Mr. O'Rourke asked if there arc any regulations about reducing common areas in a PUD. Mr. Wcith said not
specifically. He felt there was no problem with this request.
Members agreed to go straight to final hearing.
5. Site plan application of Budget Car & Truck Rental to amend a previously approved plan for a 4100 sq.
ft. auto rental service facility and long term parking. The amendment consists of converting 1930 sq. ft. of auto
rental use to auto service and repair use, 700 Airport Parkway:
Mr. Lanpher said the applicant will sublet a portion of the facility to a company that does reconditioning of
autos. There will be no changes to the building. He estimated this would bring in 2 or 3 cars a day.
Lighting will be changed to conform to regulations and they will add a bike rack. The boat that has been on the
property should be gone by now. It was left by a customer who then left town.
Mr. O'Rourke moved the Planning Commission approve the site plan application of Budget Car & Truck Rental
to amend a previously approved plan for a 4100 sg ft. auto rental service facility -and long -term parking. The
amendment consists of converting 1930 sg. ft. of auto rental use to auto service and repair use, 700 Airport
Parkway, as depicted on a plan entitled "Budget Rent-A-Car 700 Airport Parkway South Burlington, Vermont,
prepared by Lamoureux & Stone, dated 11/1/93, last revised 7/12/94, with the following stipulations:
1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect.
2. The plan shall be revised to show the changes listed below and shall require approval of the Director of
Planning & Zoning (hereinafter Director). Three copies of the approved revised plan shall be submitted to the
Director prior to permit issuance:
a) The site plan shall be revised to show a bike rack.
3. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the
Planning Commission estimates that the change in use will generate 0.34 vehicle trip ends during the P.M. peak
hour.
4. All exterior lighting shall consist of downcasting shielded fixtures. Any change to approved lights shall
require approval of the Director prior to installation. The building mounted flood lights at either end of the
building and the pole mounted flood lights shall be replaced with downcasting shielded fixtures approved by the
Director.
5 The applicant shall cease immediately use of the northwest corner of the property beyond the paved area, for
vehicle and boat storage.

6. The applicant shall obtain a zoning permit within six months pursuant to Section 27.302 of the zoninst
regulations or this approval is null and void.

8. Any change to the site plan shall require approval by the South Burlington Planning Commission.

6. Design Review application of Design Sign, Inc., to change the graphics on 4 signs, 205 Dorset Street:
Mr. Floyd explained that they are changing the top part of the signs only. The new graphics will have a dark
background with light letters.
No issues were raised.
Mr. O'Rourke moved that the Planning Commission approve the design review application of Design► Signs, Inc,
to change the graphics on four signs, 205 Dorset Street, as depicted on drawings and photographs prepared by
Design Signs, Inc, with a stamped received date of February 22, 1999, in accordance with the following stip-
ulations:
1. This approval is for compliance with only the design review criteria contained in the South Burlington Sign
Ordinance (i.e., Section 4(a)-(d)). The decision of whether or not this application complies with other provisions
of the Sign Ordinance shall be made by the Code Officer.
2. In accordance with Section 23(h) of the Sign Ordinance, the two nonconforming signs on the property (A Plus
Beepers) shall be brought into conformance with Sections 19(c) and 4 by 3/23/01. Sian design approval shall
be obtained from the Planning Commission prior to changing these signs.
3. The applicant shall obtain a sign permit from the Code Officer within six months of this approval or this
approval is null and void.
4. Any change to the sign design shall require approval of the Planning Commission.

7. Sketch plan application of Evelyn Lamplough & Windjammer Hospitality Group to subdivide a 54.352
acre parcel into two lots of 1.476 acres, (lot #1) and 52.876 acres (lot 42), 1076 Williston Road:
Mr. Levering said the proposed subdivision would help them in their program to get some financing. They have
been leasing property from Mrs. Lamplough and now want to exercise the option to purchase it. There is no
additional development planned, and they are not trying to increase anything.

This project consists of amending a previously approved plan for a 4100 square foot auto rental
service facility and long term parking. The amendment consists of converting 1930 square feet of
auto rental use to auto service and repair use. This property was last reviewed by the Commission
on 3/11/97 (minutes enclosed).
This property located at 700 Airport Parkway lies within the IC District. It is bounded on the north
by the airport, and on the south, east and west by Airport Parkway.
Access/circulation: No changes
Coverage/setbacks: Building coverage is 3.4% (maximum allowed is 30%). Overall coverage is
69.3% (maximum allowed is 70%). Front yard coverage is 30% (maximum allowed is 30%). No
changes proposed.
The existing building does not meet the rear setback requirement. No expansion proposed.
Landscaping: No additional landscaping required.
Parking: A total of 13 spaces are required for customers and employees and 16 spaces will be
available. Approximately 46 spaces would be used for rental car storage and the remaining 120-150
spaces would be available for long term parking. The plan should be revised to add a bike rack.
Traffic: ITE estimates that the existing uses generate 13.48 vehicle trip ends (vte's) during the P.M.
peak hour and with the change in use to generate 13.82 vte's for a 0.34 vte increase. The applicant
should be aware that the road impact fee is zero (0).
Lighting: No additional exterior lighting proposed. The building mounted flood lights at either end
of the building and the pole mounted floodlights should be replaced with downcasting shielded
fixtures approved by the Director of Planning & Zoning.
Dumpster: A screened dumpster storage area is provided.
Other:

In response to your March 5, 1999 memorandum, concerning our site plan, I offer
the following :
1, We will revise our site plan to include a bike rack which is in the process of being
purchased.
2, We will replace the building mounted flood lights with down casting and shielded
lights.
3. We have contacted Green Mountain Power to replace the pole mounted flood
lights with cobra head lights.
4. The vehicles and boat which are parked off the paved parking lot will be removed
as soon as snow melt permits and we will discontinue parking any vehicles or
other items off the paved area.

THIS AGREEMENT, executed in triplicate between Peter Val Preda
, of 700 Airport Parkway, So. Burlington hereinafter
referred to as "DEVELOPER", The Howard Bank of
Burlington, VT , hereinafter referred to as ""Bank", and
Mtn of south Burlington hereinafter referred to as
"MUNICIPALITY".
- W I T N E S S E T H:
WHEREAS, Developer has received site plan approval from the
MUNICIPALITY'S Planning Commission for the development of property
located at 700 Airport Parkway. So. Burlington , as depecited on
a site plan entitled *** it IF dated
1 1 / 1 /93 and prepared by Lamoureux & Stone
WHEREAS, DEVELOPER is required by said approval, at its own
expense, to complete the construction of the development site in
accordance with the plan approved by the Planning Commission; and
WHEREAS, the parties to this Agreement wish to establish a
mechanism to secure the obligations of the DEVELOPER for the work
as set forth above; and
WHEREAS, the BANK executes this Agreement solely in the
capacity of issuer of a Letter of Credit hereinafter specified;
NOW, THEREFORE, the parties hereby covenant and agree as
follows:
1. DEVELOPER will, at its own expense, complete the following
construction as depicted and in accordance with the specifications
set forth in said site plan and related documents:

improper work or materials which may be recognized within one year

the purpose of this Agreement "completion" shall be deemed to have
occurred when the MUNICIPALITY has inspected and approved the
construction of all the improvements required by this Agreement and
issued written notice to the DEVELOPER that the construction is
complete.
4. For the guarantee of DEVELOPER's performance of all
requirements hereunder set forth, DEVELOPER has caused the BANK to
issue its Irrevocable Letter of Credit in favor of the
MUNICIPALITY, the original of which is attached to the
MUNICIPALITY's copy of this Agreement, and a copy of which is
attached to the DEVELOPER's copy of this Agreement. During the
term of this Agreement, DEVELOPER shall cause the attached Letter
of Credit to be renewed at least thirty (30) days before the
maturity date thereof. Failure of DEVELOPER to deliver evidence of
such renewal to MUNICIPALITY thirty (30) days prior to the date of
expiration of said Letter of Credit shall constitute a default of
the terms of this Agreement.
5. Said Irrevocable Letter of Credit provides that the drafts
drawn under said credit, must be accompanied by a written statement
signed by a duly authorized agent of the MUNICIPALITY, that in the
judgement of the MUNICIPALITY, the DEVELOPER is in default under
the terms of this Agreement, and that the funds to be drawn by the
draft are in payment for, or in anticipation of payment for
materials, labor and services required for completion of the
improvements identified in Paragraph 1. Payment of each draft will
be made at sight when presented to the BANK by the MUNICIPALITY,
the payment limited only by the aggregate amounts presented in
relationship to the maximum amount of the Letter of Credit. If
DEVELOPER shall be in default of the Agreement for seven (7) days
because of its failure to provide evidence of renewal of the Letter
of Credit, required in paragraph 4 above, the MUNICIPALITY shall
notify DEVELOPER by certified mail of said default.. DEVELOPER
shall then within three (3) business days provide MUNICIPALITY with
evidence of said renewal of Letter of Credit or MUNICIPALITY may
notify BANK of such default and request payment under said Letter
of Credit.
6. The DEVELOPER and MUNICIPALITY hereby agree that the sum
of Five Thousand Seven Hundred Do.($ 5,700.00 ) shall be sufficient
to secure DEVELOPER's obligations under this Agreement but shall
not relieve DEVELOPER from the obligation to pay any additional
costs, if actual costs exceed the above -stated cost.
7. The MUNICIPALITY will promptly submit to the DEVELOPER a
copy of any draft it submits to the BANK. The consent of the
DEVELOPER to payment of said draft by BANK to the MUNICIPALITY
under said Letter of Credit shall not be required.

8. The MUNICIPALITY shall not file with the BANK a Statement
of Default until ten (10) days after notice has been sent to the
DEVELOPER, by certified mail, setting forth its intention to do so.
9. All funds drawn on the BANK by the MUNICIPALITY pursuant
to the Letter of Credit shall be used solely by the MUNICIPALITY
for the purpose of completing construction of the improvements
identified in Paragraph 1. Any work contracted for by the
MUNICIPALITY pursuant hereto shall be let on a contractual basis,
or on a time and material basis, or shall be performed by the
MUNICIPALITY's own work force and equipment, or shall be
accomplished in such other manner as in the judgement of the
MUNICIPALITY shall accomplish the work more expeditiously and
economically.
10. If payments are drawn on the BANK by the MUNICIPALITY
pursuant to said Letter of Credit, and it shall later develop that
a portion of the monies drawn are in excess of the MUNICIPALITY'S
needs, any such excess amount shall be refunded by the MUNICIPALITY
to the BANK, to be credited by said BANK to the DEVELOPER.
11. This Agreement and said Letter of Credit shall terminate
and shall be of no force and effect upon completion of the one year
warranty period as described in the above Paragraph 3. If the
MUNICIPALITY has not delivered any written notice to the DEVELOPER
of any defective or improper work or materials in the construction
of the improvements within the twelve (12) month period, or if
notice has been given and the defective work or materials have been
corrected by the DEVELOPER, the- MUNICIPALITY shall forthwith notify
the BANK in writing that the Letter of Credit may be canceled, and
shall return the original Letter of Credit to the BANK, and both
the DEVELOPER and the BANK shall be released from all obligations
hereunder and under said Letter of Credit.
12. The BANK may not modify the Letter of Credit without
first receiving written consent of the MUNICIPALITY.
13. DEVELOPER hereby agrees to indemnify and hold BANK
harmless from all claims, causes of action or liability of any kind
arising out of this Agreement or the issuance by BANK of this
Letter of Credit, including attorney's fees, as long as BANK
follows the terms and conditions outlined in said Letter of Credit.
14 This Agreement shall be binding on all parties hereto and
their respective heirs, executors, administrators, successors and
assigns.

b) WENDY CHAMBERS BROWN - LONG TERM PARKING - SITE PLAN
This project consists of amending a previously approved site plan
for an auto rental service facility. The amendment consists of
using a portion of the property for long term parking
(approximately 120 - 150 cars). This property was last amended on
2/8/94 (minutes enclosed).
This property located at 700 Airport Parkway lies within the
Airport District. It is bounded on the north by the airport, and
on the south, east and west by Airport Parkway.
Access/circulation: No changes
Coverage/setbacks: Building coverage is 3.4% (maximum allowed is
30%). Overall coverage is 69.3% (maximum allowed is 70%). Front
yard coverage is 30% (maximum allowed is 30%). No changes
proposed.
The existing building does not meet the rear setback requirement.
No expansion proposed.
Landscaping: No additional landscaping required.
Parking: A total of 13 spaces are required for customers and
employees and 16 spaces will be available. Approximately 46 spaces
would be used for rental car storage and the remaining 120-150
spaces would be available for long term parking.
Lighting: No additional exterior lighting is proposed. A
requirement of the 2/8/94 approval that the northernmost existing
floodlight be replaced with a shielded downcasting fixture was
never complied with. The applicant has indicated that they will
replace this light by March 28, 1997.
Traffic: The applicant estimates that this new use will generate
two (2) additional vehicle trip ends during the P.M. peak hour.
There is no category in ITE for long term parking. The applicant
should be aware that the road impact fee is approximately $175.
Recommend Conditions:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.

2. The northernmost existing floodlight shall be replaced with a
shielded downcasting fixture by March 28, 1997.
3. Any new exterior lighting shall consist of downcasting shielded
fixtures so as not to cast light beyond the property line. Any
change in lighting shall be approved by the City Planner prior to
installation.
4. For the purpose of calculating road impact fees under the South
Burlington Impact Fee Ordinance, the Planning Commission estimates
that the long term parking use will generate two (2) additional
vehicle trip ends during the P.M. peak hour.
5. The applicant shall obtain a zoning permit within six (6)
months pursuant to Section 27.302 of the zoning regulations or this
approval is null and void.
7. The applicant shall obtain a Certificate of
Occupancy/Compliance from the Administrative Officer prior to
establishing the new use.
8. Any changes to the site plan shall require approval by the
South Burlington Planning Commission.
c) RANDY & RENE BERARD - WAREHOUSE - SITE PLAN
This project consists of amending a previously approved plan to
construct a 13,650 square foot light manufacturing building on a
1.2 acre parcel. The amendment consists of: 1) reducing the size
of the building from 13,650 square feet to 8,000 square feet, 2)
change the use of the building from light manufacturing to
warehouse, and 3) site modifications. The plan was previously
approved on 9/10/96 (minutes enclosed).
This property located at 63 Ethan Allen Drive lies within the IC
and Floodplain Overlay Districts. It is bounded on the north by
Ethan Allen Drive, on the east by Commerce Avenue, on the south by
an undeveloped lot and on the west by the floodplain.
Access/circulation: Access will be provided by a 26 foot curb cut
on Ethan Allen Drive and a 24 foot curb cut on Commerce Avenue.
Both curb cuts are for ingress and egress. Section 26.103(a) of
the zoning regulations states that "unless specifically approved by

expansion and landscape alterations for an auto rental service
facility, Airport Parkway:
Mr. Goulette showed improvements already made on the site. They
are using some gravel parking that wasn't on the original approv-
al for their truck rental business. They will do some paving
outside the 50 ft. setback area and will leave truck storage area
as gravel. They will add some lighting as there have been
vandalism problems.
Mr. Burgess said the applicant had to start with what was
approved, not with the illegal things that are there. Mr. Craig
noted they are proposing 41% front yard coverage which is too
much. Mrs. Maher felt they needed more trees on the lot. Mr.
Weith noted a number of flood lights on the property shine onto
the road and recommended they be replaced withdowncasting
fixtures. This is especially true of the northernmost light.
Members agreed to let the applicant work out the landscaping with
the City Planner.
Mr. Austin moved the Plannin Commission approve the site plan
application of Peter Val Preda for parkin lot expansion and

8. Discussion with Amy Wright of Lake Champlain Housing
Develoment Corp. regarding the proposed 18 lot subdivision
located at Kirby & Patchen Roads which was approved by the
Commission on 5 February 1991. Topics to be discussed include a
possible waiver of the stipulated $11,745 sidewalk construction
fee:
Ms. Wright explained the background of the request. Their
problem is that funding sources have asked what South Burlington
can do for the developers in the way of fee waivers. She noted
that in exchange for this they are willing to give a bike path
easement. Ms. Wright felt this might make the difference be-
tween them getting the grant or not getting it.
Mrs. Maher said she had no problem with the request. Other
members felt the City Council should be consulted to see if they
had any strong feelings as this is a matter of money. They
agreed to ask that the item be put on the next Council agenda.
As there was no further business to come before the Commission,
the meeting adjourned at 10:30 pm.

I move the South Burlington Planning Commission approve the site
plan application of Peter Val Preda for parking lot expansion and
landscaping alterations for an auto rental service facility, 700
Airport Parkway, as depicted on a plan entitled "Budget Rent-A-Car,
700 Airport Parkway, South Burlington, Vermont, Proposed Parking
Lot Additions" prepared by Lamoureux & Stone, dated 11/l/93, with
a last revision date of 2/4/94, with the following stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. This site plan approval shall not be construed as approval to
alter a noncomplying structure. The decision of whether or not to
approve alteration to a noncomplying structure shall be made by the
Administrative Officer in accordance with Section 19.002 of the
zoning regulations.
3. The plan shall be revised prior to issuance of a
zoning/building permit to show the changes listed below and shall
require approval of the City Planner. Three (3) copies of the
approved revised plan shall be submitted to the City Planner prior
to permit issuance.
a) The applicant shall replace an appropriate amount of
gravel area with seeded lawn area in order to meet the 30%
front yard coverage limitation. This shall be so noted on the
plan and the plan revised accordingly.
b) The plan shall be revised to show additional landscaping,
to be made up of both deciduous and evergreen trees, along the
Airport Parkway frontage to screen the parked vehicles. The
plan shall also show the type, size and quantity of all
proposed landscaping.
c) The plan shall be revised to show that the dumpster
storage area will be suitably screened from Airport Parkway.
The type of screening shall be noted on the plan.
4. The applicant shall post a landscape bond, in an amount to be
determined by the City Planner, for the new landscaping. This bond
shall be posted prior to issuance of a zoning/building permit. The
bond shall remain in effect for three (3) years to assure that the
landscaping has taken root and has a good chance of surviving.

light fixtures prior to installation. Any future changes to
exterior lighting shall consist of downcasting, shielded fixtures
and shall require approval of the City Planner prior to

7. The applicant shall obtain a Certificate of Occupancy from the
Administrative Officer prior to use of the new parking area.
8. Any change to the site plan shall require approval by the South
Burlington Planning Commission.

Both buildings on the lot do not meet the setback requirements and
are noncomplying structures. Alterations to these structures are
subject to Section 19.002 of the zoning regulations.
Parking: This project requires a total of 11 parking spaces and 13
spaces are being provided including one (1) handicapped space. The
parking area adjacent to the play area should be widened to 36 feet
or the number of spaces reduced to three (3).
Landscaping: There is no minimum landscaping requirement, based on
building costs, for this project.
Traffic: This property is located in Traffic Overlay Zone 3 which
would allow this property to generate a maximum of 15.3 vehicle
trip ends (vte's) during the P.M. peak hour. ITE estimates the
current use to generate 2.5 vte's and the proposed uses to generate
17.8 vte's for a 15.3 vte increase. Under Section 17.50 the
Planning Commission may approve peak hour traffic volumes above the
normal standards if it determines that other site improvements will
produce a net benefit for traffic flow in the vicinity. The
applicant is proposing to not use the Williston Road curb cut.
The applicant will be required to contribute $2,208 to the
Williston Road Traffic Impact Fund -Area 2 for the 15.3 additional
vte's to be generated by this Droiect.
Sewer: The additional sewer allocation needed for this project is
45 gpd. The applicant will be required to pay the per gallon fee
prior to permit.
Lighting: Exterior lighting consists of one (1) 150 watt mercury
vapor light attached to the garage. No additional lighting
proposed.
Other: Dumpster is screened with a lattice enclosure.
7) PETER.VAL V.REDA - PARKING AREA EXPANSION - SITE PLAN
This project consists of increasing the size of the paved parking
area for an auto rental service facility by 2,712 square feet and
landscaping alterations. The Planning Commission approved this
facility on 5/25/82, approved an amended plan on 6/22/82 and
approved an addition to the building on 9/24/91.

This property located at 700 Airport Parkway lies within the I-C
District. It is bounded on the north by the airport, and on the
south, east and west by Airport Parkway.
Access/circulation: Access to this property is via one (1) 24 foot
wide curb cut on Airport Parkway. No access changes proposed.
Circulation is adequate.
Coverage/setbacks: Building coverage is 3.4% (maximum allowed is
30%). Overall coverage is 69.3% (maximum allowed is 70%). Front
yard coverage is 41% (maximum allowed is 30%). Front yard coverage
has increased from 19.9% in the 1982 plan to 41% on the current
plan. ,4
Staff can not find evidence that a variance was ever granted to
exceed the 30% limitation. It is the applicant's position that the
41% coverage was always existing and was not correctly shown on the
1982 plan. Staff recommends that an appropriate amount of gravel
area be converted to green space in order to meet front yard
coverage requirements. The Planning Commission does not have
authority to approve this plan without a variance granted by the
Zoning Board.
The existing building does not meet the rear setback requirement
and is therefore a noncomplying structure. Any alteration to this
building will be subject to Section 19.002 of the zoning
regulations.
Landscaping: There is no minimum landscaping requirement, based on
building costs, for this project. The applicant is proposing to
extend an existing landscaped berm approximately 300 feet to the
north-west along Airport Parkway. Proposed plantings have an
estimated value of $1300 and will include flowering Crabapple and
Upright Yews.
Applicant cut down much of the natural vegetation in the front yard
in the fall of 1993. Staff contacted the applicant at that time
and informed him that this was a violation of his approved site
plan since the previous plans showed these trees as to be saved.
Staff recommends substantially more landscaping, made up of both`
Deciduous and Evergreen trees, along the Airport Parkway frontage °
to screen the parked vehicles.

Parking: Parking area will be increased in size by 2,712 square
feet and 4,388 square feet of existing gravel area will be paved.
Lighting: Existing exterior lighting consists of the following.-
--- six (6) 400 watt high pressure sodium lamps mounted on four
(4) poles.
--- four (4) residential type flood lights attached to the
building.
--- two (2) roadway type lights attached to the building.
Applicant will provide more specific details regarding the
existing lighting at the meeting.
Proposed new lighting will consist of two (2) 100 watt downcasting
sodium vapor lamps on 20 foot poles. Staff recommends that all
existing lighting be replaced with shielded downcasting light
fixtures.
Dumpsters: The existing dumpsters should be suitably screened from
Airport Parkway.
8) 18 LOT SUBDIVISION, KIRBY/PATCHEN ROADS
Amy Wright of the Lake Champlain Housing Development Corporation
will be present at Tuesday's meeting to discuss a proposal to
develop the approved 18 lot subdivision (25 units) at Kirby and
Patchen Roads as an affordable housing project. The City Council
has applied for a Community Development Block Grant to assist the
project.
Enclosed are the minutes from the meetings at which the project was
approved (8/29/89 and 2/5/91). The project will be developed as it
was approved with seven (7) single family units and nine (9) duplex
units (25 units total).
Ms. Wright would like to discuss the possibility of waiving the
$11,745 sidewalk construction fee. Enclosed is a letter from Ms.
Wright.

Members Present:
Commission held a meeting on
7:30 pm, in the Conference Room,
William Burgess, Chairman; Terry Sheahan, Catherine Peacock,
David Austin, Mary -Barbara Maher, William Craig, Ann Pugh

1. Other Business:
a. Mr. Weith addressed a letter from Ann Byrnes of the Montessori
School regarding construction on Pillsbury Manor III. Ms. Byrnes
complained about work disrupting her school and blocking the
access. Greg Rabideau described the problem and said Ms. Byrnes
had a valid point. The contractor began work too early and had
to cross the driveway with the water line extension. He said
they would try to work around her schedule. Ms. Peacock
suggested that neighbors be notified of impending problems be-
fore they happen.
2. Minutes of 30 July 1991:
Mrs. Maher moved the Minutes of 30 July be approved as written.
Mr. Sheahan seconded. Motion passed unanimously.
3. Site Plan application of Peter Val Preda for construction of a
-918 sq-: f-t.-aarwash addition to an existing car rental facility
(Budget Rent -a -Car), 700 Airport Parkway:
Mr. Val Preda said they are moving the carwash from one location
to another. It is used only by the business and isn't open to
the public. It won't be visible from the street.
Mr. Sheahan asked about landscaping. Mr. Weith said there is a
$600 requirement and he recommended putting in a tree on the
south side of the access. Mr. Val Preda said there are already 2
or 3 trees there. They aren't doing well and he would put in
something else if they continue not to thrive. He agreed to put
in one more tree to meet the $600 requirement.
Mr. Austin moved the Commission approve the Site Plan application
of Peter Val Preda for construction of a 918 sq. ft. carwash ad-
dition to an existing car rental service facility (Budget Rent -a -

casting luminaire fixture which does not cast light beyond the

landscaping on the south side of the entrance drive. The Planner
shall approve the location and species.
3. The zoning/building permit shall be obtained within 6 months
or this approval is null and void.
Mrs. Maher seconded. Motion passed unanimously.
4. Public Hearing: Revised Final Plat application of University
Mall Realty Trust for 1) removal of 3 buildings and construction
of a new 5,000 sq. ft. building for retail use; 2) revision to
the approved footprint of the Main University Mall building and
3) change in parking lot layout and circulation on the University
Mall property, Dorset Street:
Mr. Khouri said they have conformed to everyone's comments. They
have conferred with the Planner about more green area up front.
This Would require removal of some green area in back to accommo-
date the transplanted parking. He showed the location on the
plan. Mr. Craig asked why not just eliminate the parking spaces
and leave the green space in back. Mr. Khouri said the spaces
are noted in their leases. He also said there is a shortage of
parking as it is with those spaces included:--Mr-s. Maher said she
never thought she would hear the Mall admit their inadequate
parking.
Mr. Sheahan asked what will happen to the Howard Bank building.
Mr. Khouri said it will come down completely.
There will be one other change: they have revised the radius
turning areas to allow for CCTA buses that now come onto the U-
Mall property. This has resulted in the loss of 8 parking
spaces. Members had no problem with this.
Mr. Austin moved the Commission approve the revised final plat
application of University Mall Realty Trust for 1)removal of
three buildings and construction of a new 5,000 sq. ft. building
for retail use, 2)revision to the approved footprint of the main
University Mall building, and 3)change in parking layout and
circulation on the University Mall property as depicted on a two

This project consists of the construction of a 918 square foot
addition to an existing car rental service facility (Budget
Rent-A-Car) to be used as a car wash. A variance to allow this
addition to have a nine (9) foot rear setback was granted by the
Zoning Board of Adjustment on August 12, 1991.
This property is located at 700 Airport Parkway and is in the
Mixed Industrial and Commercial District. It is bounded on the
north by the airport, on the south, east and west by Airport
Parkway.
Access/Circulation: Access to this property is via one (1) 26
foot curb cut on Airport Parkway. No change to the existing
access is proposed.
Circulation is adequate.
Parking: There are no specific parking requirements for this
private car wash. The site has a very large paved and gravel
parking area so parking is not a problem.
Landscaping: The minimum landscaping requirement for this
project is $600. No additional landscaping is proposed. Staff
recommends that this requirement be satisfied with plantings
along the front of the property south of the access.
Setbacks/coverage: The rear setback requirement for this addi-
tion is not being met but a variance was granted by the Zoning
Board of Adjustment on August 12, 1991.
Building coverage is 3% (maximum allowed is 30%). Overall cover-
age is 59% (maximum allowed is 70%).
Sewer: No additional sewer is required since an existing carwash
is to be moved into the new addition. The existing car wash area
will become storage.
Lighting: No exterior lighting details submitted. Any new
lighting shall be shown on the plan and shall be downcasting and
shielded.

Appeal of Peter Val Preda, seeking a variance from Section 18.00 Dimensional
requirements and Section 19.05 Conditional use expansion. Request is for per-
mission to construct a 18'x 60' car wash to within nine (9) feet of the re-
quired rear yard, located at Budget Rent-A-Car, 700 Airport Parkway.
Mr. Ward informed the Board that the area is zoned I-C District. Existing use
rental vehicles with car wash is Conditional use, Section 13.20 sub section
13.206. Section 18.00 Dimensional requirements -- minimum rear yard 30 feet,
proposed rear yard 9 feet. Section 19.05 Conditional use sub section 19.056
applies expansion to an existing conditional use. Plus a variance to dimen-
sional requirements - proposed 18'x 50' car wash.
Mr. Val Preda informed the Board that his existing car wash is too short so
that when the cars come out they do not have a chance to dry off, especially
in the winter.
Mr. Johnson asked if this is going to be an increase on the sewer capacity be-
cause it is a larger car wash. Mr. Val Preda replied no.
Mr. Val Preda addressed the conditional use criteria. (1) The depth of the
property is physically unique and the frontage _•1 fn, t,!. il(JO feet; (2)
f( the physical irregularity of the property is the season fo, the variance; (3)
the hardship was created in the shape of the property to build this car wash;
(4) the car wash will not alter the essential characteristics of the neigh-
borhood because there is no other neighbor except for the airport; and (5)
this is a minimum variance.
The appeal was granted unanimously.
No. 3 Appeal of Lawrence Press
Appeal of Lawrence H. Press, seeking a variance from Section 18.00 Dimensional
requirements. Request is for permission to construct an 8'x 8' mud room to
within twenty one (21) feet of the required front yard, located at 29 Meadow
Road.
Mr. Ward informed the Board that the area is zoned R-4 District. Section
18.00 Dimensional requirements - minimum front yard 30 feet, proposed front
yard 21.5 feet. Proposed construction of 8' x 8' mud room. Lot 100'x 100' =
10,000 square feet. The existing house is 24'x 30' cape with attached one car
garage. The variance is for 9 feet.
Mr. Press addressed the 5. Criteria (see attached Exhibit A).
Mr. Johnson asked whets the front yard faces. Mr. Press replied that the
(�( front yard faces Mrs. Barnes' back yard.
Mr. Blais asked if Mrs. Barnes has any objections to this variance or does she
know of the addition. Mr. Press replied that he informed Mrs. Barnes that he
was putting up a small addition when he first met her and she replied that was
nice.

The May 18, 1982 minutes were approved on a motion by Mr. Levesque, a
second by Mr. Jacob and a unanimous vote.

Mr. Spitz said this would move a lot line, but not create any new lots.
Mr. Dave Rath proposed that the back 2/3 of lot 1 (about 19.7 acres)
be transferred to the owner of lot 2. The purpose is to provide the owner
of the lot with open space protection. There will be no development of the
lot, nor will there be improvements, or changes in the covenants. Mr. Rath
said that the land might be further developed eventually, but that will
require bringing the right of way up to city standards.
Mr. Ewing said he wanted to be sure the old Planning Commission stipulations
would carry over to the new subdivision of land.
Mr. Levesque said he had voted no the first time around because he opposes
10 acre lots - he feels they serve no purpose.

Mr. Spitz said the Zoning Board had granted a rear yard variance for the
building.
Mr. Robertson said the building to be constructed would be small (40' z
60') but that they have left room for expansion. There is an area for overflow
storage of cars during the winter (30-60 of them) but this will be behind
bushes and shrubs and will have a security fence around it. The building
will be used as office space and will also have an area to wash two cars,
and to work on others. Mr. Robertson said they would sell the cars as they
turned them over. This will be mainly a service and office facility. The
main rental office is on Airport Road and will remain there unless they can
obtain a counter in the airport.
The Commission asked how many cars would be sold from this location and
was told that the fleet is now 103 and they will probably sell 1/3 of them

Kr. awing asked about traffic and Mr. Spitz said the estimate was for
about 20 per day. If they get a counter at the airport, they might be able
to move cars over there without using Airport Pky., if they can get access

probably rented out 20 cars per day and had about that number of returns.

room facilities for Holiday Inn on Williston Road
Mr. Spitz said the Zoning Board had granted a dimensional variance on
the side of the building.
Mr. Field said he was the general manager of the Holiday Inn. They

on the rear of the lot. With the present set-up, they cannot allow banquets
to go beyond 9 pm because they use the same room for banquets and as the lounge.
Mr. Spitz said the Zoning Board had left parking and drainage issues up
to the Commission. He noted that the site had less than the standard for
parkirig now, but the area is used a lot and there seems to be no problem with
parking now.
Mr. Field said they would put a 6' high chain link fence around the new
parking area, and put in lights. There will be 190 seats in the new banquet
room, where before there were 175, and the existing entrance walkway will be
enclosed. Additional landscaping will be put near the sign, in the courtyard,
and to the rear. Mr. Levesque suggested screening the dumpster from the
street and the Commission agreed that should be done. Mr. Field said that
could be done with a fence. He noted that employees would be required to use
the new lot, and it will be signed for overflow parking.
Mr. Roesler said that in 1964, Harper Hotels and the Lamploughs had
signed an agreement to allow surface water and sewage rights on the Lamplough
property. The area at which most of the water from the site drains is eroding
and that will be repaired during construction.

Lamoureaux of Hamlin Engineering, sai't he had called the City Engineer

had i;., i raised. City Engineer Szymanski had told him that at times water

area ;re also tends to wash out. Mr. Lamoureaux took the plans in to the

' The proposed use is on lot 10 of Rebecca Square, which was previously
approved for up to 12-residential units. As a result of the change in use,
the review procedure,to be followed is a revised final plat preceded by a
sketch plan review.
The zoning ordinance does not specify the permitted size of a community
care facility. Note that 24 units in this type of facility are not equivalent
to 24 units in a normal multi -family development. The size of the proposed
building is no larger than an average 12 unit multi -family building, and
parking requirements are considerably less than that. However, there will have
to be carefully worded stipulations against any future change in use of the
building.
Specific points to be addressed include the following:
a) Building location and screening from adjacent properties.
b) Number of required parking spaces (comparative data should be
submitted).
5) Other Business
Budget Rent-A-Car has asked for a 6-month extension to their proposed
Airport Parkway -facility (see enclosed letter). Since their time limit has
not yet expired (12/22/82) and since this would be the first extension, I see
no reason not to grant an automatic extension. However, any further extension
would require a new site plan application.
I would like to set up a joint meeting of the Zoning Board and Planning
Commission in early January to discuss implementation of the new zoning ordinace.
The Spear Street Nowland Property case will be going to the Vermont
Supreme Court. The Planning Commission should decide whether it wishes to
seek legal representation in those hearings.

After your hearing on May 25, 1982, regarding appr&val
of a rental facility for Val Preda Leasing, I was presented
with a list of stipulations that I was not prepared to
answer. The stipulations given to me were written and
dated a day prior to the meeting. I would appreciate the
opportunity to present our views of these stipulations to
the commission.
In answer to stipulation number 1, our engineers, Donald
Hamlim, consulting engineers, Inc., cannot find a valid
reason for installing the pipe requested. Mr, Leonard
Lamoureux, the engineer working on this project is willing
to present his findings to the planning commission.
Stipulation number 2 is not a problem if it is the normal
procedure,
Stipulation number 3 states that only cars rented at this
facility can be sold there. However, in the statement
before the stipulations, I was quoted as saying that the
new building "will be mainly a service and office facility".
The bulk of our rentals will be from another facility.
we would like to sell any of our fleet cars at this new
location► Buying and dispensing of cars is a major part
of the car rental business. In one,:year we might change
our entire fleet to meet competition or customer demand.

It is our hope that we will obtain a larger share of the lease and
rental market in our area. There are approximately 500 cars being
rented out of the Burlington Airport. Some of the rental agency's
change cars twice a year - if not *yore often.
Stipulation number 4 is not a problem, and a connection to the
storage area will be depicted on our new drawing's from Donald Hamlin
Consulting Engineer, Inc.
Being in the rental business, we want the least number of cars sitting;
at any given moment. However, in the off season, we might have most
of our cars return and we may need to store them in our overflow and
service area.
The quotes in the minutes of May 25th were based on my experience
with the company this past year.
The type of vehicle's we rent are passenger cars. However, the
indications for the future are that these types of vehicles will be
changing in category. The basic cars have been getting smaller, 1-ut
station wagons are being replaced with van's (which are considered
light -duty commercial vehicles) by the Chrysler Corporation - and
they call them wagons.

1. The site drainage is south easterly to a natural drainage course. An in-

1. Winter snow storage is a problem. The practice of pushing and throwing
snow across the interstate fence results in fence damage. An area should be
reserved for this purpose.
2. The proposed landscape berm appears to be on a steep slope. Contours of
this area and parking lot should be provided.
3. Drainage of expanded parking should be concentrated to a drainage inlet
and piped to the drainage swale or intercepted by existing drainage system.

Applicant's property is currently 29.8 acres. He proposes to keep 10.1 acres
with the house in the front and to separate 19.7 undeveloped acres in the rear.
The rear acreage will be added on to the adjacent parcel (Jewett) and will not
constitute an additional building lot. '
3) Budget Rent-A-Car
Application consists of a small (60'x40') building with room for expansion
and parking areas for rental cars and employees. No truck rentals are planned
and very little public parking is expected to be needed. One curb cut is
propo:;od and sight distance is adequate.
The site is a wide and shallow isolated parcel abutting the airport on the
west side. There are several unattractive exposed banks below the airport
fence, but these are behind the boundary of this property. Except for these
banks, proposed landscaping (which satifies the formula) and site work will
improve the appearance of the parcel.
4) Holiday Inn
Application is for an addition of 3,700 square feet to an existing 11,850
square foot "commercial building", i.e. restaurant, lounge, and banquet rooms.
The seating capacity of the restaurant will be unchanged. The lounge and banquet
rooms are now used somewhat interchangeably, and the two areas will become total-
ly separated. Total square footage will be approximately doubled, and the
applicant lists the seating capacity for each function as follows: lounge - old
180, new 176; banquet rooms - old 175, new 190.

The applicant feels that this addition will not increase peak hour traffic.
He feels that the lounge and banquet facilities are used primarily at different
times and that any increase will be in lounge use in the later evening hours
(s(xw data on existing volume of use has been submitted). It is difficult to
prove or disprove this argument by any available traffic generation standards.
However, there is a potential for increased afternoon peak hour use if banquet
rooms are used to full capacity in addition to "happy hour" or other lounge use.
Therefore I suggest the following analysis.

Dear Sirs:
It is my understanding that a contractor will be submitting a pro-
posal to your commission for the construction of several more houses along
the airport boundary on Airport Drive just south of the disposal plant.
I would like to express my opposition to further housing development
in close proximity to the airport, and in this particular case, in close
proximity to the runway, for two specific reasons.
First, it is an accepted fact that soon after people move into a new
house near an airport, the aircraft noise begins to bother them and they
start complaining about the business of the airport -flying. This causes
those of us who are responsible for a particular operation on an airport,
or who are managers of an airport, a great amount of distress to say the
least. The long range solution to this problem is -adequate zoning to
prohibit or control building adjacent to an airport.
Secondly, the construction of homes along or adjacent to a runway, as
in this case, or in the approach zone or transition zone most certainly
presents a safety hazard to the inhabitants. If an aircraft had severe
landing or take -off problems and was out of control, it is not inconceiv-
able that it could crash into one or more of these homes. Once again, the
solution to this problem is adequate zoning which would deter home con-
struction in these areas.
I am certain that you people of the Commission are aware of- theae
facts along with others and that you will use your considered judgement
in acting upon this proposal. I did, however, want to offer my opposition
to any further housing development adjacent to the airport for the reasons
stated earlier.

1. Location: Airport Parkway opposite old Legion building,
bordered by City of South Burlington and
Airport Property.
2. Parcel in question contains approximately two and one.
half acres.
Request is to set-off seven (7) lots for duplex units.
3. Parcel in question is zoned Residential District B,
allowing one and two family units.
4. Minimum lot size required 15,000 square feet.
5. Minimum frontage required 100 feet print indicates both
requirements okay.
6. Park area as proposed is not in ideal location - mostly
a ravine.
7. 1969 Master plan and proposed zoning map indicates this
area as Airport Industrial zone.
8. Question as to why lots are not squared off to the street
right-of-way.
9. Sewer line as built indicates only three service connections.
Main line is located on opposite side of roadway in area
of lots 1 - 2 - 3 on print.
10. Road and drainage should be up -graded - consider installation
of curbs.
11. Landscaping should be considered.

On behalf of the Board of Airport Commissioners of the
City of Burlington, I wish to register an objection to the
proposed subdivision of the land located on the east side of
Airport Parkway as requested by William Hauche.
As you are aware, the land in question is bordered on
the north and on the east by property of the Burlington
International Airport. Any development in the form of
residential housing would undoubtedly produce unsatisfactory
living conditions for prospective purchasers due to the noise
factor. In addition, airport planning calls for the con-
struction of a new taxiway parallel to the east property
line of the aforementioned property. This development would
bring aircraft a great deal closer to the property, thereby
increasing the noise problem for residents of that development.
Consideration should also be given to the fact that the
proposed new zoning, expected to be adopted this summer, would
prevent such development for the very reasons I have mentioned
above.
Your consideration of our objections would be greatly
appreciated.

1. The lot lines should be perpendicular to the street.
2. Final submission plan shall include topography, curbs,
drainage, sidewalk and street widening along the
development side.
3. Sewer and water is on west side of street requiring
a crossing. This must be done by next spring before
the City repaves the street.
