SITE PLAN APPLICATION #SP-18-14
FINDINGS OF FACT AND DECISION
W. Thomas Anderson, hereinafter referred to as the applicant, is seeking after -the -fact approval
to amend a previously approved plan for a 10,500 sq. ft. multi -use building. The amendment
consists of converting Suite 4 (286 sq. ft.) to warehouse & distribution and Suite 7 (600 sq. ft.)
personal service, resulting in the following uses: 1) 600 sq. ft. of "personal service" use, 2)
2,706 sq. ft. of warehouse & distribution use, 3) 2,600 sq. ft. of auto repair use, and 4) 3,165
sq. ft. of "general office" use, 76 Ethan Allen Drive.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking after -the -fact approval to amend a previously approved plan for a
10,500 sq. ft. multi -use building. The amendment consists of converting Suite 4 (286 sq. ft.)
to warehouse & distribution and Suite 7 (600 sq. ft.) personal service, resulting in the
following uses: 1) 600 sq. ft. of "personal service" use, 2) 2,706 sq. ft. of warehouse &
distribution use, 3) 2,600 sq. ft. of auto repair use, and 4) 3,165 sq. ft. of "general office"
use, 76 Ethan Allen Drive.
2. The owner of record of the subject property is W. Thomas Anderson.
3. The subject property is located in the Mixed Industrial - Commercial Zoning District.
4. The application was received on 3/22/2018.
5. The plan submitted is titled, "Site Plan of Lands of W. Thomas Anderson Ethan Allen Drive
South Burlington, Vermont", prepared by Richard W. Bell Land Surveying, Inc., and dated
March, 2018.
DIMENSIONAL REQUIREMENTS
6. Building coverage, overall coverage, and front yard coverage will remain unchanged as the
request is only for a changes of use.
7. Setback requirements are being met.
SITE PLAN REVIEW STANDARDS
Section 14.06 of the South Burlington Land Development Regulations establishes the following
general review standards for all site plan applications:

Only the standards below are affected by this application. All other standards will continue to be
met.
Vehicle and Bicycle Parking
8. The applicant will comply with Section 13.14 of the LDRs to include the new type and
location for bicycle racks, to accommodate the full requirement of one (1) (100% of
requirement) short-term bicycle parking spaces.
9. The vehicular parking requirement is 31 spaces and there are 37 parking spaces available,
including two (2) handicapped spaces.
Traffic
10. No change in traffic generation.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-18-14 of W. Thomas Anderson, subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval shall
remain in effect.
2. This project shall be completed as shown on the plan and shall be on file in the South
Burlington Department of Planning and Zoning.
3. For the purpose of calculating road impact fees under the South Burlington Impact Fee
Ordinance, the Administrative Officer estimates that this change in use will generate
zero (0) additional vehicle trip ends during the p.m. peak hour.
4. The applicant shall obtain a zoning permit within six (6) months pursuant to Section
17.04 of the Land Development Regulations or this approval is null and void.
5. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer
prior to use of the building for the new uses.
6. Any change to the site plan shall require approval by the South Burlington Development
Review Board or the Administrative Officer.
