FINAL PLAT APPLICATION #SD-10-37
FINDINGS OF FACT AND DECISION
F & M Development Co. LLC, herein referred to as the applicant, is seeking final plat
approval to amend a multi -building mixed -use planned unit development. The
amendment consists of amending condition #14 of final plat application #SD-09-49 to
allow some reserved parking within certain areas of the development, Farrell and Bacon
Streets.
The Development Review Board held a public hearing on January 4, 2011. Eric Farrell
represented the applicant.
Based on testimony provided at the above mentioned public hearing and the plans and
supporting materials contained in the document file for this application, the Development
Review Board finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking final plat approval to amend a multi -building mixed -use
planned unit development. The amendment consists of amending condition #14 of final
plat application #SD-09-49 to allow some reserved parking within certain areas of the
development, Farrell and Bacon Streets.
2. The owners of record of the subject property are EF Farrell, DB Morrissey and Farrell
Street Senior Housing Partnership.
3. The application was received on December 10, 2010
4. The subject property is located in the Cl-R15 Zoning District.
5. The plans submitted consist of an application form and memorandum entitled "O'Dell
Parkway Shared/Reduced Parking Analysis" prepared by Resource Systems Group, Inc.,
dated 12/21 /2010.
Pursuant to Section 14.03(A)(6) of the South Burlington Land Development Regulations,
anv PUD shall require site plan approval. Section 14.06 of the South Burlington Land
Development Regulations establishes the following_ general review standards for all site
plan applications:

The site shall be planned to accomplish ... adequate parking areas [additional
standards unrelated to parking removed for clarity by staffJ.
Based on the Land Development Regulations, the overall PUD will now require 1215
parking spaces. The applicant has provided and or is proposing to provide 911 parking
spaces. This shortfall is 304 spaces or 25.0%.
This figure is within the allowable waiver that may be granted by the DRB, but remains a
significant number. Given this, the Board finds that parking associated with the most
recent phase of development must remain non -reserved to ensure adequate parking for
the multiple uses on the site.
Based on the parking analysis provided by the applicant, together with the provision of
additional non -reserved parking spaces on the site, the Board finds that a parking waiver
of 304 spaces, or 25.0%, is reasonable.

to approve Final Plat Application #SD-10-37 of F+M Development Corp. LLC, subject
to the following conditions:
1. All previous approvals and stipulations shall remain in full effect except as amended
herein.
2. All parking spaces from Lot #8 and the parking demands generated from uses on that
lot, previously considered "grandfathered" for purposes of the Planned Unit
Development, are a part of this PUD.
3. The Development Review Board approves a 304-space or 25.0% parking waiver for a
total of 911 spaces provided.
4. All surface parking spaces on lots 1, 12 and 16, shall be shared. No parking spaces in
these areas shall be reserved or otherwise signed or assigned, except to meet the
Americans with Disabilities Act. All surface parking adjacent on lot 11 shall be non -
reserved between the hours of five (5) pm and seven (7) am.
5. Any changes to the final plat plan shall require approval of the South Burlington
Development Review Board.
