Re: Findings of Fact, application of Randy & Rene Berard to amend
a previously approved plan for a 3200 square foot warehouse. The
amendment consists of: 1) changing the use of the building to light
manufacturing, and 2) enclosing a 320 square foot loading dock, 60
Ethan Allen Drive.
On the 25th day of November, 1997, the South Burlington Planning
Commission approved the request of Randy & Rene Berard for site
plan review under Section 26.10 of the South Burlington Zoning
Regulations based on the following findings:
1. This project consists of amending a plan previously approved on
11/25/85 for a 3200 square foot warehouse. The amendment consists
of: 1) changing the use of the building to light manufacturing, and
2) enclosing a 320 square foot loading dock. The change is use and
loading dock enclosure have already been completed. This property
is also developed with a 40' x 60' detached accessory building.
2. This property located at 60 Ethan Allen Drive lies within IC
District the C.O. District and the Floodplain Overlay District. It
is bounded on the north by an industrial building, on the east by
Lime Rock Road, on the south by Ethan Allen Drive and on the west
by an undeveloped lot currently proposed for airport transient/long
term parking.
3. Access/circulation: Access is provided by a 30 foot curb cut on
Ethan Allen Drive. No changes proposed.
4. Coverage/setbacks: Building coverage is 11.5% (maximum allowed
is 30%). Overall coverage is 32.7% (maximum allowed is 70%). Front
yard coverage along Lime Rock Road is 25.8% and along Ethan Allen
Drive is 23.9% (maximum allowed is 30%).
Setback requirements are met.
5. Parking: A total of five (5) spaces are required and nine (9)
spaces are provided including one (1) handicapped space and a bike
rack. The parking lot should be striped.
6. Landscaping: The minimum landscaping requirement, based on
building costs, is $85 which is not being met. Applicant sought a
credit for the $85 shortfall.
7. Sewer: No additional allocation requested.
8. Traffic: ITE estimates that the current facility generales 4.1

vehicle trip ends (vte's) during the P.M. peak hour and the
proposed use to generate 4.4 vte's for a 0.3 vte increase. The
applicant was made aware that the road impact fe is $0.
9. Lighting: This information was requested but not submitted.
10. Dumpster: The plan should show a screened dumpster storage
area, if one is to be used.
11. C.O. District/Floodplain: The plan shows the location of the
C.O. District and the 100 year floodplain boundary. No additional
encroachments proposed.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the site plan application of Randy and Rene
Berard to amend a previously approved plan for a 3200 square foot
warehouse. The amendment consists of: 1) changing the use of the
building to light manufacturing, and 2 ) enclosing a 320 square foot
loading dock, 60 Ethan Allen Drive, as depicted on a plan entitled,
"N.E.T.C. Livestock Fence Company Lot 2 - Ethan Allen Farm South
Burlington Vermont," prepared by FitzPatrick-Llewellyn, Inc. dated
October, 1989, last revised on 11/15/97, with the following
stipulations:
1) All previous approvals and stipulations which are not superseded
by this approval shall remain in effect.
2) For the purpose of calculating road impact fees under the South
Burlington Impact Fee Ordinance, the Planning Commission estimates
that the expansion will generate 0.3 additional vehicle trip ends
during the P.M. peak hour.
3) Any new exterior lighting or changes to existing exterior
lighting shall consist of downcasting and shielded fixtures. Any
change to existing lights shall require approval of the City
Planner prior to installation.
4) The Planning Commission grants a landscape credit of $85 for
existing landscaping on the site.
5) The parking lot shall be striped as shown on the approved site
plan prior to issuance of a Certificate of Occupancy/Compliance.
6) The applicant shall obtain a zoning permit within six (6) months
pursuant to Section 27.302 of the zoning regulations or this
approval is null and void.
7) The applicant shall obtain a Certificate of Occupancy/Compliance
from the Administrative Officer within 30 days for the use of the
enclosed loading dock and newly converted space.

8) Any change to the site plan shall require approval by the South
Burlington Planning Commission.
9) If the applicant installs a dumpster, a revised plan showing the
dumpster shall be submitted to the City Planner for approval. The
dumpster shall be adequately screened.
