SITE PLAN REVIEW APPLICATION #SP-18-26
FINDINGS OF FACT AND DECISION
John Larkin, Inc., hereinafter referred to as "applicant" is seeking approval to amend a
previously approved plan for a 35,816 sq. ft. building consisting of: 1) 7,504 sq. ft. of medical
office use, 2) 3,491 sq. ft. of personal instruction use, and 4) 10,017 sq. ft. of standard
restaurant use. The amendment consists of: 1) constructing a 153 sq. ft. addition for medical
office use, and 2) minor site modifications, 57 Fayette Road.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking approval to amend a previously approved plan for a 35,816 sq. ft.
building consisting of: 1) 7,504 sq. ft. of medical office use, 2) 3,491 sq. ft. of personal
instruction use, and 4) 10,017 sq. ft. of standard restaurant use. The amendment consists
of: 1) constructing a 153 sq. ft. addition for medical office use, and 2) minor site
modifications, 57 Fayette Road.
2. The owner of record of the subject property is Larkin Milot Partnership, LLP.
3. The subject property is located in the Commercial 1 — Automobile Zoning District.
4. The application was received on June 5, 2018.
5. The plans submitted consists of a 10 page set of plans, page one (1) is labeled "Overall Site
and P.U.D. Plan" dated 5/7/18, last revised on 5/29/18, and prepared by Krebs & Lansing
Consulting Engineers, Inc.
DIMENSIONAL REQUIREMENTS
6. No changes to coverages or setbacks proposed.
SITE PLAN REVIEW STANDARDS
Only the standards below are affected by this application. All other standards will continue to be
met.
Bicycle Parking
7. The plan complies with Section 13.14 of the LDRs to include the new type and location for

bicycle racks, to accommodate six (6) short-term bicycle parking spaces (75% of
requirement).
Landscaping
8. Minor landscaping changes are proposed. The plans were reviewed by the City Arborist and
had the following comments:
The trees which are to be designated for protection need to be delineated on the plans.
The proposed methods for tree protection and root pruning should be detailed on the plans.
Stormwater
9. The Stormwater Division indicated in an email dated 6/7/18 that they had reviewed the
plans and had no comments.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-18-26 of John Larkin, Inc., subject to the following conditions:
1. All previous approvals and stipulations which are not changed by this decision, will
remain in full effect.
2. This project must be completed as shown on the plans submitted by the applicant, and
on file in the South Burlington Department of Planning and Zoning.
3. The plans must be revised to show the changes below and will require approval of the
Administrative Officer. Three (3) copies of the approved revised plans must be submitted
to the Administrative Officer prior to permit issuance.
a. The site plan must be revised to delineate the trees which are to be designated
for protection.
b. The site plan must be revised to show the proposed methods for tree protection
and root pruning.
4. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility
lines, services, and service modifications must be underground.
5. The applicant must obtain a zoning permit within six (6) months to construct the site
modifications pursuant to Section 17.04 of the Land Development Regulations or this
approval is null and void.
6. All exterior lighting must be installed or shielded in such a manner as to conceal light
sources and reflector surfaces from view beyond the perimeter of the area to be
illuminated.

7. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior
to use or occupancy of the addition.
8. Any change to the site plan will require approval by the South Burlington Development
Review Board or Administrative Officer.

Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of
this decision.
