The amendment consists of relocating the dumpster enclosure, 84 Ethan Allen Drive. Based on the plans and supporting materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. Harry & Diane Loso, hereafter referred to as the applicants, are seeking after -the -fact approval to amend a previously approved plan for a 6,000 sq. ft. mixed use building. The amendment consists of relocating the dumpster enclosure, 84 Ethan Allen Drive. 2. The owners of record of the subject property are Harry & Diane Loso. 3. The application was received on October 7, 2016. 4. The subject property is located in the Mixed Industrial - Commercial Zoning District. 5. The plan submitted is entitled "Loso Commercial/Industrial Bldg. South Burlington Vermont" prepared by Grover Engineering, PC, dated 4/06/06 and last revised on 10/14/15. DIMENSIONAL REQUIREMENTS 6.There are no dimensional changes associated with this application. 7. Setback requirements are being met. SITE PLAN REVIEW STANDARDS Only the standards below will are affected by this application. All other standards will continue to be met. (c) All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure, and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s), 8. A screened dumpster enclosure is shown on the site plan in its current location. The location of this enclosure was not correctly depicted in the last approved site plan (#SP-15-67). This criterion is being met. #SP-16-70 DECISION Based on the above Findings of Fact, the Administrative Officer hereby approves site plan application #SP-16-70 of Harry & Diane Loso, subject to the following conditions: 1. All previous approvals and stipulations shall remain in full effect except as amended herein. 2. This project must be completed as shown on the plat submitted by the applicant and on file in the South Burlington Department of Planning and Zoning. 3. The applicant must obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 4. The applicant must obtain a Certificate of Occupancy from the Administrative Officer upon the effective date of the zoning permit. 5. Any change to the site plan will require approval by the South Burlington Development Review Board or the Administrative Officer. Signed this day of i�C 1 2016, by Ra and J. This Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
