MOTION OF APPROVAL 11/12/96 BERARD CONSTRUCTION COMPANY, INC. I move the South Burlington Planning Commission approve the site plan application of Berard Construction Company, Inc., to amend a previously approved site plan for a 10,360 square foot light manufacturing building. The amendments consist of: 1) razing a 380 square foot portion of the building, and 2) constructing a 2220 square foot addition for a total square footage of 12,200 square feet, 87 Ethan Allen Drive, as depicted on a plan entitled, "Addition to the Top Shop Ethan Allen Drive," prepared by J.G. Architects, Inc, last revised 10/30/96 with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The plans shall be revised to show the changes below and shall require approval of the City Planner. Three (3) copies of the approved revised plans shall be submitted to the City Planner prior to permit issuance. a) The site plan shall be revised to indicate the species, quantity and size of the proposed cedar shrubs. b) The site plan shall be revised to include the property's street address. c) The plan shall be revised to reduce the front yard coverage along Commerce Avenue so as not to exceed the 30% front yard coverage limitation. 3. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Planning Commission estimates that the proposed expansion will generate 1.4 additional vehicle trip ends during the P.M. peak hour. Cg. 4. Any new exterior lighting shall be downcasting shielded fixtures so as not to cast light beyond the property line. Any change in lighting shall be approved by the City Planner prior to installation. 5. These dumpsters should be placed in their approved location as shown on the plan. 8) BERARD CONSTRUCTION COMPANY, INC. - LIGHT MANUFACTURING ADDITION - SITE PLAN This project consists of amending a previously approved site plan for a 10,360 square foot light manufacturing building. The amendment consists of: 1) razing a 380 square foot portion of the building, and 2) constructing a 2220 square foot addition for a total square footage of 12,200 square feet. This building was originally approved on 6/14/88 (minutes enclosed). This property located at 87 Ethan Allen Drive lies within the IC District. It is bounded on the north and south by industrial buildings, on the west by Ethan Allen Drive and on the east by Commerce Avenue. Access/circulation: Access is by a 32 foot curb cut on Ethan Allen Drive and a 25 foot curb cut on Commerce Avenue. No changes proposed. Circulation on the site is adequate. Coverage/setback: Building coverage is 29.9% (maximum allowed is 30%). Overall coverage is 62.1% (maximum allowed is 70/5). Front yard coverage along Commerce Avenue was increased from 20.8% to 34% and along Ethan Allen Drive from 19.3% to 31.6% (maximum allowed is 30%). These increases in front yard coverage were never approved. Plan should be revised to reduce coverages to meet the 30% limitation. Setback requirements are met. Parking: A total of six (6) parking spaces are required and 11 spaces including one (1) handicapped space are being provided. A bike rack will be provided as required under Section 26.253(b) of the zoning regulations. Landscaping: The minimum landscaping requirement, based on building costs, is $2700 which is being met. The plan should be revised to indicate the species, quantity and size of the cedar shrubs. Sewer: No additional sewer allocation needed. Traffic: ITE estimates that the current facility generates 7.8 vehicle trip ends (vte's) during the P.M. peak hour and with the addition to generate 9.2 vte's for a 1.4 vte increase. The applicant should be aware that the road impact fee will be approximately $20.00. Dumpster: The dumpster will be screened by a cedar hedge. Lighting: No additional lighting proposed. The reason that the front yard coverage does not meet the City ordanance now is because the building was built before the curbs and pavement were completed. When the street was paved it was decided by the City Engineer to move the whole street south 7 or 8 feet, because it was too expensive to have the telephone line moved back to the north to accopmodate the new road. This, therefor took away the "green area" on the south side of the road of all property owners. She also noted that the landscaping plan was slightly different. Mrs. Maher asked for additional evergreens cc the plan. Mr. Steven Winters was present for Cumberland Farms. Mr. Spitz pointed cut the location on Shelburne road. He said that currently there are gas pumps in the right -of --way and a Morgan Store (now cumberland Farms) just behind it. They are proposing to tear down the current building and build a new 3-X=�^--, square focit building with a canape over 3 double sided gas pumps. The canopy would meet the set backs and be 50 feet back from the property line and the building even further back from that. He said that some of the residences and the Funk: of Vermont next door have been very concerned about filling the back of the property. He pointed out that the jog in the building is to meet the set backs where the residential zone starts. The back portion of the property is border by residences. They are proposing to build a fence to protect the bank: and the neighbors cc the same side as the bank:. They will also add plantings for screening. Mr. Spitz said that in the front of the building they are going from 0% green space to creating 44% greenspace. Mrs. Maher asked for an explanation of oar circulation. Mr. Spitz explained that there would be one entrance/exit and one exit only for a total � �f two curb outs. The great majority of traffic will be entering from the south. Cars going north will be using the north exit. Mrs. Maher asked how this northerly exit would be shaped to disccttrage oars from entering. Please refer to the note on landscapeing on the preliminary plan submittal. New location of the dumpster is attached. There are two company vehicles operating from the property. The front yard coverage on Ethan Allen Drive and Commercial Avenue will remain as they exist. No change is planned. Existing exterior lighting is to remain the same. No additional exterior lighting is planned. The existing security light over the northeast overhead door will be over the relocated overhead dood on the addition. There is no change planned to the existing pavement on the north east corner of the lot. There will be a new cedar hedge to screen the dumpster as show on the preliminary plan. Hay bale dams and silt fences shall be installed as depicted on the plans prior to commencement of construction. The Permittee shall prevent the transport of any sediment beyond that area necessary for construction approved herein. All disturbed areas of the construction site shall be stabilized, seeded and mulched within 1 to 14 days of initial disturbance, and prior to October 1, to ensure proper stabilization of disturbed soils. All erosion control devises shall be periodically cleaned, replaced and maintained until vegetation is permanently established on all slopes and disturbed areas. The project is approved for the following maximum cumulative impacts: 18 vehicle parking spaces, 150 gallons per day of water and wastewater, 30 vehicle trips per day, 20 peak hour vehicle trips. 6. This permit hereby incorporates all of the conditions of the Subdivision/Public Building Permit # issued on by the Regional Engineer, Division of Protection, Department of Environmental Conservation, Agency of Natural Resources. Conditions of this permit are as follows: 7. The Permittee shall apply and maintain calcium chloride and/or water on all roadways or disturbed areas within the project during construction and until pavement and/or vegetation is fully established to control dust. 8. The building approved herein is not approved for any manufacturing use or the on -site disposal of any process wastes. The Permittee shall apply and receive approval for any change in the use of the buildings which involves the storage or handling of any regulated substances or the generation of hazardous wastes. 9. The Permittee shall apply to the District Environmental Commission for approval for any change in the use of the building and land and manufacturing processes which would cause noxious or unhealthy emissions into the air or injection of toxic wastes into the soils. 11. The Permittee and all assigns and successors in interest shall install and maintain water conserving plumbing fixtures, including but not limited to low -flush toilets, low -flow showerheads, and aerator type or flow restricted faucets. All leases and deeds shall require the maintenance of the same. 12. The Permittee shall comply with Exhibit #8 for erosion control. Hay bale dams and silt fences shall be installed as depicted on the plans prior to commencement of construction. The Permittee shall prevent the transport of any sediment beyond that area necessary for construction approved herein. All disturbed areas of the construction site shall be stabilized, seeded and mulched within 1 to 14 days of initial disturbance, and prior to October 1, to ensure proper stabilization of disturbed soils. All erosion control devises shall be periodically cleaned, replaced and maintained until vegetation is permanently established on all slopes and disturbed areas. The District Environmental Commission reserves the right to schedule hearings and site inspections to review erosion control and to evaluate and impose additional conditions with respect to erosion control as they deem necessary. 13. In addition to conformance with the requirements of condtion #12 the Permittee shall not cause, permit, or allow the discharge of waste materials into any surface waters. Compliance with the requirements of this condition, does not absolve the Permittee from compliance with 10 V.S.A., Chapter 47, Vermont's Water Pollution Control Law. 14. The Permittee and all assigns and successors in interest shall continually maintain the landscaping as approved in Exhibit #8 by replacing any dead or diseased plantings as soon as seasonably possible. 15. The installation of exterior light fixtures is limited to those approved in Exhibit # , and shall be mounted no higher than 20 feet above grade level. All exterior lighting shall be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. , Page 4 Land Use Permit Amendment #4CO643-5 16. No exterior signs shall be installed without the prior written approval of the District Environmental Commission. 17. All heated structures approved herein shall be constructed with insulation with an R Value of at least R-19 in the exterior walls, at least R-38 in the roof or cap and to comply with the ASHRAE 90-80 standards. 18. The installation and or use of electric resistance spaceheating is specifically prohibited without the prior written approval of the District Environmental Commission. 19. All construction on this project must be completed by October 15, 1988. 20. The permit shall expire on October 15, 2019 unless extended by the District Environmental Commission. Notwithstanding, this permit shall expire one year from date of issuance if the Permittee has not demonstrated an intention to proceed with the project. The Permittees shall apply to the District Environmental Commis- sion for approval for any change in the use of the building and land which would cause noxious or unhealthy emissions into the air or injection of toxic wastes into the soils. 13. The Permittees and all assigns and successors in interest shall install and maintain water conserving plumbing fixtures. The plumbing fixtures shall operate with the following specifica- tions: (1) internal system water pressure of 50 psi maximum, (2) toilets with a maximum of 3.5 gallons per flush, (3) showerheads operating with a maximum of 3 gallons per minute, and (4) faucets on sinks and lays shall operate at a maximum of 3 gallons per minute. An alternative water conservation plan may be presented to the Commission for approval before implementation. The ap- proved alternate shall be implemented and maintained by the Permittees for the duration of the permit. 14. The Permittees shall comply with Exhibits #3 and #9 for erosion control. Hay bale dams and silt fences shall be installed as depicted on the plans prior to commencement of construction. The Permittee shall prevent the transport of any sediment beyond that area necessary for construction approved herein. All disturbed areas of the construction site shall be stabilized, seeded and mulched within 1 to 14 days of initial disturbance, and prior to October 1, to ensure proper stabilization of disturbed soils. All erosion control devices shall be periodically cleaned, re- placed and maintained until vegetation is permanently estab- lished on all slopes and disturbed areas. The Commission re- serves the right to schedule hearings and site inspections to review erosion control and to evaluate and impose additional conditions with respect to erosion control as they deem ne- cessary. The Permittees shall also comply with the winter erosion control procedures oulined in the Vermont Handbook for Soil Erosion and Sediment Control on Construction Sites. 15. Prior to commencement of construction, the Permittees shall have a professional engineer, or other qualified person certify that the erosion control plan contains site specific erosion control mea- sures necessary to provide a level of protection at least equiva- lent to the procedures outline in the Vermont Handbook for Soil Erosion and Sediment Control on Construction Sites. 16. In addition to conformance with the requirements of condition #14 and 15, the Permittees shall not cause, permit or allow the discharge of waste materials into any surface waters. Compliance with the requirements of this condition does not absolve the Permittees from compliance with 10 V.S.A., Chapter 47, Vermont°s Water Pollution Control Law. All exterior lighting shall be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. 19. The exterior of the building will have a light brown and red brick exterior, with a dark, non -reflective roof. 21. The installation and or use of electric resistance space heating is specifically prohibited without the prior written approval of the District Environmental Commission. 23. Access: Access is shown from both Ethan Allen Drive and the new road built on the south side of Ethan Allen Drive. The plans show a 24 foot wide drive from both streets. Circulation: Circulation is shown in front of and in back of the building. No circulation is available on the sides of the building due to the narrowness of the lot and the width of the building.
