MINOR LOT LINE ADJUSTMENT APPLICATION #AD-18-02
FINDINGS OF FACT AND DECISION
Robert V. & Ruby B. Willis, hereinafter referred to as the applicants, are seeking
approval for a minor boundary line adjustment between 72 & 74 Ethan Allen Drive.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the follow:
FINDINGS OF FACT
1. The applicants are seeking approval for a minor boundary line adjustment between
72 & 74 Ethan Allen Drive.
2. The owners of record of the subject properties are Robert V. & Ruby B. Willis,
Trustees of Robert V. Willis Family Trust.
3. The subject properties are located in the Mixed Industrial - Commercial District.
4. The application was received on April 23, 2018.
5. The subject properties consist of two (2) lots of approximately one (1) acre. (72
Ethan Allen Drive), and 0.97 acres (74 Ethan Allen Drive). The proposal is to merge the
two (2) lots into one (1) lot of 1.97 acres.
6. The plat submitted is entitled, "Boundary Consolidation Plat Robert & Ruby Willis
Parcel ID #0640-00072 72 Ethan Allen Drive South Burlington, Vermont", prepared by
Trudell Consulting Engineers, and dated 4/10/18.
DIMENSIONAL REQUIREMENTS
7. All area and dimensional requirements will continue to be met for the merged lot.
PURSUANT TO SECTION 15.19(B) OF THE LAND DEVELOPMENT
REGULA TIONS.
NO NEW LOTS ARE CREATED THROUGH THIS ADJUSTMENT.
8. The boundary line adjustment between the lots involved will not result in the creation
of any new lots. The result of this boundary line adjustment will that two (2) adjoining
lots will be merged into one (1) lot.
THE SALE OR EXCHANGE OF PARCELS OF LAND IS BETWEEN ADJACENT
PROPERTY OWNERS.

9. The lot line adjustments will be between the same property owners.
THE RELOCATION OF THE LOT -LINE DOES NOT RESULT IN THE CREATION OF
A NON -CONFORMING LOT, STRUCTURE OR USE.
10. The merger of the two (2) lots in question will result in bringing 74 Ethan Allen Drive
into compliance with the front setback coverage requirement.
THE PROPOSED CHANGE DOES NOT VIOLATE ANY CONDITIONS IMPOSED
FROM PRIOR MUNICIPAL APPROVAL.
11. This lot line adjustment does not violate any conditions of any prior approvals.

12. The plat should be revised to: 1) include the signature of the land surveyor, and 2)
replace "Development Review Board" with "Administrative Officer" in the resolution
statement.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves Minor
Lot Line Adjustment Application #AD-18-02 of Robert V. & Ruby B. Willis, for a boundary
line adjustment between 72 & 74 Ethan Allen Drive, subject to the following conditions:
1. All previous municipal approvals and stipulations which are not superseded by this
approval will remain in effect.
2. This project must be completed as shown on the plat and shall be on file in the
South Burlington Department of Planning and Zoning.
3. The plans must be revised to show the changes below and will require approval of
the Administrative Officer. Three (3) hard copies of the approved revised plans must
be submitted to the Administrative Officer prior to zoning permit issuance.
a. The plat must be revised to: 1) include the signature of the land surveyor,
and 2) replace "Development Review Board" with "Administrative Officer" in
the resolution statement.
4. The applicant shall obtain a zoning permit within six (6) months pursuant to Section
17.04 of the Land Development Regulations or this approval is null and void.
5. The final plat plan shall be recorded in the land records within 180 days or this
approval is null and void. The plan shall be signed by the Administrative Officer prior
to recording. Prior to recording the final plat plan, the applicant shall submit a copy
of the survey plat in digital format. The format of the digital information shall require
approval of the South Burlington GIS Coordinator.

6. Any change to the plat plan shall require approval by the South Burlington
Development Review Board_ r he Administrative/Officer.

PLEASE NOTE: Pursuant to 24 VSA §4465, an interested person may appeal this decision
by filing a Notice of Appeal with the secretary of the Development Review Board. This
Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days
of the date of this decision.
