanding that this paved area extends five (5) feet onto the adjoining property. The approved plan shows the paved area stopping one (i) foot before the adjoining property boundary. Any additional pavement beyond what is shown on the approved plan must be removed. I will visit your property again in two (z) weeks with the expectation that all your zoning violations will have been corrected. M E M O R A N D U M To: South Burlington Planning Commission From: Joe Weith, City Planner Re: November 28, 1995 agenda items Date: November 22, 1995 2) JAMES CARLSON - SITE MODIFICATIONS - SITE PLAN This project consists of making site modifications to a previously approved site plan and converting 2,800 square feet of an 8190 square foot building to auto sales and repair. This site plan was last reviewed on 12/20/94 (minutes enclosed). This property located at 88 Ethan Allen Drive lies within the IC District. It is bounded on the west and east by vacant lots, on the north by an agricultural field and on the south by Ethan Allen Drive. Access/circulation: Access is provided by two (2) curb cuts, the westerly curb cut is 24 feet wide and is the main access to the site and the easterly curb cut is 21 feet wide and provides access to the loading dock. No changes proposed. Circulation is adequate. Coverage/setbacks: Building coverage is 17.4% (maximum allowed is 30%). Overall coverage is 43.1% (maximum allowed is 70%). Front yard coverage is 28.5% (maximum allowed is 30%). Setback requirements are met. Parking: A total of 17 spaces are required and ???-??? spaces including one (1) handicapped spaces are being provided. A bike rack is being provided as required under Section 26.253(b) of the zoning regulations. r The site appears to be quite congested with parked vehicles waiting Q� to be serviced. Staff suggests that the applicant consider expanding the storage area behind the building. Lot coverage does not appear to be a problem. Landscaping: There is no minimum landscaping requirement, based on building costs, for this project. The front of the building is well landscaped and no additional landscaping is recommended. Lighting: The existing floodlights have not been replaced with a downcasting and shielded fixture as required under condition #4 of '{ the 12/20/95 approval. Applicant should replace these lights with a fixture approved by the City Planner. Traffic: No increase in traffic is anticipated. 3) UP GOLFCO_, INC. - GOLF COURSE/RESIDENTIAL PRD - PRELIMINARY PLAT This application was continued from the November 14, 1995 meeting (see enclosed staff memo from the November 14, 1995 meeting). 4) DAVID SIMENDINGER - CONVENIENCE STORE - SITE PLAN This project consists of razing a bank building and constructing a 900 square foot convenience store with gas sales (two (2) pumps/three (3) fueling positions), deli, ATM machine and 1440 square foot canopy. The ZBA granted a conditional use permit for this facility on 4/27/95. A slightly larger version of this project was denied by the Commission on 10/10/95 (minutes enclosed). The denied application consisted of four (4.) fueling positions and 1,000 square feet of convenience store/deli. The first issue the Commission will have to address is whether to reconsider this application. The applicant has submitted a written statement (see enclosed) which sets forth his reasons why the Commission should reconsider his application. This property located at 801 Williston Road lies within the Cl District. It is bounded on the west by Spear Street, on the south by a residence and the Burlington Tennis Club, on the east by a service station and Staples Plaza, and on the north by Williston Road. Access/circulation: Access is not proposed to be changed. S+cere)i, r e Weith, ty Planner JW/mcp 1 Encl PLANNING COMMISSION 28 November. 1995 The South Burlington Planning Commission held a meeting on Tuesday, 28 November 1995, at 7:30 pm, in the Conference Room, City Hall, 575 Dorset St. Members Present: William Burgess, Chair; Mac Teeson, Mark Crow, Terry Sheahan, David Austin, Gayle Barone Also Present: Joe Weith, City Planner; Jim Carlson, Randall Kay, Shelley Snyder, Dean Economou, Dean Zoecklein, Don Miner., Jimmy Leas, Bill, Walt and David Simendinger 1. Other Business: Mr. Weith gave members an appeal from Charles Wilkins and Maclean Corp. to a denial of their application because of a curb cut. Mr.. Weith also gave members a copy of a letter from C-regg Beldock regarding violations the Planning Commission has been trying to get corrected. Messrs. Austin and Crow noted their conflict of interest in this matter and did not participate in the dis- cussions. Mr. Beldock has asked how to proceed. Mr. Weith said he had told him either to do the project according to the plan or to come back to the Commission to try to change the plan. Mr. Burgess noted the Commission has the option to revoke the Certificate of Occupancy based on the violations. Mr. Weith noted the violations include encroachment into the CO Zone and a shortfall of parking. Members felt Mr. Beldock should come in to address the issues. Mr. Teeson noted that if he doesn't make a formal appeal, the Commission's only alternative is to pull the Certificate of Occupancy or go to court. Mr. Teeson also noted the tone of Mr. Deldock's letter was antagonistic. Members asked Mr. Weith to draft a letter for Commission approval. Mr. Teeson asked if escrow funds are still being held. Mr. Weith said there are some landscape and infrastructure bonds. 2. They had proposed a stockade ienca along the building. They have put up a fence 48 ft. back which blocks the view from the road. Mr. Carlson also showed the location of parking and noted there is not a high volume of traffic. Mr. Sheahan suggested setting aside space for additional parking, if needed. Mr. Weith noted the original plan showed perpendicu- lar spaces with storage along the back. Mr. Carlson said they needed that space. Mr. Teeson suggested moving the fence to the edge of the building. That would result in extra parking at no added expense. Mr. Carlson showed pictures of the site to the Commission. Mr Teeson also suggested moving the fence back 28 ft. and putting in a swing gate. This would also result in extra parking. Mr. Burgess said he hadn't heard a convincing argument not to correct the discrepancies. He felt the pictures showed that ad- ditional parking was needed as there are cars all over the place. Members wanted to see a plan that had at least 17 parking spaces. . Austin moved to continue the application until 9 Janu 96. Mr.. Teeson seconded Motion assed unanimously. 3. The lot is 42000 square feet. This business will manufacture ceramic pottery on the first floor with offices on the mezzanine floor. The height is 24 feet. Access: Access is shown from 2 driveways from Ethan Allen Drive. One of these serves trucks using the loading dock which is located at a lower grade. The other serves the public/employee parking lot. I suggest that if two driveways are absolutely essential, the parking lot driveway should be a shared driveway with lot #11 to the west. Otherwise, only one driveway should be allowed and the site redesigned. Circulation: A 22 foot wide aisle serves the parking lot. A turnaround is shown at the end of the lot. Trucks loading and unloading will have to back into the lot from the street. This is not ideal. See Bill Szymanski's comments. Parking: Thirteen parking spaces are shown which should be sufficient for 10 employees. There should be a 5 foot buffer along the western property line but to achieve this the building, the aisle width, or the 5 foot landscaped strip along the edge of building would have to be reduced. Evidently, the building can not be moved easterly because of the grade. Landscaping: A $2280 landscaping bond is required for this $76,000 building. The plan shows landscaping valued at slightly less than the required amount with 4 white pine and 20 junipers. An additional white pine of the same size will make up the difference. This lot is one of several commercial lots formed under Land Use Permit #4CO643. The proposed Project shall be a 7,500 square foot warehouse used for light manufacturing of pottery with administrative office space. Water will be supplied by the South Burlington Water Department and waste water will be disposed of on site, by means of a conventional septic system. As stated in the Land Use Permit #4CO643 all amendments will be reviewed under criteria 1 (Air), 1B (Storm Water), 1C (Water Conservation), 2, 4, 5, 7 (Fire Services), 8, 9(F) and 9W. Response to the criteria pertaining to the amendment application are as follows: 1. (Air Pollution) The proposed building will be heated by bottled gas and emissions will be typical of bottled gas exhaust. Conversion to natural gas would be a desirable option should it become available. Heating in specific areas will be gas fired hot air in the office, with 5 gas fired infrared heaters in the warehouse and shop area. The infrared heaters have a capacity of 60,000 BTU/hour each, and the gas fired hot air heater has a capacity of 120,000 BTU/hour. Noise and odor are not anticipated to be a problem since the intended use is commercial and conforms to the zoning of the area. No heavy industrial work is proposed and only light ceramic manufacturing will take place on the site. Noise generated will be only that of traffic and will access during typical business hours which are 3 to 5. Design • Inspection • Studies • Permitting • Surveying Mr. Geoffrey Green FILE: 37028 9 June 1987 Page Two As part of the ceramic manufacturing process, pottery is baked in an oven/kiln which reaches a temperature of 2200 degrees Farenheit. The Onion River Pottery company is currently using an electric kiln and plans to use this kiln in the new building. No harmful emissions will come from the baking process. Dust will be controlled during construction by the application of calcium chloride or water as conditions require. Post construction conditions of the site will reveal grassed lawns with several shrubs throughout the property and a gravel drive and parking lot. Thirteen parking spaces are proposed including one handicapped space. The 13 parking spaces proposed are 5% of the total 260 parking spaces allocated to the subdivision under the original Land Use Permit #4C0643. No air quality permit is required. 1B. (Waste Disposal) Sewage disposal will be accomplished on site by a conventional septic tank and leach field system. Based on the criteria outlined in the Vermont Environmental Protection Rules, the septic system was designed to handle 330 gallons per day of sewage; this number was based on 15 gallons/day/employee. The soils on the site are mapped by the Soil Conservation Service as Agawam loamy fine sands. Test pit imformation on the site reveal that these soils extend to a depth of 12'+/- showing no evidence of ground water. A certification of compliance has been applied for and a copy of the approval is enclosed with this application. Stormwater The project does not involve any paved parking or drive areas. The relative porosity of the soils in the areas indicate treatment of storm water will be by means of overland flow with no concentrated discharge points. Application has been made to the Department of Water Resources for a Discharge Permit. Solid Waste These are no stumps or any other organic debris which will be disposed of on site. All construction debris will be disposed of in a state approved landfill. Materials such as glazes used in the manufacturing process are non -toxic earthen compounds. Expected wastes generated will be from cleaners and other household solvents commonly used and sold. 1C. (Water Conservation) The applicant is willing to have as a condition of the permit low flow fixtures installed in the building. 2. & 3. Sufficient Water The estimated demand for water in gallons per day is 330. Water will be supplied to the project by the South Burlington Water Department via 8" water main on Ethan Allen Drive. The estimated average daily demand of 330 gallons per day is well below the 1000 gallons allocated to the lot under the original Land Use Permit #4C0643. Application has been made to the municipality for connection to the main, and is forthcoming. 4. Erosion Control An erosion potential analysis was performed on the site using the standards outlined in the Vermont Handbook for Soil Erosion and Sediment Control on Construction Sites. The site was determined to have a low erodibility potential. Erosion control practices have been incorporated in the site plan to minimize the movement of soil off the site. The soils on the site are listed as Agawam loamy fine sands. Because these sands can accept large amounts of water through infiltration, erosion control practices during construction will be to seed and mulch the areas as soon as final grading is complete. 5. Traffic The 13 lot subdivision has been approved under the existing Land Use Permit #4C0643 for 815 vehicle trip ends per day with 197 p.m. peak hour vehicle trips. Using data supplied by the Institute of Traffic Engineers, Trip Generation Report 1983, we can estimate the expected number of vehicle trip ends. The building consists of 6,550 square feet warehouse space and 950 square feet of office space. (Fire Services) As stated in condition #6 of the existing Land Use Permit review by the South Burlington Fire Department for adequate fire fighting capacity and emergency vehicle access and approval is required prior to issuance of an amended permit. South Burlington Fire Chief James Goddette has reviewed and approved the project. An approval letter is included herein. 8. Aesthetics There are no known historic sites, natural areas or necessary wildlife areas that will be affected by the Project. Our statement is supported by the findings of fact issued by the Commission in the original Land Use Permit #4C0643. Exterior lighting within the Project will be of a non -glare sharp cut off luminaire type. Interior lighting will be 4' and 8' flourescent fixtures. Ground cover will be primarily grass with several trees and shrubs mixed in. For additional information regarding the planting schedule, see the landscape plan. A sign identifying the Project is proposed for the building. It will be constructed out of wood, lettering will be hand painted and will be 16 Sq.Ft. in size. No external source of illumination is proposed at this time. To access the rear of the property the owner would like to remove a section of existing woven wire fence. As stated in condition number 11 of the original Land Use Permit #4C0642, no construction shall take place beyond the fence line as delineated by the site plan. 9F. Energy Conservation The building will be heated by bottled gas and convert to natural gas when available. Insulation will conform to ASHRAE 90-80 standards. 9K. Development Affecting Public Investment There are vacant lots on both sides of the proposed building, a city street and a third vacant lot across the street. The project is in a section of the city which is zoned co►mercial and is expected to beco►ne a small commercial section. Public investment nearby is the existing roadway, Ethan Allen Drive. The generation of 85 vehicle trip ends is within the 315 allocated by the previous Land Use Permit and will not impose an undue burden on the capacity of the roadway. During this discussion, Mr. Belter stepped down from the Commission due to a conflict of interest. Mr. Goodrich explained that Onion River Pottery manufactures ceramic cups. The are now located in Winooski and have 11 employees. The lot is .9 acre, 120 ft. wide and 350 ft. deep. The depth of the lot causes a problem as the las't40o is unusable because of a steep pitch. As there are trucks coming to deliver and pick up goody a 4 ft. loading dock is needed. The 5 ft. rise in the land is ideal for the loading operation; however, the 15' side setback requirement requires the moving of the dock to a less desirable location. Mr. Gc,--064% explained that they usually have 1 UPS and one other trailer truck per day.. They are also requesting 2 curb cuts, one for the trucks and one for employees. Since they are at the end of the line of buildings, they didn't feel this would be a problem. Mr. Dooley asked if it would be possible to merge one curb cut with an adjacent lot. Mr. Belter said that the Masons, who have the adjacent lot under lease, feel this would be a problem for them. Mrs. Lafleur noted that there is no landscaped buffer along the back of the parking area to the property line as they chose to put in a 5-foot strip adjacent to the building. Mr. Belter said that most likely snow would be pushed to the rear of the lot. Members felt they would rather see the 5-foot buffer along the adjacent lot. Mr. Goodrich agreed to provide a revised landscaping plan. Mr. Dooley moved that the Planning Commission approve the site plan application of Julian Goodrich Architect, agent for construction of a 8303 sq. ft. building for light manufactur- ing and office space for Onion River Pottery, lot #12 'Ethan Allen Drive as depicted on a plan entitled "Onion River Pottery" prepared by J.G.Architects, Inc, dated December 5, 1986 with the following stipulations: �1. All leases for said units shall require the maintenance of the same. 13. The Permittee shall comply with Exhibit #7 for erosion control. The Permittee shall prevent the transport of any sediment beyond that area necessary for construction approved herein. From October 1 to April 15 of any calendar year, all disturbed areas of the construction site shall be mulched until final vegetative cover is established.
