FINDINGS OF FACT AND DECISION
Crystal Thompson, hereinafter referred to as the applicant, is seeking approval to amend
a previously approved plan for a 9,800 sq. ft. building consisting of 4,410 sq. ft. of social
services use and 5,390 sq. ft. of child care facility, licensed non-residential use for 41
students. The amendment consists of: 1) adding 74 additional students for a total of 115
students, and 2) converting 4,410 sq. ft. of social services use to child care facility,
licensed non-residential use, 72 Ethan Allen Drive.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking to amend a previously approved plan for a 9,800 sq. ft.
building consisting of 4,410 sq. ft. of social services use and 5,390 sq. ft. of child
care facility, licensed non-residential use for 41 students. The amendment consists
of: 1) adding 74 additional students for a total of 115 students, and 2) converting
4,410 sq. ft. of social services use to child care facility, licensed non-residential use,
72 Ethan Allen Drive.
2. The owner of record of the subject property is Robert V. Willis d/b/a Rising Star
Properties.
3. The subject property is located in the Mixed Industrial & Commercial (Mixed IC)
Zoning District.
4. The application was received on May 25, 2018.
5. No changes to the approved site plan proposed.
DIMENSIONAL REQUIREMENTS
6. No changes to the coverages.
7. Setback requirements are being met.
SITE PLAN REVIEW STANDARDS
Only the standards below are affected by this application. All other standards will
continue to be met.

Bicycle Parking
9. The property currently has one (1) bike rack which can accommodate two (2) bicycles
per the last site plan approval (#SP-17-77). This new plan will add one (1) rack to
accommodate two (2) more bicycles to meet the minimum requirement of four (4) short-
term bicycle parking spaces (100% of requirement). The plan shows a new bike rack to
be added to the front of the building next to the existing one. The applicant has indicated
that this is in error, so the plan should be revised to correct this error.
Parking
10. The existing and proposed student expansion will require a total of 28 parking
spaces and a total of 47 spaces two (2) handicapped spaces are being provided. A bike
rack is shown on the plan.
Traffic
14. The current uses are estimated to generate 34.6 pm peak hour trip ends, using the
ITE 10th edition (10.8 vtes for existing social services use & 23.8 vtes for the 41 child
care facility). The City of South Burlington Impact Fee Ordinance was amended on May
19, 2014 to allow a pass -by rate reduction of 30% when estimating the traffic to be
generated by child care centers for which the City has issued a zoning permit since
1/1/11. The 115 students are estimated to generate 83 vtes and with the 30% reduction
to generate 58.1 additional vtes (83 X 0.7 = 58.1). The existing child care use minus the
trip ends generated by the social services use plus the proposed additional students will
generate an additional 23.5 vtes for a total of 58.1 vtes generated by the child care use
with 115 students.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-18-23 of Crystal Thompson, subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval
shall remain in effect.
2. This project shall be completed as shown on the plan and shall be on file in the
South Burlington Department of Planning and Zoning.
3. The plan must be revised to show the changes below and will require approval of the
Administrative Officer. Three (3) copies of the approved revised plan must be
submitted to the Administrative Officer prior to permit issuance.
a. The site plan must be revised to eliminate the new bike rack in front of the
building.

4. For the purpose of calculating road impact fees under the South Burlington Impact
Fee Ordinance, the Administrative Officer estimates that this change in use will
generate 23.5 additional vehicle trip ends during the p.m. peak hour.
5. The applicant shall obtain a zoning permit within six (6) months pursuant to Section
17.04 of the Land Development Regulations or this approval is null and void.
6. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer
prior to the use of the expanded child care facility.
7. Any change to the site plan shall require approval by the South Burlington
Development Review Board or the Administrative Officer.

Board. This Notice of Appeal must be accompanied with a $233 filing fee and be filed
within 15 days of the date of this decision.
