FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Findings of Fact, site plan application #SP-01-43 of W. Thomas Anderson to: 1) add three (3)
temporary accessory structures, and 2) elimination of 36 parking spaces, 76 Ethan Allen Drive.
On the 7th of August, 2001, the South Burlington Development Review Board approved the site
plan application of W. Thomas Anderson under Section 26.10 of the South Burlington Zoning
Regulations based on the following findings:
1. This project consists of a site plan application to: 1) add three temporary accessory
structures, and 2) eliminate of 36 parking spaces, 76 Ethan. Allen Drive.
2. The owner of record is W. Thomas Anderson.
3. Coverage/Setbacks: The applicant proposed storing three (3) trailers on the site. The trailers
will increase overall coverage from 55.3% to 55.9% (70% max). One of the trailers did not
meet the rear setback requirement of 30 feet as it is proposed to be only 23 feet from the
property line. Staff recommended that the trailer be moved to meet rear yard setback
requirements.
4. Parking: The applicant proposed eliminating 36 parking spaces for a total of 14 spaces. A
total of 22 parking spaces are required for this property. The proposed changes would
require an eight (8) space or 36% parking waiver. One handicapped parking space is
required. Staff recommended that the plans be revised to illustrate at least 22 parking spaces
and a handicapped parking space.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board approves
site plan application 4SP-01-43 of W. Thomas Anderson to: 1) add three (3) temporary accessory
structures, and 2) elimination of 36 parking spaces, 76 Ethan Allen Drive, as depicted on a plan
entitled "Anderson, W.T. — Owner Anderson Properties Lot 3, 76 Ethan Allen Drive So.
Burlington, Vermont", prepared by W. Thomas Anderson, dated May 7, 2001, with the following
stipulations:
1. All previous approvals and stipulations which are superseded by this approval shall
remain in effect.
2. The plan shall be revised to show the changes below and shall require approval of the
Director of Planning and Zoning (hereinafter Director). Three (3) copies of the approved
revised plan shall be submitted to the Director prior to permit issuance.
a. The site plan shall be revised to show individual parking spaces meeting the
parking dimensions in place of "parking as needed" on the plan.
b. The site plan shall be revised to move the easterly trailer so that it meets the 30
foot rear yard setback requirement.
c. The site plan shall be revised to show the three (3) parking spaces at the
northwest corner of the building perpendicular to the building.
d. The site plan shall be revised to show one (1) handicapped space.
3. The parking lot shall be striped as shown on the approved plans no later than November
1, 2001.
4. Any change to the site plan shall require approval by the South Burlington Development
Review Board.
