HomeMy WebLinkAboutSP-02-55 - Decision - 0086 Ethan Allen Drive#SP-02-55 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, site plan application #SP-02-55 of Chris & Mike Senesac of ACM Realty to amend a previously approved site plan consisting of a 5,500 square foot warehouse building. The amendment consists of minor alterations to the layout, building, and landscape, 86 Ethan Allen Drive. The Development Review Board last approved this plan on June 19, 2001. On the `'_tn of November 2002, the Director of Planning and Zoning approved the request of Chris and Mike Senesac of ACM Realty, seeking site plan approval under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1) This project consists of an amendment to a previously approved site plan consisting of a 5,500 square foot warehouse building. The amendment consists of minor alterations to the layout, building, and landscape. 2) The owner of record is Chris and Mike Senesac, ACM Realty. 3) This property located at 86 Ethan Allen Drive lies within the IC District. It is bounded on the east by Swedish Pit, on the west by an industrial commercial lot owned by Belter, on the south by Ethan Allen Drive, and on the north by Belter Farm. The only issues affecting the site plan are parking, coverage, and landscaping. 4) Coverage/Setback: Building, overall, and front yard coverage remain unchanged from the previous approval at 19%, 59.4%, and 26%, respectively. The layout of the site including curbing and green space has changed slightly. 5) Parking: The parking requirement is 16 spaces. The plan shows 13 parking spaces which is a 3 space or 19% shortfall. 6) Landscaping: The minimum landscaping requirement based on construction cost is $5,828. The minimum landscaping requirement is met. The plantings include spirea, barberry, linden, and eastern white cedar. DECISION AND CONDITIONS Based on the above Findings of Fact, the Director of Planning & Zoning approves site plan application #SP-02-55 of Mike and Chris Senesac of AMC Realty to amend a previously approved site plan consisting of a 5,500 square foot warehouse building. The amendment consists of minor alterations to layout, building, and landscape, 86 Ethan Allen Drive, as depicted on a site plan entitled `Belter Park Lot 1 I Ethan Allen Drive South Burlington, Vermont" prepared by O'Leary Burke Civil Associates, PLC, dated 5/20/99 , last revised on 6/04/02, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) The Director, pursuant to Section 26.256 (b), approves the 3 space or 19% parking shortfall. 3) The applicant shall obtain a zoning permit within six (6) months, pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 4) The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the building. 5) Any change to the site plan shall require approval by the Director of Planning & Zoning.
