FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
RE: Findings of Fact, Site Plan Application #SP-01-92 of Waste Systems
International, Inc. seeking amendment of a previously approved site plan
approval for an automobile repair and service use in conjunction with a truck
terminal, 73 Ethan Allen Parkway.
On the 31" day of December, 2001, the South Burlington Director of Planning &
Zoning approved the request of Waste Systems International, Inc. for site plan
review under Section 26.10 of the South Burlington Zoning Regulations based on
the following findings:
This project consists of an amendment to #SP-01-15 to replace the approved
screened dumpster with two enclosed metal box receptacles for the storage
of used tires at 73 Ethan Allen Parkway.
2. The owners of record of this property are Joseph Kelly and Sean Kelly.
3. Access, Circulation and Parkin: No changes to the approved access and
circulation for this property are proposed.
4. Coverage and Setbacks: The installation of the proposed enclosed metal box
receptacles will increase overall site coverage by 216 SF, or 0.52%, to 65.52%.
This is within the 70% limit for the Mixed -Industrial Commercial district. All
other coverages and all setback requirements are met.
5. Traffic: No changes to traffic generation will result from replacement of the
dumpster with the metal box receptacles.
6. Sewer: No additional wastewater allocation is needed.
7. Landscaping: As the metal box receptacles will be located behind the
building, no additional landscaping is recommended.
8. L ghiing: No changes to exterior lighting are proposed.

DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Director of Planning and
Zoning approves the site plan application of Waste Systems International, Inc. to
amend previously approved site plan #SP-01-15 to replace a screened dumpster
area with two enclosed metal box receptacles at 73 Ethan Allen Parkway, as
depicted on a plan entitled "Site Plan of 73 Ethan Allen Parkway" prepared by
Bradford L. Holden and dated October 19, 2001, with the following stipulations:
All previous approvals and stipulations that are not superseded by this
approval shall remain in effect.
2. The metal box enclosures shall be fully enclosed. Any change to the location
or configuration of the approved enclosures shall require approval of the
South Burlington Development Review Board.
3. Any changes to exterior lighting shall require approval of the Director of
Planning & Zoning prior to installation.
4. The applicant shall obtain a zoning permit within six (6) months of the date
of this approval, pursuant to Section 27.302 of the South Burlington Zoning
Regulations, or this approval shall be null and void.
5. The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer,
6. Any changes to the site plan shall require approval by the South Burlington
Development Review Board.
