Re: Findings of Fact, application of J.G. Architects, Inc. for a
9,438 square foot office building at 77 Ethan Allen Drive.
On the 26th of February 1991, the South Burlington Planning
Commission approved the request of J.G. Architects, Inc. for site
plan review under Section 19.10 of the South Burlington Zoning
Regulations based on the following findings:
1. This project consists of the construction of a two (2) story
office building which has a total of 9,438 square feet (4,719
square feet per floor) at 77 Ethan Allen Drive.
2. The lot is 40,481 square feet and is located on the southerly
side of Ethan Allen Drive and on the northerly side of Commerce
Avenue. The lot fronts on both streets.
3. This property is located in the Mixed Industrial and Commer-
cial District and is bounded on the east by an industrial build-
ing, on the west by a single-family home and several commercial
buildings, on the north by Ethan Allen Drive and on the south by
Commerce Avenue.
4. Access/circulation: Two (2) 22 foot curb cuts are proposed,
1 on Ethan Allen Drive and 1 on Commerce Avenue resulting in two
(2) driveways. Section 19.103(a) of the zoning regulations
states that "there shall be one driveway per lot" unless specifi-
cally approved by the Planning Commission. Both driveways meet
the minimum width requirement of 20 feet.
5. Setbacks/coverage: Setback requirements will be met.
6. Landscaping: The landscaping requirement for this project is
$6,000 and only $1,195 in new landscaping is proposed. The
applicant has indicated that existing plantings have a value of
$36,525. Trash storage will be screened with a stockade fence.
7. Parking: 38 parking spaces are required and 28 spaces are
being provided, 2 of which are handicapped. This is a 10 space
or 26.3% shortfall. An area for 10 future parking spaces is
shown if needed. Each of the two (2) levels are to be served by
separate parking areas. Each floor requires 19 spaces and the
applicant is providing 13 spaces in the north parking area and 15
spaces in the south parking area. 25 spaces will be provided on
the south side if future parking is constructed. A stairway will
be constructed along the westerly side of the building to provide
pedestrian access afrom the south parking area to the upper level
of the building.
Parking stalls and aisle widths meet minimum requirements.
8. Sewer: This project requires a sewer allocation of 473 gpd.
The $2.50 per gallon fee would have to be paid prior to permit.
9. Lighting: Section 19.104(d) of the zoning regulations re-
quires that "all outdoor lighting or parking from ... commercial
uses shall be screened from the view of the ground floor of
adjacent residential buildings". All site lighting will be
mounted on the building and all but 1 fixture will be on the side
of the building facing the residence. Lighting proposed includes
four (4) 35 w. H.P.S., two (2) 50 w H.P.S. and one (1) 400 H.P.F.
10. Sidewalk: The subdivision approval which created this lot
(4/4/89) included a stipulation which required the applicant to
pay a sidewalk fee of $15 per lineal foot. The applicant would
have to pay the $1,800 sidewalk fee prior to permit.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Plan-
ning Commission approves the Site Plan application of J.G. Archi-
tects, Inc. for the construction of a 9,438 square foot, 2-story
office building at 77 Ethan Allen Drive as depicted on a 2 page
set of plans, page 1 entitled "Office Building, Lot 9 - Ethan
Allen Drive, South Burlington, Vermont" prepared by J.G. Archi-
tects, Inc. and dated 1/18/90, last revised 2/20/91, with the
following stipulations:
1. The applicant shall post a $6,000, 3-year landscaping bond
prior to permit. The plan shall be revised prior to permit to
show additional trees along the southwest property line in an
amount, location, and species to be approved by the Planner.
2. A sewer allocation of 473 gpd is granted. The applicant
shall pay the $2.50 sewer allocation fee prior to permit.
3. The applicant shall pay a $1,800 sidewalk fee based on 120
feet of frontage at $15 per lineal foot.
4. The plan shall be revised prior to permit to show: 1) de-
pressed concrete curb for Ethan Allen Drive curb cut, and 2)
culvert under Commerce Avenue Driveway.
5. The applicant shall obtain a zoning permit within 6 months or
this approval is null and void.
