HomeMy WebLinkAboutSD-10-11 - Decision - 0466 Farrell Street#SD-10-11 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING F+M DEVELOPMENT CO., LLC - FARRELL STREET FINAL PLAT APPLICATION #SD-10-11 FINDINGS OF FACT AND DECISION F+M Development Co, LLC, hereafter referred to as the applicant, is seeking final plat approval to amend a previously approved subdivision plat for a 15 lot subdivision. The amendment consists of correcting a drafting error by removing the phrase "existing property line to be extinguished," Farrell Street. The Development Review Board held a public hearing on April 20, 2010. Eric Farrell represented the applicant. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking final plat approval to amend a previously approved subdivision plat for a 15 lot subdivision. The amendment consists of correcting a drafting error by removing the phrase "existing property line to be extinguished," Farrell Street. 2. The owner of record of the subject property are the constituent lot owners of the "O'Dell Parkway PUD Association, Inc." 3. The application was received on March 22, 2010. 4. The subject property is located in the Commercial 1 Residential 15 Zoning District. 5. The plans submitted consist of the two (2) page set of plans, page one (1) entitled "Revised Final Plat O'Dell Parkway PUD Farrell Street South Burlington Vermont", prepared by Civil Engineering Associates, Inc., dated June 20, 2005, last revised on 10/28/2009. 6. The phrase "Existing Property Line to be Extinguished" was placed on the plat in reference to one of the boundary lines between lots #11 and 12 in error. The request is to remove that phrase from the previously approved final plat. Staff has no issues with their request. /,. All previous approvals and stipulations shall remain in full effect except as amended herein. 2. This project shall be completed as shown on the plat submitted by the applicant and on file in the South Burlington Department of Planning and Zoning. 3. Any changes to the final plat plan shall require approval of the South Burlington Development Review Board. 4. The final plat plan (survey plat) shall be recorded in the land records within 180 days or this approval is null and void. The plan shall be signed by the Board Chair or Clerk prior to recording.
