SITE PLAN APPLICATION #SP-17-58
FINDINGS OF FACT AND DECISION
J & E Enterprises, LLC, hereinafter referred to as the applicant, is seeking after -the -fact
approval to amend a previously approved plan for 5,920 sq. ft. of auto sales, service and
repair use on two (2) buildings. The amendment consists of replacing trees removed
without approval and trees that have died, 60 Ethan Drive.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking after -the -fact approval to amend a previously approved plan
for 5,920 sq. ft. of auto sales, service and repair use on two (2) buildings. The
amendment consists of replacing trees removed without approval and trees that
have died, 60 Ethan Drive.
2. The owner of record of the subject property is J & E Enterprises, LLC.
3. The subject property is located in the I-C Zoning District.
4. The application was received on August 3, 2017,
5. The plan submitted is titled, "Proposed Site Alterations to: Twisted Wrench Ethan
Allen Drive S. Burlington, VT", prepared by Trudell Consulting Engineers, dated June
30, 2017, and last revised on 7/17/17.
DIMENSIONAL REQUIREMENTS
6. No changes in coverage is proposed.
7. Setback requirements are being met.
SITE PLAN REVIEW STANDARDS
Only the standards below are affected by this application. All other standards will
continue to be met.
Vehicle and Bicycle Parking
8. No changes to vehicular parking.
9. The plan does not comply with Section 13.14 of the LDRs to include the new type
and location for bicycle racks, to accommodate the minimum requirement of two (2)

short-term bicycle parking spaces. The plan will have to be revised to comply with
this requirement.
Landscaping
10. The applicant removed approximately five (5) large white pine trees and allowed
three (3) Maple trees along Ethan Allen Drive to die without replacement. The
applicant is now planting seven (7) 7'- 8' Arborvitae trees to replace the white pines
and three (3) 2.5" — 3" caliper Red Maple trees to replace the trees that died along
Ethan Allen Drive. The new plantings have a value of $4,000. The City Arborist on
8/09/17 indicated in an email that he has no issues with the new plantings.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-17-58 of J & E Enterprises, LLC, subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval
will remain in effect.
2. This project must be completed as shown on the plan and shall be on file in the
South Burlington Department of Planning and Zoning.
3. The plans must be revised to show the changes below and will require approval of
the Administrative Officer. Three (3) copies of the approved revised plans must be
submitted to the Administrative Officer prior to permit issuance.
a. The site plan must be revised to comply with Section 13.14 of the LDRs to
include the new type and location for bicycle racks, to accommodate the
minimum requirement of two (2) short-term bicycle parking spaces.
4. Prior to permit issuance, the applicant must post a $4,000 landscaping bond. This
bond must remain in full effect for three (3) years to assure that the landscaping has
taken root and has a good chance of survival.
5. Prior to issuance of a zoning permit for the project, the applicant must submit to the
Administrative Officer a final set of project plans as approved in digital (PDF) format.
6. The applicant must obtain a zoning permit from within six (6) months pursuant to
Section 17.04 of the Land Development Regulations or this approval is null and void.
7. All exterior lighting must be installed or shielded in such a manner as to conceal light
sources and reflector surfaces from view beyond the perimeter of the area to be
illuminated.
8. The applicant must obtain a Certificate of Occupancy from the Administrative Officer
upon completion of the installation of the new plantings.

9. Any change to the site plan will require approval by the South Burlington
Development Review Board or the Administrative Officer.

PLEASE NOTE: Pursuant to 24 VSA §4465, an interested person may appeal this
decision by filing a Notice of Appeal with the secretary of the Development Review
Board. This Notice of Appeal must be accompanied with a $233 filing fee and be filed
within 15 days of the date of this decision.
