FINAL PLAT APPLICATION #SD-10-24
FINDINGS OF FACT AND DECISION
F&M Development Corp., hereafter referred to as the applicant, is seeking to amend a previously
approved planned unit development consisting of: 1) 383 residential units in seven (7) buildings, 2) a
63 unit congregate housing facility, 3) a 4,430 sq. ft. expansion of an indoor recreation facility, and 4)
an 16,000 sq. ft. television studio and office building with approval to: 1) raze an existing car wash and
television station, 2) construct a 24,800 sq. ft. 2 and 4 story addition to contain 28 congregate housing
units and 3,000 sq. ft. of social service use to existing 63 unit congregate housing facility, and 3)
construct a 48,500 sq. ft. 4-story multi -family dwelling to contain 42 dwelling units. The amendment
consists of: 1) add the property at 20 Bacon Street to the PUD to construct a parking area, and 2) add
accessory storage use to the approved Bacon Street Lofts building, Bacon Street. The Development
Review Board held a public hearing on Tuesday, August 17, 2010. Eric Farrell represented the
applicant.
Based on testimony provided at the above mentioned public hearing and the plans and supporting
materials contained in the document file for this application, the Development Review Board hereby
finds, concludes and decides the following:
FINDINGS OF FACT
1. The applicant is seeking to amend a previously approved planned unit development consisting of:
1) 383 residential units in seven (7) buildings, 2) a 63 unit congregate housing facility, 3) a 4,430 sq. ft.
expansion of an indoor recreation facility, and 4) an 16,000 sq. ft. television studio and office building
with approval to: 1) raze an existing car wash and television station, 2) construct a 24,800 sq. ft. 2 and
4 story addition to contain 28 congregate housing units and 3,000 sq. ft. of social service use to
existing 63 unit congregate housing facility, and 3) construct a 48,500 sq. ft. 4-story multi -family
dwelling to contain 42 dwelling units. The amendment consists of: 1) add the property at 20 Bacon
Street to the PUD to construct a parking area, and 2) add accessory storage use to the approved
Bacon Street Lofts building, Bacon Street.
2. The owner of record of the subject property is E.F. Farrell, LLC, D.B. Morrissey, LLC, and 20 Bacon
Street, LLC.
3. The subject property is located in the C1-R15 Zoning District.
4. The plans submitted consist of a 19 page set of plans, page one is entitled, "Revised Final Plat
O'Dell Parkway PUD Farrell Street South Burlington Vermont," prepared by Civil Engineering
Associates Inc, dated 6/20/05, last revised on 7/1/10.
5. The applicant is requesting approval to include the parcel at 20 Bacon Street to the PUD. There is
an existing garage building which the applicant is proposing to tear down in favor of expanded parking
for the remainder of the PUD. The new 22 spaces would be a 2 space increase for the PUD, as 20
parking spaces are proposed to be removed from underneath the building known as Bacon Street
Lofts.

for a strip not less than 15 feet wide to be landscaped with dense evergreens or fencing. However, the
Board will require the applicant to provide additional screening between the parking area and the
property line beyond what is proposed. This could count towards the minimum required landscaping
budget for the Bacon Street Lofts.
7. The applicant is also seeking to replace the previously proposed metal siding with a fiber cement
material, as well as to replace the previously proposed dry cooler on the roof with smaller, individual
condenser units to be centered on the roof area and screened.
8. There are no substantive changes to the dimensional elements of the plan. Coverage limitations
and other dimensional requirements are not affected or are impacted by only fractions of a percent.

Plat Application WSD-10-24 of F&M Development Corp, subject to the following conditions:
1. All previous approvals and stipulations shall remain in full effect except as amended herein.
2. This project shall be completed as shown on the plat submitted by the applicant and on file in the
South Burlington Department of Planning and Zoning.
3. The plat plan shall be revised to show the changes below and shall require approval of the A.O.
Three (3) copies of the approved revised plan shall be submitted to the A.O. prior to recording the final
plat plan:
a) The final plat plan shall be revised to include the seal and signature of the land
surveyor.
4. The existing fence along the northerly boundary of 20 Bacon Street shall be maintained. The
applicant shall extend this fence along the A. Bouche property line to the tree line, a distance of
approximately 30 feet in length.
5. The applicant shall obtain a zoning permit within six months pursuant to Section 17.04 of the Land
Development Regulations or this approval is null and void.
6. The applicant shall obtain a Certificate of Occupancy prior to use of the parking area at 20 Bacon
Street.
6. Any changes to the final plat plan shall require approval of the South Burlington Development
Review Board.
7. The final plat plan (survey plat) shall be recorded in the land records within 180 days or this
approval is null and void. The plan shall be signed by the Board Chair or Clerk prior to recording. Prior
to recording the final plat plan, the applicant shall submit a copy of the survey plat in digital format. The
format of the digital information shall require approval of the South Burlington GIS Coordinator.
