On the 14th of September, 1993 the South Burlington Planning Commission approved the request of 10 Farrell Street Corporation for site plan review under Section 19.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of utilizing 3,350 square feet of vacant space for indoor recreation (gymnastics instruction) in a 26,125 square foot mixed commercial/industrial building. The Planning Commission approved multiple uses of the building on 4/27/93 and outdoor storage on 7/20/93. The proposed indoor recreation use was not one on the list of uses the Planning Commission approved at the 4/27/93 meeting. The applicant must obtain from the Zoning Board of Adjustment a conditional use permit for the proposed indoor recreation use. 2. This property located at 10 Farrell Street lies within the C2 District. It is bounded on the north by undeveloped land approved for an office building separated from this property by Potash Brook, on the east by East Woods, on the south by Swift Street and on the west by Farrell Street. 3. Access/circulation: Access is being proposed via two (2) curb cuts on Farrell Street, a 45 foot wide curb cut to the north and a 52 foot wide curb cut to the south. The curb cuts are existing and no changes proposed. 4. Circulation is adequate. There will be one-way traffic along the south and east sides of the building and two-way traffic along the north side. A "DO NOT ENTER" sign will be placed at the north- east corner of the building to discourage vehicles from going in the wrong direction. 5. Coverage/setbacks: Building/coverage is 26% (maximum allowed is 30%). Overall coverage is 60.4% (maximum allowed is 70%). Front yard coverage is 57.9% (maximum allowed is 30%). This is an existing situation which will not be made worse. Setback requirements are met. 6. Parking: The Planning Commission on 7/20/93 approved a total of 80 parking spaces and 80 parking spaces are being provided. The 1 existing and proposed uses require a total of 61 spaces. 7. Traffic: As part of the 4/27/93 approval 600 daily trip ends and 90 P.M. peak hour trip ends were approved. The existing and proposed uses are expected to generate 571 daily trips and 88 P.M. peak hour trip ends. 8. Sewer: This project requires 225 gpd of sewer allocation in addition to the 1165 gpd currently allocated. This would bring the total sewer allocation to 1390 gpd. The applicant will be required to pay the per gallon fee prior to permit. 9. Landscaping: There is no minimum landscaping requirement based on building costs. The existing landscaping and the landscaping added as part of the multiple use approval is adequate. No additional landscaping recommended. 10. Other: The recently approved outdoor storage area is not being used as approved. The storage trailer is not located within the storage area, it is in the parking area, and the fence has not been installed. Also, the fence around the dumpster area has not been installed. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of 10 Farrell Street Corporation for use of 3,350 square feet within a 26,125 square foot mixed commercial/industrial building for indoor recreation use as depicted on a two (2) page set of plans, page one entitled, "10 Farrell Street, South Burlington, Proposed Revised Parking Plan", prepared by DHD with a stamped "received" date of 7/13/93, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This approval is for the following uses which are currently permitted in the Commercial 2 District: Business, professional and non-profit offices; retail businesses; hotels and motels; standard restaurants, coffee shops; state and municipal facilities; university facilities, excluding buildings for residential use; rental of equipment and miscellaneous items; equipment service and repair shops; sale of building materials; catering and food delivery; sale of automotive parts; and indoor recreation. If the zoning regulations change so that any of the above uses are no longer permitted, then those uses which are no longer permitted shall no longer be approved. K 3. This approval is conditioned on a maximum of 80 parking spaces, 1390 gpd sewer allocation, 600 daily trip ends and 90 p.m. peak hour trip ends. 4. The applicant shall obtain approval from the City Planner prior to the change of any tenant in the building. The City Planner shall approve the proposed new tenant only if the proposed combination of uses fits within the limitations established in stipulation #3 above. 5. Prior to issuance of a zoning/building permit, the applicant shall pay the sewer allocation fee for the additional 225 gpd of approved sewer allocation. 6. The applicant shall obtain a zoning/building permit within six months or this approval is null and void. 7. Any changes to the site plan shall require approval by the South Burlington Planning Commission. Chairman or Clerk South Burlington Planning Commission Date 3
