Re: Findings of Fact, application of Randy Berard for conversion
of 2,100 square feet of unused space within an existing office/barn
building to general office use, 75 Ethan Allen Drive.
On the 12th of January, 1993 the South Burlington Planning
Commission approved the request of Randy Berard for site plan
review under Section 19.10 of the South Burlington Zoning
Regulations based on the following findings:
1. This project consists of the conversion of 2,100 square feet of
unused space on the second floor in an existing barn to office
space. The Planning Commission approved office space on the first
floor on 2/6/90 and reapproved the project on 9/18/90.
2. This property located at 75 Ethan Allen Drive lies within the
Mixed Industrial Commercial District. There is presently a
contracting business, offices and a residence on the site. It is
bounded on the east by a vacant industrial lot, on the west by a
contracting business, on the north by Ethan Allen Drive and on the
south by Commerce Avenue.
3. Access/circulation: Access to the office space and contracting
business is via a 22 foot curb cut on Ethan Allen Drive and a 20
foot curb cut on Commerce Drive. The access drive extends between
the two (2) curb cuts. There is a separate curb cut on Ethan Allen
Drive for the residence.
Circulation is adequate.
4. Coverage/setbacks: Building coverage is 11.5% (maximum allowed
is 30%). Overall coverage is 32.6% (maximum allowed is 70%).
All setback requirements are met except the front setback for the
house.
5. Parking: The commercial uses require a total of 22 parking
spaces and 22 spaces are shown including two (2) handicapped
spaces. The parallel parking spaces should be at least 22 feet in
length. The paved parking area should be striped.
6. Landscaping: The minimum landscaping requirement for this
project is $900 which is not being met. The applicant has not
proposed any additional landscaping with the exception of a cedar
hedge around the dumpster and is instead seeking a credit for
existing landscaping. The cedar hedge has a value of $600, the

applicant is therefore seeking a $300 credit. The plan indicates
that the existing landscaping has a value of $26,424.
7. Lighting: Exterior lighting is existing and will consist of
one (1) wall mounted 175 watt mercury vapor light on the west side
of the building and two (2) wall mounted 75 watt incandescent
lights on the north side of the building.
8. Sewer: The sewer allocation for the project is 120 gpd. The
applicant should pay the per gallon fee prior to permit.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the site plan application of Randy Berard for
conversion of 2,100 square feet of unused space within an existing
office/barn building to general office use as depicted on a four
(4) page set of plans, page one entitled "Randy M. Berard, Lot 7,
Permit Site Plan for Barn Renovation", prepared by J.G. Architects
and dated 12/15/92, with the following stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. The applicant shall post a $ 900, 3-year landscaping bond
prior to issuance of a zoning/building permit. The Commission
grants a $ 300 credit for existing landscaping.
3. A sewer allocation of 120 g.p.d. is granted. The applicant
shall pay the required sewer allocation fee prior to issuance
of a zoning/building permit.
4. All existing lighting shall be appropriately shielded or
pointed downward so as not to cast light beyond the property
line. Any change in existing exterior lighting or new
exterior lighting shall be approved by the City Planner prior
to installation. Any new lighting shall be downcasting and
shielded and shall not cast light beyond the property line.
5. The applicant shall obtain a zoning/building permit within six
(6) months or this approval is null and void.
