WITNESSETH: WHEREAS, Developer has received site p14n approval from the MUNICIPALITY'S Planning Commission for the development of property located at 20 Farrell Street , as 'depicted an a site plan entitled 20 Farrell Street Buildin dated 8/2U95 and prepares by Norther Archi is c. WHEREAS, Developer is required by said approval, at its own expense, to complete certain improvements; and WHEREAS, the parties to this Agreement wish to establish an escrow account to secure the obligations of the Developer as set forth in the City approval; and WHEREAS, the Bank executes this Agreement solely in the capacity of escrow agent. NOW THEREFORE, the parties hereby covenant and agree as follows: 1. DEVELOPER will, at its own expense, complete the following construction as depicted and in accordance with the specifications set forth in said site plan and related documents. landscaping 2. The Developer shall complete the improvements set forth in Paragraph one no later than 6/27/98 3. DEVELOPER shall replace or repa4ir any defective or improper work or materials which may be recognized within three (3) years after completion of the improvements set forth in paraKraph one. For the purpose of this Agreement "completion" shall be deemed to have occurred when the MUNICIPALITY has inspected and $pproved the construction of all the improvements required by this Agreement and issued written notice to the DEVELOPER that the construction is complete. 4. For the guaranty of Develope-F's performance of all requirements hereinabove set forth, and prior to the issuance of any zoning permit for Blueprints, Etc., Inc. , Developer and Bank agree that the sutra of 14,050,00 shall be set aside and held in escrow by the Bank DRUG 23 '95 13:58 CITY `S BURLINGTON P.2/3 and shall be available for payment to the Municipality in accordance with the terms herein set forth. 5. If the Municipality shall file with the Bank a statement that the Developer is in the judgement of Municipality in default under the terms of this Agreement, the Bank shall from time to time pay monies from said escrow fund to the Municipality, in amounts not to exceed a total enabling the Municipality to complete improvements and requirements set forth in this Agreement. 6. The Municipality will promptly submit to the Developer a copy of such statement as it files with the Bank. The consent of the developer to such payment by the Bank to the Municipality shall not be required. The Bank shall incur no liability to the Developer on account of making such payment to the Municipality, nor shall the Bank be required to inquire into the propriety of any claim by the 1VMunicipality of default on the part of the Developer or into the use of such funds by the Municipality in completing such improvements. 7. The Municipality shall not file with the Bank a statement of default until thirty (30) days after notice has been sent by it to the Developer by certified mail, return receipt requested, setting forth its intention to do so- 8. All monies released by the Bank to the Municipality pursuant to paragraph ai five (5) shall be used by the Municipality solely for the purpose of performing obligations imposed upon the Developer by that portion of this Agreement upon, which the Developer is then in default, Any work to be performed by the Municipality pursuant hereto shall be let on a contractual basis, or on a time and material basis or shall be performed by the Municipality with its own work force and equipment or shall be accomplished in such manner as in the judgement of the Municipality shall accomplish the work most expeditiously and economically. 9. If monies are released by the Bank to the Municipality pursuant to paragraph five (5) and it shall later develop that a portion of the released monies are surplus to the Municipality's needs, any such surplus shall be refunded by the Municipality to the Bank to be held and distributed by the Bank pursuant to the terms of this Agreement. 10. The Bank will not refuse or delay to make such payments to the Municipality when requested by the Municipality by the appropriate statement, and Developer will clot -Interfere with or hinder such payments by the Bank to the Municipality. Said statement shall contain a certificate of compliance with the notice requirements of paragraph seven (7) of this Agreement. 11. This Agreement shall terminate and shall be of no force or effect upon performance of all requirements contemplated hereby, and the completion of the warranty period set forth in paragraph three (3) . 12. The amendment is to eliminate phase II, 20 Farrell Street, as depicted on a plan entitled "Proposed Office Building, 20 Farrell Street, South Burlington, Vermont," prepared by Northern Architects, Inc., dated 7-8-87, last revised 8/14/95, with a stamped "received" date of August 14, 1995, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) The plan shall be revised to show the changes listed below and shall require approval by the City Planner. Three (3) copies of the approved revised site plan shall be submitted to the City Planner prior. a) The site plan shall be revised to eliminate all Phase II portions of the project, i.e. parking area, coverage notation, planting schedule, etc. If the eliminated parking area is to remain in its existing wooded state, it should be shown as such on the plan. b) The plan shall show the air conditionaing units and pads located on the south side of the building. c) The planting schedule shall be revised to indicate a 2 1/2" caliper sugar maple instead of a 4" caliper sugar maple. 3) The applicant shall post a $4,050 landscaping bond prior to issuance of a zoning permit. He suggested reversing parking if the adjacent owner develops his property and putting a row adjacent to this property. Mr. Weith said that would work if the road is one way only. Mr. Sheahan moved that the Planning Commission endorse the concept as presented by the city for a median cut on Dorset Street.. Ms. Barone seconded. The applicant is looking to reduce the landscape bond and showed what landscaping would be eliminated. He noted they are still above the requirement. The footprint of the building would remain the same. There would, however, be no reserved future parking area. Site Plan application of David Simindinger to raze a drive-in bank building and construct a 1750 sq. ft. convenience store with gas sales, deli, ATM Machine and an 1800 sq. ft. canopy, 801 Williston Road: Mr. Simindinger said they will remove the existing Chitt.enden Bank building and build a convenience store with y�� cas, she store will be 1750 sq. ft. and will have an ATM machine. There will be three gas pumps on one island. Setbacks are met. The canopy will have lighting and a fire suppression system. The building would be brick with a gable roof. The applicant said they have a letter from Chittenden Bank indicating they are not abandoning the use as a bank. Mr. Boyle said they meet all coverages. Circulation would be from a right turn in, right turn out only (on Williston Road). From Spear Street, it would be an entrance only. He showed the traffic pattern on the lot. There would be 23 parking spaces. Mr. Burgess questioned the need for 2 driveways on Williston Rd. and also the width of the driveways. Mr. Boyle said they don't see a strong need for 40'. Mr. Simindinger said they need the 2 driveways because of a 60 ft. tractor trailer which makes de- liveries. Mr. Boyle noted there is a median in the driveway. The second driveway is to reduce traffic to the intersection with Spear St. It also facilitates the trailer coming in. Mr. Boyle showed what they feel would be the ideal circulation pattern but noted it is prohibited because of the required 200 ft. setback Memorandum - Planning August 22,1995 agenda items August 18, 1995 Page 2 The City Manager responded to the Planning Staff 's and the City Engineer's comments (see enclosed). 5) BRUCE ERDMANN- ELIMINATE PHASE II - SITE PLAN This application is to amend a previously approved site plan for construction of a 10,000 square foot office building in two (2) phases of 5,000 square feet each. The amendment is to eliminate phase II. The last review of this property by the Planning Commission was on 6/27/95 (minutes enclosed). This property located at 20 Farrell Street lies within the C2 and CO zones and is bounded on the north by the Vermont Lung Association, on the east by East Woods, on the south by a warehouse/distribution building and on the west by Farrell Street. Access/circulation: Access will be provided by one (1) 22 foot wide curb cut on Farrell Street. No change proposed. Circulation is adequate. Coverage/setbacks: Building coverage is 9% (maximum allowed is 30%). Overall coverage is 29.9% (maximum allowed is 70%). Front yard coverage is 19% (maximum allowed is 30%). The building meets the setback requirements except that it will project seven ( 7 ) feet into C.O. zone and will result in 54 square feet of the building being within the C.O. zone. The owner obtained a variance from the ZBA for this encroachment. Parking: A total of 20 parking spaces are required and 25 spaces including two (2) handicapped spaces are being provided. A bike rack is being provided as required. Landscaping: The minimum landscaping requirement, based on building costs, is $4050 which is being met. Plantings will include Sugar Maple, Burning Bush and Juniper. Sewer: The sewer allocation required is 120 gpd. The applicant will be required to pay the per gallon fee prior to the issuance of the permit. 2 Memorandum - Planning August 22, 1995 agenda items August 18, 1995 Page 3 Traffic: ITE estimates that the building will generate 17 vehicle F trip ends during the P.M. peak hour. The road impact fee will be approximately $3500. Lighting: Exterior lighting consists of two (2) 250 watt metal halide cutoff luminaries on 14 foot poles and two (2) 100 watt incandescent recessed lights attached to the building. Dumpster: Dumpster is proposed to be screened with an evergreen hedge as required on 5/25/93. Other: The site plan should be revised to eliminate the phase II portions of the project which are being eliminated, i.e., parking coverage, planting schedule, etc. If this area is to remain in its existing wooded state, it should be shown as such on the plan. 6) DAVID SIMENDINGER - CONVENIENCE STORE -SITE PLAN This project consists of razing a drive-in bank building and constructing a 1750 square foot convenience store with gas sales, deli, ATM machine and an 1800 square foot canopy. The ZBA granted a conditional use permit for this facility on 4/27/95. his property located at 801 Williston Road lies within the C1 District. It is bounded on the west by Spear Street, on the south by a residence and the Burlington Tennis Club, on the east by a service station and Staples Plaza, and on the north by Williston Road. Access/circulation: Access will be provided by a 20 foot wide, right -turn ingress only curb cut on Spear Street and a 40 foot wide ingress and egress curb cut on Williston Road. The Williston Road curb cut is designed to discourage left turn movements for entering and exiting traffic. This design, which includes an island to separate ingress and egress traffic, results in a 40 foot wide curb cut which exceeds the 36 foot wide limit. The Planning Commission under Section 26.103(b) of the zoning regulations may approve a wider driveway due to special circumstances. This proposal also results in two (2) driveways. Site plan application of Blueprints, Etc, to amend a previously approved site plan for the construction of a 2-story, 10,000 sq. ft. office building on a 1.3 acre lot. The amendment consists of phasing the project into two phases, each consisting of 5,000 sq. ft; 20 Farrell Street: Mr. Erdmann said this is the only change to the plan. This property located at 20 Farrell Street lies within the C2 and ' CO zones and is bounded on the north by the Vermont Lung ,� s Association, on the east by East Woods, on the south by a warehouse/distribution building and on the west by Farrell Street. Access/circulation: Access will be provided by one (1) 22 foot wide curb cut on Farrell Street. Circulation is adequate. Coverage/setbacks: Building coverage is 9% (maximum allowed is 30%) . Overall coverage for Phase I is 29.9% and for Phase II it is 39% (maximum allowed is 70%). Front yard coverage is 19% (maximum allowed is 30%). The building meets the setback requirements except that it will project seven (7) feet into C.O. zone and will result in 54 square feet of the building being within the C.O. zone. The owner obtained a variance from the ZBA for this encroachment. .6 Memorandum - Planning June 27, 1995 agenda items June 23, 1995 Page 7 Parking: Each phase requires 20 parking spaces for a total of 40 spaces. The landscaping proposal falls $5258 short of this requirement. The Planning Commission, as part of the latest s approval, granted a landscaping credit for the shortfall. The credit was given for the existing trees to be preserved within the C.O. District and within the front yard area of the property. Staff recommends that all the landscaping be planted as part of Phase I. Lighting: Exterior lighting consists of two (2) 250 watt metal halide cutoff luminaries on 14 foot poles and two (2) 100 watt incandescent recessed lights attached to the building. In that event, the Real Estate Owner shall be reimbursed by the City the sum of $11.62 per lineal foot for approximately 2800 lineal feet of frontage of said other landowners, when and if the other landowners avail themselves of the sewer line extension constructed by the Real Estate Owner, but not otherwise. 4. Front footage, as used herein, shall mean the length in feet of the real property line which borders a public right- of-way easement. The applicant is seeking a variance from the Zoning Board of Adjustment on January 9, 1995 in order to build the building with 54 square feet located within 93 feet of the centerline of Potash Brook. This property located at 20 Farrell Street lies within the C2 and CO zones and is bounded on the north by the Vermont Lung Association, on the east by East Woods, on the south by a warehouse/distribution building and on the west by Farrell Street. Access/circulation: Access will be provided by one (1) 22 foot wide curb cut on Farrell Street. Circulation is adequate. Coverage/setbacks: Building coverage is 9% (maximum allowed is 30%). Overall coverage is 39% (maximum allowed is 70%). Front yard coverage is 19% (maximum allowed is 30%). A bike rack is being provided as required under Section 26.253(b) of the zoning regulations. Landscaping: The landscaping requirement for this project is $11,500. The landscaping proposal falls $5258 short of this requirement. The applicant is seeking a credit for this shortfall. Under Section 26.105(a) of the zoning regulations the Planning Commission may grant some credit for existing trees or for site improvements other than tree planting as long as the objectives of this section are not reduced. No trees may be cut within the CO zone. Sewer: The sewer allocation for this project is 500 gpd. The applicant will have to pay the per gallon fee prior to permit. r Traffic: The lot is not in a Traffic Overlay Zone. However, the applicant must contribute $873 to the Shelburne Road Intersection��� Improvement Fund based on 34 new peak hour trip ends generated by this use. �y Drainage easement: The plan shows a 15 foot drainage easement �A along the front of the property. This easement was a requirement of the 8/25/87 approval. The legal documents granting this easement must be recorded prior to permit. Sewer Line Extension: One of the requirements of the 8/25/87 approval was that the developer reimburse the City $11,62/linear foot of frontage for the 1976 sewer line extension prior to permit. Lighting: Exterior lighting consists of two (2) 250 watt metal halide cutoff luminaries on 14 foot poles and two (2) 100 watt incandescent recessed lights attached to the building. Other: Dumpster is proposed to be screened with an evergreen hedge as required on 5/25/93. Details can be worked out with staff. Regarding the Gleason property, it is currently permitted for 5,000 sq. ft. of retail use. Mr. Khouri said they haven't yet leased it. Mr. Weith suggested getting permission to put tem- porary parking on the land until it can be leased and built on. Mr. Weith said another concern is that the approval for the retail building expires in September, 1994. He suggested that if parking is approved for the area there be a stipulation that a building permit must be applied for by 1 July or a new permanent plan be presented. Regarding the boundary line adjustment, Mr. Weith said it looks like the Chittenden Bank lot is being merged with University Mall. Mr. Khouri said this isn't so. The Chittenden Bank land is leased. There will be a subdivision; however. Ms. Knox noted the Chittenden Bank land is counted for coverage. Mr. Weith replied that in the future if the Chittenden wants to do anything with the land, they would have to consider the whole property. Mr. Khouri said they have been asked to relocate the northern curb cut somewhat to the south to line up directly with Corpor- ate Way. This is being coordinated with the Dorset St. project. There will now be three exit lanes, two for left turns and one for right turns and straight ahead. Mr. Khouri said there is a condition of their agreement with How- ard Johnson's to put up a stockade fence. The Commission had no problem with this. Ms. McDonald was concerned about general lack of parking for commuters in the area who use the Interstate and suggested a small percent of spaces in the Mall lot be set aside for this purpose. Mr. Khouri responded that this would create an insur- ance problem as such areas are often targeted by car thieves who realize cars will be there unattended all day. He said they would be willing to do something unofficial. 4. DEVELOPMENT MANAGEMENT POLICY The development management policy influences the rate, amount, type, location, and/or quality of future development. Objectives of the South Burlington development management policy are to: 1. Provide adequate municipal services and facilities; 2. Maintain an identity and enhance the "quality of life"; 3. Establish a stable and proportional tax effort relative to other municipalities for existing and future residents; 4. Accept a "fair share" of the burdens and benefits as a member of a regional community in housing, commerce, and industry; 5. Recognize the consequences of South Burlington's geographic location (relative to the urban core, suburban communities, and rural towns) and the type and extent of its future development; and 6. Provide adequate employment opportunities for the citizens of South Burlington. While the City chooses not to totally control the rate of devel- opment within its boundaries, it can influence the type and location of development that does occur. A management policy must consider the interrelationships of all types of development in establishing zoning boundaries and densities. The management policy also must insure that development may occur only in con- formance with the municipality's ability to provide services. Finally, the management policy must strive to achieve: 1) the balance between the residential and non-residential sectors of the economy, 2) phased development to allow for carefully planned and guided growth, and 3) development which respects the finite supply of irreplaceable natural resources within and around the City. Recommendations and Implementation 1. Zoning boundaries in the Southeast Quadrant shall be deline- ated in such a manner that new development, with public sewer and water, shall be directed to those areas located within the desig- nated general growth area on Map 8. These areas are contiguous to existing urban areas. On the 25th of May, 1993, the South Burlington Planning Commission approved the request of Trillium Limited Partnership for site plan review under Section 19.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of the construction of a two (2) story 10,000 square foot office building on a 1.3 acre lot. Site plan approval for this building was granted on August 25, 1987 and on January 14, 1992 and a six (6) month extension was granted on 6/23/92 but this building has never been built. The applicant received a variance from the Zoning Board of Adjustment on April 12, 1993 in order to build the building with 54 square feet located within 93 feet of the centerline of Potash Brook. 2. This property is located in the C2 and CO zones and is bounded on the north by the Vermont Lung Association, on the east by East Woods, on the south by a warehouse/distribution building and on the west by Farrell Street. 3. Access/Circulation: Access will be via one (1) 30 foot wide curb cut on Farrell Street. A 30 foot wide drive will serve the first 100 feet. It will then narrow to 24 feet to serve the parking area. Circulation pattern is acceptable. 4. Parking: The project requires a total of 40 parking spaces and 39 spaces are shown on the plan including one (1) handicapped space. Parking stall dimensions and aisle widths meet minimum requirements. The Planning Commission granted a waiver of one (1) parking space on 1/14/92. The plan should be revised to indicate that only 39 spaces are being provided. 5. Coverage/setbacks: Building coverage is 9% (maximum allowed is 30%). Overall coverage is 42% (maximum allowed is 70%). Front yard coverage is 18.9% (maximum allowed is 30%). The building does not meet the 100 foot setback requirement from the center of Potash Brook. It will project seven (7) feet into this setback area and will result in 54 square feet of the building within the Conservation zone. The applicant appeared before the Zoning Board of Adjustment on April 12, 1993 and was granted a 1 variance for the encroachment into the CO zone. All other setback requirements are met. 6. Landscaping: The landscaping requirement for this project is $11,500. The landscaping proposal falls $5600 short of this requirement. The applicant is seeking a credit for this shortfall. Mrs. Maher noted a work session scheduled for 31 March. This is the night of party caucuses and she felt there would not be a quorum. Members suggested meeting on 2 April, which is a Thursday evening. This was accepted. 2. The applicant shall post an $11,500, 3 year landscaping bond prior to permit. Site plan approval for this building was granted on August 25, 1987 (see enclosed minutes) but the building was never built. The appli- cant was granted a variance from the Zoning Board from dimension- al requirements in order to build the building with 54 square feet located within 93 feet of the centerline of Potash Brook. This property is located in the C2 zone and is bounded on the north by the Vermont Lung Association, on the east by East Woods, on the south by a warehouse/distribution building and on the west by Farrell Street. Access/circulation: Access will be via one (1) 30 foot wide curb cut on Farrell Street. A 30 foot wide drive will serve the first 100 feet. It will then narrow to 24 feet to serve the parking area. Circulation pattern is acceptable. Parking: The project- require-- a total of 40 parking spaces and 40 are shown on the plan including one (1) handicapped space. Parking stall dimensions and aisle widths meet minimum require- ments. Coverage/setbacks: Building coverage is 9% (maximum allowed is 30%). Overall coverage is 42% (maximum allowed is 70%). Front yard coverage is 18.9% (maximum allowed is 30%). The building does not meet the 100 setback requirement from the center of Potash Brook. It will project seven (7) feet into this setback area and will result in 54 square feet of the building within the Conservation zone. The applicant appeared before the Zoning Board of Adjustment on December 9, 1991 and was granted variance for the encroachment into the CO zone. All other set- back requirements will be met. Landscaping: The landscaping requirement for this project is $11,500. The landscaping proposal falls $7,618 short of this requirement. The applicant is seeking a credit for this short- fall. Under Section 19.104(a) of the zoning regulations the Planning Commission may grant some credit for existing trees or for site improvments other than tree planting as long as the objectives of this section are not reduced. No trees may be cut within the CO zone. However, the applicant must contribute $750 to the Shelburne Road Intersection Improvement Fund based on 29.1 new trip ends to be generated by this use. Drainage easement: The plans shows a 15 foot drainage easement along the front of the property. This easement was a requirement of the 8/25/87 approval. The legal documents granting this easement to the City must be submitted for review by the City Attorney, and must be recorded prior to permit. Sewer Line Extension: One of the requirements of the 8/25/87 approval was that the developer reimburse the City $11.62/linear foot of frontage for the 1976 sewer line extension prior to per- mit. This should be made a condition of this approval. Other: --- a screened dumpster area is shown and it is located in front of a parking stall. When this stall is being used, the dumpster can not be accessed. --- exterior lighting consists of two (2) 250 watt metal halide cutoff luminaries on 14 foot poles and two (2) 100 watt incandescent recessed lights attached to the building. --- The applicant has been requested to provide fire flow information for the fire hydrant at Farrell and Swift Streets. The Fire Chief needs this information in order to determine adequate water capacity for a building of this size. This letter is intended to provide you with the additional information you requested. The area of the site is 1.3 acres. The coverage percentages for landscaped areas are 58% and for the overall coverages 42%. I have included the site area and coverage percentages in a revised site plan application which is enclosed. You are correct in assuming that I am requesting that a credit be given for the existing trees. The trees and vegetation on site are quite extensive. Many of the trees are over 12" in diameter. Any one of these trees would be worth the $7,600 which I am request- ing as credit. I believe that with the landscaping which I am pro- posing and the existing landscaping, the resulting project will have sufficient landscaping. Per our discussion, I intend to provide you with legal documents for the drainage easement prior to receipt of my actual permit. As the City experiences more intense development, extreme care must be taken to preserve and protect the natural and man- made environment. 3. The City should participate in Act 250 reviews on both local, and regional projects which affect the City, especially where local jurisdiction may be inadequate. 4. The City should enforce the adopted health regulations per- taining to sewage disposal. 5. The City should continue phasing requirements on individual projects as needed to dissipate impacts on municipal services. 6. Standards for quality and capacity of municipal service should be used for review criteria in subdivision regulations and should be updated as needed. 7. The Southeast Quadrant should be developed in a gradual, well planned manner that provides a variety of development patterns at differing densities. Development should follow a general pattern of moderate density in the northern portion and rural residential density in the southern portion. 8. To allow for farming and to encourage open space preserva- tion, recreational or other creative uses of the land, the City should consider alternative ownership arrangements of large parcels of land created by clustered development. One possible option, a land bank, entails public acquisition of land in ad- vance of urbanization. Such land could be retained as permanent open space or resold for private development where deemed appro- priate. Another possible option is the use of Transferable Development Rights. 9. The City should actively pursue the acquisition of develop- ment rights such as through the encouragement of land trusts for recreational use, farming and the protection of views and the open character of the area. 10. The City should protect water quality and drainageway buff- ers by reserving them for stormwater, pedestrian trails and possible future sewer and water easements. 11. At the south east corner of the building the driveway shrinks to 20 feet wide because one parking space juts out into the drive. This should be corrected. The drive on the west of the building is gravel. In the south west corner circulation may be tight. Parking:' Twenty four spaces are required to meet the ordinance requirement. (Office = 4 spaces plus 23 non office workers = 15 spaces plus five for company vehicles). The plans show 27. Landscaping: According to my calculations, $2860. worth of landscaping is shown (excluding cost for lawn) because we do not give credit for that). 11 The plans require $7940 in landscaping. The Commission should require that the applicant plant larger maples and some salt resistant evergreens in the front yard. A landscaping bond of $7940 shall be posted prior to permit. Traffic: This lot is in traffic overlay zone 5 and a maximum of 57 peak hour trip ends are allowed. According to limited ITE data the following peak hour trip ends will be generated by this use: 10 for manufacturing, 14 for industrial, 22 for warehousing. The Act 250 umbrella permit allowed a total of 125 trip ends during the peak hour from this subdivision. To date, 92 projected trip ends have been approved. The Planning Commission approval required a review of traffic before approval of the 5th lot (this application). The also required an analysis of the need for a connection to the Green Tree Park land (formerly Willis land). It was noted that approval of lots #5 and 6 could be withheld until conditions are brought up to par. (Minutes of 4/8/80). Other: See Bill Szymanski's and Chief Goddette's comments. A sewer allocation of 270 gpd must be made and a $2.50/gallon fee must be paid prior to permit. 7) THE DAVIS COMPANY, 20 FARRELL STREET The applicant proposes to construct a 10,000 square foot, office building o ice b7ui1-t-ng on a 1.3 acre lot. The applicant is seeking a variance from the Zoning Board from dimensional requirements, in order to build the building with 54 square feet located to within 95 feet of the centerline of Potash Brook. Access: Access is via a 24 foot wide drive off Farrell. Street. Parking: Forty spaces are required; 41 are shown. Landscaping: The plans require $9500. worth of landscaping. No plant list is shown on the plan. Six new trees are shown as well as a low hedge. Six 3" caliper norway maples would cost $2800.00. The Planning Commission should consider giving the applicant some credit for existing trees. No trees may be cut within the Conservation Zone. A snow fence should be installed during construction to restrict any further infringement in this area. Traffic: The lot is not in an overlay zone; However, the appli- cant shall pay a Shelburne Road intersection improvement fee of $750. based on 28 new trip ends generated by this use. The road issue with Mr. Gregory should be resolved. A proposal to resolve this issue was presented by the realtor to Mr. Gregory. An agreement should be drafted. City Attorney was asked to do this but has several other request of higher priority pending and it may be some time before this is done. 2. Curbing at entrance drive shall be continuous across drive and depressed for the width of drive. 3. Utility services to the building shall be underground. 4. A site drainage plan shall be submitted. 7) OFFICE BUILDING, 20 FARRELL STREET 1. There will be a 6 - 8 foot cut at north-east corner for the parking lot. A retaining wall should be considered there. 2. There exists a drainage system across the front of this property. This system drains Farrell Street from the north. The City should have a 15 foot easement for this system so that it can be maintained by the City. 2 PLANNING COMMISSION 25 AUGUST 1987 PAGE 4 2. Since the applicant does not intend to build the road, the plan shows no paved access to the lot. Mr. Burgess seconded. Motion passed unanimously. 3. Continue site plan application of the Davis Company for construction of a 10,000 sq. ft. building for office use, 20 Farrell Street Larry Williams explained this will be a 2-story building with each story being 5,000 sq. ft. There will be 41 parking spaces in an asphalt lot. They agree with -the City Engineer that a retaining will is required in the northeast corner of the lot and will reach an agreement with him as to the com- position of the wall. They will provide a drainage easement across the front of the property. The Fire Chief has re- quested a 30 ft. driveway running to the end of the building. The applicant proposes a 24 ft. drive. They met with the Chief and the Chief agreed to have it 30 ft. not quite to the end of the building. The Chief needs this footage to set up equipment. The applicant disputes this and read a letter from their architect to this affect. Members agreed with the Fire Chief and felt the 30 foot arrangement was manageable. It will require the elimination of 1 parking space, but they will still have enough. The applicant requested credit for existing trees. Ms. Lafleur suggested giving credit for $3500 and requiring an additional $6000. Commission members agreed. Ms. Lafleur noted when the Farrell Street sewer line was put in, developers were to reimburse the City. This should be a condition of this approval. Ms. Hurd moved that the Planning Commission approve the site plan applicationof the Davis Company for construction of a 10,000 sq. ft. office building at 20 Farrell Street as de- picted on a plan entitled "Proposed Office Building _ 20 Farrell Street, South Burlington, Vermont" dated 8/4/87 pre- ared �2y Northern Architects, Inc, with the following stipula- tions: 1. A $9500 landscaing bond shall be posted prior to permit. PUBLIC HEARING: Final plat application of A & G Invest- ments (Milot & Bartlett) for a planned unit development consisting of 98 single family lots, 80 multi -family units in 20 buildings on 40 acres, a 2 acre lot with an existing farmhouse and 68 acres of a City park land, 900 Dorset St. Mr. Llewellyn advised the the City Council required a 20 ft. setback to preserve the treed area. The building setback was changed to 30 ft. from the rear property line; the front set- back was adjusted to 20 ft. This is only on "Street A." The Council also wants the ballfields shown on the plans. This issue is not yet resolved.
