DECISION AND FINDING OF FACT
On the 12th day of June, 1995 the South Burlington Zoning Board
of Adjustment heard testimony regarding the Conditional use
application of Ken P. Smith, 81 Ethan Allen Drive, this meeting
was attended by Skip McClellan.
Based upon the testimony provided at the above mentioned public
hearing and the documents submitted to the Zoning Board of
Adjustment which are contained within the "document file" for
this application, the Zoning Board finds, concludes, and decides
as follows:
Findings of Fact
1) The area in question is zoned Mixed Industrial -Commercial
District.
2) Multiple use of a structure is a conditional use setforth
under Section 26.65 of the Zoning by-laws.
3) The applicant is requesting a multiple use approval for
permitted use setforth under Section 15.10 of the by-laws.
4) Two existing industrial lots will be merged and developed
with a 25,000 square foot building.
5) The total square footage of the parcel in question is 112,245
square feet (2.5 acres).
6) All dimensional, density requirements are in compliance.
Conclusion
1) The general character of area not affected. Industrial park
developed with similar uses.
2) Sewer, water and storm sewer is available to this property.
3) I.T.E. estimates 30 vehicle trip ends allowed based on uses
proposed.
4) Rear of property classified as Conservation -Open Space
District. The wetland buffer was reviewed by Natural Resource
Committee and suggestions to mitigate the impact were agreed on.

5) Applicant proposing a maximum of ten (10) tenants.
6) No outside storage is requested. Any change in plan would
require Zoning Board of Adjustment review.
Based upon the findings and conclusions setforth above, the
Zoning Board of Adjustment hereby grants the applicants request
to construct a 25,000 square foot multiple use structure located
at 49-53 Commerce Avenue with a stipulation that Administrative
approval by the Zoning Board is required prior to first tenant
and least to 50% of total oyOaMp ncy., g .
