HomeMy WebLinkAboutSP-03-39 - Decision - 0063 Ethan Allen Drive#SP-03-39 FINDINGS OF FACT & DECISION State of Vermont County of Chittenden City of South Burlington RE: Findings of Fact site plan application # SP-03-39 of Rene J. Berard to amend a previously approved site plan for a 6,000 sq ft warehouse building. The amendment consists of reducing the amount of pavement on the property at 63 Ethan Allen Drive. On the 91" day of September, the Administrative Officer approved the request of Rene J. Berard for site plan review under Section 14.09 of the South Burlington Land Development Regulations based on the following findings: 1. The project consists of amending a previously approved site plan for a 6,000 sq ft warehouse building. The amendment consists of reducing the amount of pavement area on the property 2. This property located at 63 Ethan Allen Drive is located within the I-C District, and the Floodplain Overlay District. It is bounded on the north by Ethan Allen Drive, on the east by Commerce Avenue, on the south by an auto body shop, and on the west by undeveloped land. 3. The owner of record of this property is Rene J. Berard. 4. The only issues affected by the application are overall and front yard coverages. 5. Overall coverage is 44 % (maximum allowed is 70%). Front yard coverage along Ethan Allen Drive is 30% (maximum allowed is 30%). 6. Snow Storage: A snow storage area is designated on the plan. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Administrative Officer approves site plan application #SP-03-39 of Rene J. Berard to amend a previously approved site plan for a 6,000 sq ft warehouse building. The amendment consists of reducing the amount of pavement area on the property at 63 Ethan Allen Drive, as depicted on a site plan entitled "Rene J. Berard Lot 37 Topographic Site Plan", prepared by Lamoureaux & Dickinson Consulting Engineers, Inc, dated 8/13/03, last revised on 8/21/03, with the following stipulations: 1. All previous approvals and stipulations that are not superseded by this approval shall remain in effect 2. The applicant shall obtain a zoning permit within six (6) months of the date of this decision and prior to reducing the pavement, pursuant to Section 17.03 of the Land Development Regulations. 3. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer upon completion of the pavement removal project. 4. Any change to the approved site plan shall require approval of the South Burlip,§ton Development Review Board. Date ve Officer Please note: You have the right to appeal this decision to the Vermont Environmental Court, pursuant to 24 VSA 4471 and VRCP 76 in writing, within 30 days of the date this decision is issued. The fee is $150.00. If you fail to appeal this decision, your right to challenge this decision at some future time may be lost because you waited too long. You will be bound by the decision, pursuant to 24 VSA 4472 (d) (exclusivity of remedy; finality).
