FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Findings of Fact, site plan application of ACM Realty to construct a 6475 sq. ft. warehouse building, 86
Ethan Allen Drive.
On the 2nd day of November, 1999, the South Burlington Development Review Board approved the site plan
application of ACM Realty under Section 26.10 of the South Burlington Zoning Regulations based on the
following findings:
1. This project consists of constructing a 6475 square foot warehouse building.
2. This property located at 86 Ethan Allen Drive lies within the IC District.
3. The record owners of this property are Chris & Mike Senesac, ACM Realty.
4. Access/Circulation: Access is proposed to be via a 30 foot curb cut on Ethan Allen Drive.
Circulation on the site is adequate.
5. Coverage/setbacks: Building coverage is 15.62% (maximum allowed is 30%). Overall coverage is 39.44%
(maximum allowed is 70%). Front yard coverage is 26.9% (maximum allowed is 30%).
Setback requirements have been met.
6. Parking: A total of 16 parking spaces are required and 17 spaces, including one handicapped space and a
bike rack are being provided. The plan should be revised to note the correct parking requirement for office
space which is 1 space/250 square feet.
7. Landscaping: The minimum landscaping required, based on building costs, is $5,828 which is being met.
Plantings will include Red Maple, Rose Glow Barberry, and White Pine. The plan should be revised to provide
a 15 foot green strip along the property's frontage as required under Section 25.107 of the zoning regulations.
Coverages should be adjusted accordingly.
8. Lighting: Exterior lighting consists of three 12" wall mounted fixtures with 100 watt metal halide lamps.
Prior to issuance of a zoning permit, the applicant should submit details of proposed building mounted lights to
the Director of Planning & Zoning for approval.
9. Dumpster: The dumpster will be screened by a 6 ft. high stockade fence.
10. Traffic: This project is exempt from the road impact fees.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board approves the site plan
application of ACM Realty to construct a 6,475 square foot warehouse building, 86 Ethan Allen Drive, as
depicted on a two (2) page set of plans, page one (1) entitled, `Beher Park Lot 11 Ethan Allen Drive South
Burlington, Vermont," prepared by O'Leary - Burke Civil Associates, PLC, dated 5/20/99, last revised on
8/27/99, with the following stipulations:
1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect.
2) The plat plan shall be revised to show the changes below and shall require approval of the Director of
Planning & Zoning Three (3) copies of the approved revised plans shall be submitted to the Director of
Planning & Zoning prior to permit issuance:
a) The plan shall be revised to note the correct parking requirements for office space is one (1)
space/250 square feet.
b) The plan shall be revised to provide a 15 foot green strip along the property's frontage as required
under Section 25.107 of the zoning regulations. Coverage shall be adjusted accordingly.
3) All exterior lighting shall consists of downcasting shielded fixtures. Any change to approved lights shall
require approval of the Director of Planning & Zoning prior to installation. Prior to permit issuance, the
applicant shall submit details of the proposed building mounted lights to the Director of Planning & Zoning for
approval.
4) Prior to issuance of a zoning permit, the applicant shall post a $5828 landscape bond. The bond shall
remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving.
5) The Planning Commission approves a sewer allocation of 225 gpd. The applicant shall be required to pay
the per gallon fee prior to permit issuance.
6) The building shall be sprinklered.
7) The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning
regulations or this approval is null and void.
8) The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to
use of the building.
9) Any change to the site plan shall require approval by the South Burlington Development Review Board.
