FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
RE: Findings of Fact, site plan application #SP-02-19 of Rene J. Berard to amend
a previously approved site plan to 1) construct a 3,360 SF addition with loading
dock on the west fagade of the building; 2) add one parking space; and 3) utilize
one existing parking space for an 8' by 20' box container, 63 Ethan Allen Drive,
South Burlington.
On the 111h day of April, the Director of Planning & Zoning approved the site
plan application of Rene J. Berard under Section 26.10(b) of the South Burlington
Zoning Regulations, based on the following findings:
1. This project consists of amending a previously approved site plan to add a
3,360 SF addition at the northeast corner of the existing building at 90
Ethan Allen Drive, adding one parking space at the northeast corner of the
parking lot, and the use of one existing parking space for storage of an 8'
by 20' box container. The addition includes a 50' by 60' extension of the
building and a 360 SF loading dock, with a fence extending from the
loading dock to screen a dumpster storage area.
2. The owner of record is Rene J. Berard.
3. This property is located within the IC -Mixed Industrial Commercial
District.
4. Access and circulation: Access and circulation will not be substantially
affected by the proposed addition. The proposed site plan amendment
would relocate the bike rack to the western end of the parking lot.
5. Parking: The proposed site plan amendment would add one new parking
space at the northeast corner of the parking lot, and utilize one of the 28
spaces existing on site for storage of a box container. A total of 25 spaces
are required (1 for each of 8 office employees,1 for the non -office
employee, and 16 for company vehicles operating off site) and 28,
including one handicapped space, are provided. Parking requirements are
therefore met.

6. Coverage: The proposed addition will add 3,360 SF of building cover to
the site. This brings the total building coverage to 20.6% (30% allowed)
and total site coverage to 54.2% (70% allowed). The front yard coverage
will be increased from 26.9% to 29.7% (30% allowed) with the addition of
one parking space that is partially within the front yard setback from
Ethan Allen Drive. Coverage requirements are therefore met.
7. Setbacks: The proposed addition will meet all setback requirements. At
the present time, the Administrative Officer has noted that there is a
concrete pad with HVAC equipment on it at the rear of the building, with
a metal hood over the HVAC equipment that is attached to the roof. This
is a violation of the required 15 foot setback which, per Section 28.149,
must not include any structures.
8. Landscaping: The application for the site plan states that new landscaping
in the amount of $6,000 will be provided, but the specific landscaping
improvements proposed are not shown on the plans.
9. Lighting: The applicant has not indicated any exterior lighting for the
proposed building on the plans. On June 8,1998 the Director of Planning
& Zoning approved SBF Powerflood Floodlights,100 watt metal halide, for
use on the exterior of the building.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Director of Planning
and Zoning approves site plan application #SP-02-19 of Rene Berard to 1)
construct a 3,360 SF addition with loading dock on the west facade of the
building; 2) add one parking space; and 3) utilize one existing parking space for
an 8' by 20' box container, 63 Ethan Allen Drive, as depicted on a plan entitled
"Contractor's Yard Building, Berard Construction Co., Inc., 63 Ethan Allen Drive,"
prepared by JG Architects, Inc., with a date received notation of 4/2/02, with the
following stipulations:
1. All previous approvals and stipulations that are not superseded by this
approval shall remain in effect.
2. Prior to issuance of a Certificate of Occupancy, the concrete pad, HVAC
equipment, and metal overhang attached to the rear wall of the building
shall be completely removed and the area re -planted. No Certificate of
Occupancy shall be issued until this violation is completely remediated.

3. Any exterior light fixtures installed on the addition shall be the same
fixtures as previously approved for and utilized on the existing building.
Any other fixtures to be installed shall require prior approval of the
Director of Planning & Zoning.
4. The applicant shall obtain a zoning permit within six (6) months of the
date of this decision, pursuant to Section 27.302 of the Zoning Regulations,
or this approval is null and void.
5. This approval is conditioned on the installation of $6,000 worth of new
landscaping, in accordance with Section 26.105 of the Zoning Regulations.
Prior to obtaining a zoning permit, the applicant shall submit five (5)
copies of a revised site plan indicating the locations of the new
landscaping to be installed and the species used. A landscape bond in the
amount of $6,000 valid for three (3) years shall be provided.
6. The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer.
7. Any change to the approved site plan shall require approval of the South
Burlington Development Review Board.

within 30 days of the date this decision is issued. The fee is $150.00. If you fail to
appeal this decision, your right to challenge this decision at some future time may
be lost because you waited too long. You will be bound by the decision, pursuant
to 24 V.S.A. § 4472(d) (exclusivity of remedy; finality).
