SITE PLAN APPLICATION #SP-16-63
FINDINGS OF FACT AND DECISION
Ten Farrell Street, LLC, hereinafter referred to as the applicant, is seeking approval to
amend a previously approved plan for a 26,125 sq. ft. mixed use building with an
umbrella approval. The amendment consists of: 1) revise landscaping plan, 2) revise the
northerly curb cut and access drive, 3) increasing the number of parking spaces by six
(6) spaces, and 4) removing existing shed, 10 Farrell Street.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. Ten Farrell Street, LLC is seeking approval to amend a previously approved plan for
a 26,125 sq. ft. mixed use building with an umbrella approval. The amendment
consists of: 1) revise landscaping plan, and 2) revise the northerly curb cut and
access drive, 10 Farrell Street.
2. The owners of record of the subject property is Ten Farrell Street, LLC.
3. The subject property is located in the Swift Street Zoning District.
4. The application was received on September 8, 2016.
5. The plan submitted consists of a two (2) page set of plans, page one (1) is entitled
"Restriping Layout Plan 10 Farrell Street", prepared by SMM Environmental Engineering,
and dated 9/01/16.
DIMENSIONAL REQUIREMENTS
6. Building coverage will remain at 26% (maximum allowed is 40%). Overall coverage
will decrease to 52% (maximum allowed is 70%). Front yard coverage will increase to
27.9% (maximum allowed is 30%).
7. Setback requirements will continue to be met.
SITE PLAN REVIEW STANDARDS
Section 14.06 of the South Burlington Land Development Regulations establishes the
following_ general review standards for all site plan applications:

Only the standards below are affected by this application. All other standards will
continue to be met.
Landscaping
8. The proposal is to move previously approved landscaping, located just north of the
northerly curb cut, off from an existing underground stormwater tank. There will be no
change in the number or size of the originally approved plants, just their location will
change.
9. The landscaping plan does not match the site plan with regard to site features, so it
will have to be revised to match the site plan.
10. The City Arborist in an email dated 9/12/16 to staff indicated that the plans were
acceptable.
PARKING
11. The applicant is increasing the total number of parking spaces to 88 spaces which
will include four (4) handicapped spaces. The site plan does not indicate a bike rack so it
will have to be revised to show at least one (1) bike rack.
OTHER
12. The site plan does not show the snow storage areas so it will have to be revised to
include the snow storage areas.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-16-63 of Ten Farrell Street, LLC, subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval
will remain in effect.
2. This project must be completed as shown on the plan and shall be on file in the
South Burlington Department of Planning and Zoning.
3. The site plan must be revised to show the changes below and will require
approval of the Administrative Officer. Three (3) copies of the approved revised
plan must be submitted to the Administrative Officer prior to permit issuance.
a. The site plan must be revised to show a bike rack.
b. The site plan must be revised to show the snow storage area(s).
c. The landscaping plan must be revised to show all the same features as
shown on the site plan.

4. The applicant must obtain a zoning permit within six (6) months pursuant to
Section 17.04 of the Land Development Regulations or this approval is null and
void.
5. The applicant must obtain a Certificate of Occupancy from the Administrative
Officer upon completion of installing the new landscaping.
6. Prior to issuance of a zoning permit, the applicant must submit to the
Administrative Officer a final set of project plans as approved in digital (PDF)
format.
7. Any change to the site plan will require approval by the South Burlington
Development Review Board or the Administrative Officer.

PLEASE NOTE: Pursuant to 24 VSA §4465, an interested person may appeal this decision
by filing a Notice of Appeal with the secretary of the Development Review Board. This
Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days
of the date of this decision.
