The consent of the developer to such payment by the Bank to the Municipality shall not be required. The Bank shall incur no liability to the Developer on account of making such payment to the Municipality , nor shall the Bank be required to inquire into the propriety of any claim by the Municipality of default on the part of the Developer or into the use of such funds by the Municipality in completing such improvements. 7. The Municipality shall not file with the Bank a statement of default until thirty (30) days after notice has been sent by it to the Developer by certified mail, return receipt requested, setting forth its intention to do so. 8. All monies released by the Bank to the Municipality pursuant to paragraph five (5) shall be used by the Municipality solely for the purpose of performing obligations imposed upon the Developer by that portion of this Agreement upon which the Developer is then in default. Any work to be performed by the Municipality pursuant hereto shall be let on a contractual basis, or on a time and material basis or shall be performed by the Municipality with its own work force and equipment or shall be accomplished in such a manner as in the judgement of the Municipality shall accomplish the work most expeditiously and economically. 9. If monies are released by the Bank to the Municipality pursuant to paragraph five (5) and it shall later develop that a portion of the released monies are surplus to the Municipality's needs, any such surplus shall be refunded by the Municipality to the Bank to be held and distributed by the Bank pursuant to the terms of this Agreement. 10. The Bank will not refuse or delay to make such payments to the Municipality when requested by the Municipality by the appropriate statement, and Developer will not interfere with or hinder such payments by the Bank to the Municipality. Said statement shall contain a certificate of compliance with the notice requirements of paragraph seven (7) of this agreement. 11. This agreement shall terminate and shall be of no force or effect upon performance of all requirements contemplated hereby, and the completion of the warranty period set forth in paragraph three (3). 12. By acceptance of this permit, the Permittees agree to allow representatives of the State of Vermont access to the property covered by the permit, at reasonable times, for the purpose of ascertaining compliance with Vermont environmental and health statutes and regulations and with this permit. The project shall be completed, operated and maintained in accordance with: the plans and exhibits on file with the District Environmental Commission, and the conditions of this permit. The approved plans are: Sheet 1 - "Site Plan, Loso Commercial/Industrial Blgd." dated 4/5/06, last revision 4/18/06; Sheet 2 - "details, Loso Commercial/Industrial Blgd." dated 4/6/06; and Sheet A2 - "Floor Plan, Loso Commercial/Industrial Blgd." dated 1/9/06, last revision 2/8/06. No changes shall be made in the design or use of this project without the written approval of the District Coordinator or the Commission, whichever is appropriate under the Environmental Board Rules. 7. Pursuant to EBR 51(G), the permit application and material representations relied upon during the review and issuance of this permit by the District Commission shall provide the basis for determining future substantial and material changes to the approved project and for initiating enforcement actions. The District Environmental Commission maintains continuing jurisdiction during the lifetime of the permit and may periodically require that the permit holder file an affidavit certifying that the project is being completed, operated and maintained in accordance with the terms of the permit, as provided by 10 V.S.A. §§ 6001-6092 and the rules of the Environmental Board. By acceptance of the conditions of this permit without appeal, the Permittees confirm and agree that the conditions of this permit shall run with the land and the land uses herein permitted, and will be binding upon and enforceable against the Permittees and all assigns and successors in interest. 10. The project is approved for the following maximum impacts: 8 - vehicle parking spaces (73 remaining for Phase 2 of park), 330 - gallons per day of water and wastewater (10,906 remaining for Phase 2 of park), 15 - vehicle trips per day (316 remaining for Phase 2 of park), and 7 - AM peak hour vehicle trips (68 remaining for Phase 2 of park). 11. This permit hereby incorporates all of the conditions of the following Agency of Natural Resources Permits: • Potable Water Supply and Wastewater System Permit #WW-4-261.1 issued on May 5, 2006 by the Wastewater Management Division; and • Final Discharge Permit #3-9015 issued on June 7, 2006 by the Water Quality Division. Any subsequent nonmaterial changes to these permits shall be automatically incorporated herein upon issuance by the Agency of Natural Resources. Subsequent amendments involving material changes to the Act 250 permit shall not be constructed prior to review and approval of the District Coordinator or the District Commission under applicable Environmental Board Rules. 12. The Permittees shall apply and maintain calcium chloride and/or water on all roadways or disturbed areas within the project during construction and until pavement and/or vegetation is fully established to control dust. 13. There shall be no floor drains installed at the facility without first acquiring the required Underground Injection Control Permit from the Water Supply Division of the Agency of Natural Resources. Land Use Permit #4C0643-25 Page 3 of 5 14. The Permittees and all subsequent owners or lessees shall install and maintain only low -flow plumbing fixtures in any buildings. Any failed water conservation measures shall be promptly replaced with products of equal or better performance. 15. The Permittees shall comply with Exhibits #11 and #12 for erosion control. The Permittees shall prevent the transport of any sediment beyond that area necessary for construction approved herein. All erosion control devices shall be periodically cleaned, replaced and maintained until vegetation is permanently established on all slopes and disturbed areas. The Commission reserves the right to schedule hearings and site inspections to review erosion control and to evaluate and impose additional conditions with respect to erosion control as it deems necessary. 1.6. All mulch, siltation dams, water bars and other temporary devices shall be installed immediately upon grading and shall be maintained until all roads are permanently surfaced and all permanent vegetation is established on all slopes and disturbed areas. Topsoil stockpiles shall have the exposed earth completely mulched and have siltation checks around the base. 17. Grading shall be phased so that all exposed earth is mulched and water bars are in place at the end of each construction day. 18. All disturbed areas of the site shall be stabilized, seeded and mulched immediately upon completion of final grading. All disturbed areas not involved in winter construction shall be mulched and seeded before October 1. Between the periods of October 1 to April 15, all earth disturbing work shall conform with the "Winter Construction" standards and specifications of the Vermont Handbook for Soil Erosion and Sediment Control on Construction Sites (1987). 19. Prior to construction of the approved work, the Permittees shall complete the following: a) construction limits shall be clearly delineated with flagging or snowfencing; b) diversion ditches shall be placed on the uphill limits of the construction area; and c) temporary siltation controls shall be placed on the downhill limits of the construction. Immediately following the above, the permanent drainage system and/or roads shall be installed after which normal construction can begin. 20. A copy of the approved erosion control plan shall be on the site at all times during construction. 21. In addition to conformance with all erosion control conditions, the Permittees shall not cause, permit or allow the discharge of waste material into any surface waters. Compliance with the requirements of this condition does not absolve the Permittees from compliance with 10 V.S.A. (§§ 1250-1284) Chapter 47, Vermont's Water Pollution Control Law. 22. The Permittees shall maintain a 50-foot undisturbed, naturally vegetated buffer strip between the Class Two wetland and any disturbed areas. The boundary of the Class Two wetland's 50-foot buffer shall be memorialized with permanent markings by either a split rail fence or boulders. 23. All stumps shall be disposed of on -site above the seasonal high water table or at a State approved landfill so as to prevent groundwater pollution. Land Use Permit #4C0643-25 Page 4 of 5 24. The installation of exterior light fixtures is limited to those approved in Exhibit #11, and shall be mounted no higher than 13 feet above grade level. All exterior lighting shall be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. 25. The Permittees shall not erect .additional exterior signage without first obtaining approval from the District Commission. Signage includes banners, flags, and other advertising displays, excepting temporary real estate marketing signs. 26. The project shall conform with the 2001 Vermont Guidelines for Energy Efficient Commercial Construction and shall further include custom energy measures referenced in interagency comments by the Department of Public Service if found cost-effective on a life -cycle -cost basis. Any design or equipment features that do not comply with the 2001 Guidelines, or any custom measures not installed, shall be brought promptly to the attention of the Department of Public Service for comment and to the District Commission for approval prior to construction. 27. The installation and/or use of electric resistance space heat is specifically prohibited without the prior written approval of the District Environmental Commission. 28. Each prospective purchaser of any lots shall be shown a copy of the approved plot plan, Potable Water Supply and Wastewater System Permit and the Land Use Permit Amendment before any written contract of sale is entered into. 29. No further subdivision, alteration, and/or development of any parcel of land approved herein shall be permitted without the written approval of the District Commission. 30. The Permittees shall reference the requirements and conditions imposed by Land Use Permit #4C0643-25 in all deeds of conveyance and leases. 31. Pursuant to 10 V.S.A. § 6090(c) this permit amendment is hereby issued for an indefinite term, as long as there is compliance with the conditions herein. Notwithstanding any other provision herein, this permit shall expire three years from the date of issuance if the Permittees have not commenced construction and made substantial progress toward completion within the three year period in accordance with 10 V.S.A. § 6091(b). 32. Semi -Annual Inspection and Report The stormwater collection, treatment and control system authorized herein shall be properly operated and maintained and shall be inspected at least twice per year, once in .the spring after snowmelt and once in the fall prior to snow fall. The inspection shall evaluate the operation and maintenance and condition of the stormwater collection, treatment and control system. The permittee shall prepare a semiannual inspection report on a form available from the Department. The permittee shall, by November 1st and June 1st of each year, submit an inspection report to the Department. Restatement of Compliance An initial statement of compliance, signed by a designer, must be submitted to the Department no later than 6 months following completion of construction of the stormwater management system. Then, every 3 years, the permittee shall submit to the Department a written statement signed by a designer that the stormwater collection, treatment and control system authorized herein is properly operating and maintained. The first re -statement of compliance is due June 7, 2009. Failure to submit a designer's restatement of compliance shall constitute a violation of General Permit 3-9015 and may result in the revocation of this authorization to discharge. I have made the following revisions and provide the following additional information, based on technical review comments received during the site design approval process: City Engineer's comments: 1) I have relocated buried electrical, water and gas services to provide 10-feet of separation between the 6- inch water service and the other utilities; 2) Survey markers were added to the property early in the project by Lamoreux and Dickenson, land surveyors. I have shown these monuments on the site plan; 3) I have shown a new extension to the existing sidewalk to expand this walkway to the full width of the Loso parcel; 4) Bill Syzmanski requested a curb stop one foot from the street ROW. In discussing the installation of this large (6-inch) service with Jay Nadeau, he required a tapping sleeve and valve in the street at the water main, as I originally showed on my site plans. When we met with Bill Syzmanski on May 4th, he asked that we follow Jay Nadeau's requirement, so no changes to the water service valving has been made; 5) I have added an emergency overflow to Infiltration Basin A. Any overflow from Infiltration Basin B would flow northwest to the swale on the west side of the parcel, then flow into Infiltration Basin A. COMMENTS Criterion 1 (G) - Wetlands Erin K. Haney, District Wetlands Ecologist with the Vermont Wetlands Office, reviewed the application and reports: I agree with the wetland delineation as provided on the site plan, dated 04106106. Although the proposed project will not impact the 50 foot buffer zone around the Class II wetland, I recommend that the District Commission require that the applicant install permanent marking, such as boulders or split -rail fencing, to clearly defines the upland edge of the buffer zone. Such marking would help prevent any future encroachment by the unknowing, and may also serve to discourage the dumping of debris, trash, or fill in the buffer. Criterion 9(F) - Energy Conservation John M. Becker, Energy Program Specialist with the Department of Public Service (DPS) has reviewed the application for this project and endorses the inclusion of Condition #26 relating to the 2001 Energy Guidelines, and Condition #27 relating to no electric heat in the final permit. DPS supports permit issuance at this time; however, in reviewing the documents, it does not appear that a 9(J) ability to serve letter from the local electric utility was included the applicant should provide the 9(J) letter. There are certain custom energy efficiency measures that make the project better conform with Criterion 9(F). These should be installed if they are cost-effective on a life cycle basis. Rear Setback 30 ft. 180 ft. zoning compliance + zoning non-compliance SITE PLAN REVIEW STANDARDS Section 14.06 of the South Burlington Land Development Regulations establishes the following general review standards for all site plan applications: (a) The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. The proposed building will accomplish a desirable transition from structure to structure or from structure to site. According to Table 13-2 of the South Burlington Land Development Regulations, Business Service Use requires four (4) parking spaces for every 1,000 square feet of gross floor area (GFA) and Warehouse Use requires 0.5 spaces for every 1,000 square foot of GFA. Thus, the proposed 6,000 square feet of additional space will require 8.25 parking spaces. Eight (8) spaces including one (1) designated as handicapped are shown on the plan. The applicant should either add one additional space or request a waiver of one space, or 12.5%. The applicant shall adhere to the stipulations of the South Burlington City Engineer. The South Burlington Fire has reviewed the plans and provided comments in a letter dated April 14, 2006 (enclosed). 2. The applicant shall adhere to the stipulations of the South Burlington Fire Chief. The building is proposed to be one (1) story and be 18' high, which is consistent with the development on surrounding properties. (d) Newly installed utility services and service modifications necessitated by exterior alterations or building expansions shall, to the extent feasible, be underground. 4. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. (e) The DRB shall encourage the use of a combination of common materials and architectural characteristics, landscaping, buffers, screens and visual interruptions to create attractive transitions between buildings of different architectural styles. (f) Proposed structures shall be related harmoniously to themselves, the terrain, and to existing buildings and roads in the vicinity that have a visual relationship to the proposed structures. The plans depict one (1) screened dumpster on the northeasterly corner of the building. (d) Landscaping and Screening Requirements Pursuant to Table 13-9 of the Land Development Regulations, the proposed project will require a minimum of $3,750 of landscaping. The applicant is proposing $3,768 worth of landscaping. The South Burlington City Arborist has not yet had the opportunity to review the proposed landscaping plan. He should review the plans and provide comments. 5. The South Burlington City Arborist shall review the landscaping plan and provide comments. The applicant shall adhere to the comments of the South Burlington City Arborist. 6. The applicant shall provide planting details for all proposed trees and shrubs. Pursuant to Section 13.06(B) of the Land Development Regulations, snow storage areas must be specified and located in an area that will minimize the potential for run-off. The plans do not depict the snow storage area(s). 7. The plans shall be revised to show adequate snow storage area(s). CITY OF SOUTH BURLINGTON 5 DEVELOPMENT REVIEW BOARD Access/Circulation DEPARTMENT OF PLANNING & ZONING The proposed access to the subject property is a 36' wide curb -cut on Ethan Allen Drive. Staff finds this acceptable. Circulation on the site is adequate. Section 13.01(G)(5) requires that bicycle parking or storage facilities are provided for employees, residents, and visitors to the site. A bicycle rack is not depicted on the plans. 9. The site plan shall be revised to depict a bicycle rack. Traffic Due to a previous agreement, this property is not subject to traffic impact fees. Other 10. Please find my comments below. 1. The Application for Water Allocation previously provided must be completed and returned to the South Burlington Water Department as soon as possible. As your project continues, the Application for Water Allocation will need final approval from this Department, which will be contingent upon available water storage capabilities within the City. Current water distribution system upgrades have been substantially completed that should allow for the construction of your project, pending approval of all other local and State requirements. 2. Based upon the final water allocation request, water service fees shall be applied to the project based on the current Rate and Fee Schedule. It must be recognized by all developers that the Rate and Fee Schedule established by the South Burlington City Council may be modified by resolution at an open meeting of the City Council, and therefore subject to change prior to completion of the project. 3. All construction drawings and plans shall have a note saying "All water line and related work to be performed in accordance with the Specifications and Details for the Installation of Water lines and Appurtenances for all Water Systems Owned by the Champlain Water District the City of South Burlington Colchester Fire District #1 and the Village of Jericho, henceforth the "CWD Specification." 4. Mechanical joint restraints with twist off nuts shall be EBAA or Sigma, or a Department approved equal grip ring. 9. No underground utility shall be installed within four feet from the water main on either side, from the top of the main to the finish grade, with the exception of storm sewer and sanitary sewer as stated in the above referenced Specifications. Generally, trees shall not be placed over any water main or service line, nor placed within 20' of any appurtenance, including fire hydrants. 10. The SBWD shall be sent any future hard copy plans involving this project for review. Future plans must include details and specifications as required in the above referenced Specifications. 11. The SBWD shall be notified prior to backfilling to inspect all joints, fittings, main line taps, appurtenances, water line crossings, and testing. 12.
