FINDINGS OF FACT & DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
RE: Findings of Fact, site plan application #SP-02-56 of Joseph P. Kelley to
amend a previously approved site plan consisting of: 1) a 3926 sq. ft. general
office building, and 2) a 963 sq. ft. accessory building. The amendment consists
of constructing a 32' x 72' accessory structure, 80 Ethan Allen Drive.
On the / yt�—day of November 2002, the South Burlington Director of
Planning & Zoning approved the request of Joseph P. Kelley for site plan
approval under Section 26.10 of the South Burlington Zoning Regulations, based
on the following findings:
1. This project consists of amending a previously approved plan consisting
of: 1) a 4000 sq. ft. general office building, and 2) a 1000 sq. ft.
accessory building. The amendment consists of constructing a 32' x 72'
accessory structure.
2. The owner of record of this property is Joseph P. Kelley.
3. This property located at 80 Ethan Allen Drive lies within the I-C District
and Flood Plain Overlay District.
4. Access/Circulation: Access is provided by a 24 foot curb cut on Ethan
Allen Road. Access to this property is also provided by a 30 foot right-of-
way across the property to the east which is used to access the rear of
the subject property. No changes proposed.
Circulation on the site is adequate
5. Coverage/Setbacks: Building coverage is 17% (maximum allowed is
30%). Overall coverage is 55% (maximum allowed is 70%). Front yard
coverage is 17% (maximum allowed is 30%).
6. The existing office building and the proposed accessory structure meet
the setback requirements. The existing accessory structure does not meet
the side yard setback requirement and is a noncomplying structure.
7. Parking: A total of 16 parking spaces are required and 13 spaces
including one (1) handicapped space and a bike rack are provided. The
parking shortfall is an existing situation which is not being made worse by
the application since the accessory structure does not require additional
parking spaces.
8. Landscaping_ The minimum landscaping requirement, based on building
costs is $300 which is being met. Proposed plantings include two (2) Red
Maple trees.
9. Lighting: The floodlights at the rear of the office building will be replaced
with a 26 watt fluorescent light which is downcasting and shielded.
10. Dumpster: The existing dumpster storage area is screened.
11.Traffic: No additional traffic expected to be generated.
DECISION & CONDITIONS
Based on the above Findings of Fact, the Director of Planning & Zoning hereby
approves site plan application #SP-02-56 of Joseph P. Kelley to amend a
previously approved site plan consisting of: 1) a 3926 sq. ft. general office
building, and 2) a 963 sq. ft. accessory structure. The amendment consists of
constructing a 32' x 72' accessory structure, 80 Ethan Allen Drive, as depicted on
a plan entitled, "Site Improvements 80 Ethan Allen Drive South Burlington
Vermont", prepared by Grover Engineering, dated 10/15/02, with the following
stipulations:
1. All previous approvals and stipulations which are not superseded by this
approval shall remain in effect.
2. Any new exterior lighting shall consist of downcasting shielded fixtures.
Any change to approved lights shall require approval by the Director of
Planning & Zoning prior to installation.
3. For the purpose of calculating road impact fees under the South
Burlington Impact Fee Ordinance, the Development Review Board
estimates that the accessory building will generate zero (0) additional
vehicle trip ends during the P.M. peak hour.
4. Prior to issuance of a zoning permit, the applicant shall post a $300
landscape bond. The bond shall remain in effect for three (3) years to
assure that the landscaping takes root and has a good chance of
surviving.
5. The applicant shall obtain a zoning permit within six (6) months pursuant
to Section 27.302 of the zoning regulations or this approval is null and
void.
6. The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer prior to the use of the new accessory structure.
7. Any change to the site plan shall require approval by the South Burlington
Development Review Board.
