HomeMy WebLinkAboutSP-17-77 - Decision - 0072 Ethan Allen Drive#SP-17-77 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING CRYSTAL THOMPSON - 72 ETHAN ALLEN DRIVE SITE PLAN APPLICATION #SP-17-77 FINDINGS OF FACT AND DECISION Crystal Thompson, hereinafter referred to as the applicant, is seeking approval to amend a previously approved plan for a 9,800 sq. ft. building consisting of 4,410 of social services use and 5,390 sq. ft. of child care facility, licensed non-residential use for 41 students. The amendment consists of after -the -fact approval to expand the outdoor play area by 1800 sq. ft., 72 Ethan Allen Drive. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking to amend a previously approved plan for a 9,800 sq. ft. building consisting of 4,410 sq. ft. of social services use and 5,390 sq. ft. of child care facility, licensed non-residential use for 41 students. The amendment consists of after - the -fact approval to expand the outdoor play area by 1800 sq. ft., 72 Ethan Allen Drive 2. The owner of record of the subject property is Robert V. Willis d/b/a Rising Star Properties. 3. The subject property is located in the Mixed Industrial & Commercial (Mixed IC) Zoning District. 4. The application was received on November 15, 2017 5. The changes to the last approved site plan includes expanding the play area, eliminating the dumpster enclosure and adding a new bike rack. 6. This application is to reapprove site plan application #SP-16-58, for only the playground expansion, which expired due to the applicant not obtaining the zoning permit within six (6) months of the approval. DIMENSIONAL REQUIREMENTS 7. The overall coverage will increase to 43.0 % (maximum allowed is 70% 8. Setback requirements are being met. SITE PLAN REVIEW STANDARDS - 1 — #SP-17-77 Only the standards below are affected by this application. All other standards will continue to be met. Bicycle Parking 9. The plan complies with Section 13.14 of the LDRs to include the new type and location for bicycle racks, to accommodate the minimum requirement of two (2) short- term bicycle parking spaces (50% of requirement). DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-17-77 of Crystal Thompson, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 4. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to the use of the expanded play area. 5. Any change to the site plan shall require approval by the South Burlington Development Review Board or the Administrative Officer. n Signed on this day of 2017 by ymond J. This Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
