Believe me, I have been even more confused than you! Since the last meeting, I have exhausted countless hours gathering information to address the Zoning Board's concerns. Although it took some serious searching on my part and getting the involvement of the park developer, John Belter, to address the issues at hand, I believe that I have compiled the most up to date information available regarding the Ethan Allen Industrial Park. John was a tremendous help in clearing up issues that were both confusing to me and to the Zoning Board. As it turns out, the park was developed in four stages. The first two stages (Berard's 8 lots, tax map # 13, 14, 15, 16, 17, 18, 2, 1 1) and Belter's Phase I (lots 1-8) did not fall under Act 250; therefore, very little information exists on these first two phases. The information I gave you at the first meeting was taken from the Land Use Permits on record in Essex Junction, Vermont. Aside from the Land Use Permits, any other information regarding Phases 2 and 3 of the Ethan Allen Industrial Park found at the environmental offices in Essex are incomplete and extremely vague at best. The only records that come close to being accurate are the records that I obtained from John Belter. This information clearly explains allocations and tripins and developed lots in Phases 2 and 3 of the park. As you can see, our requests are well within the allotments for the park. I also met with Arthur Hogan of the Chittenden County Regional Planning Commission at my request that he review my project. He retrieved the latest traffic study done near that intersection. He then looked at my proposal and informed me that our project would not have a significant impact on that intersection. He also classified our project as a controlled warehouse situation. With the exception of 38 parking spaces, he agreed that the remaining spaces, to be controlled by our employees, are therefore not considered parking spaces. I then took this information to the Department of Environmental Conservation in Essex Junction. Faith took this information to the Commission, and they are also treating our application as a warehouse and storage facility with 38 parking spaces and 95 tripins. I have been notified that I should have my permit in three weeks. Arthur Hogan said he would be happy to set up a counter in the park; however, he wants to wait until spring as snowplows may damage the counter. I will pursue this in April, at your request. In closing, I would again like to apologize to the Board for the misinformation prior to tonight. I was misinformed for various reasons as were the people I hired to take care of this matter. With the help of John Belter and Art Hogan as well as my own research, I am confident that you have the most complete information on this park that is presently available. The 21 lot subdivision is approved for the following maximum cumulative impacts which may not be exceeded without the prior written approval of the District Environmental Commission: 315 parking spaces; 9450 gallons per day of wastewater and water; 1446 average daily vehicle trips; 149 average p.m. peak hour vehicle trips; and 1575 kVa of electricity. 6. Prior to the commencement of any construction on the 21 lots the Permittee, and any assigns or successors in interest, including any purchaser or tenant, shall file an amendment application as co -applicants which specifically addresses criteria l(Air), l(B), 1 (C) , 2, 4, 5, 7 (fire services) , 8, 9(F), 9 (J) and 9 (K) . 7. This permit hereby incorporates all of the conditions of the Subdivision Permit EC-4-1183 issued on December 4, 1987 by the Regional Engineer, Division of Protection, Department of Environmental Conservation in compliance with the Vermont State Environmental Protection Rules. 8. During construction of the roads and utilities and on the 21 lots dust shall be controlled as needed through applications of water until all disturbed areas are fully stabilized. 9. Prior to commencement of construction the Permittee shall file a Discharge Permit from the Agency of Natural Resources. The Permittee, and all assigns and successors interest shall conform to all of the terms and conditions of this discharge permit. 10. All stumps and construction debris associated with the construction of the roads and utilities and the development of the 21 lots shall be disposed of at the South Burlington landfill. 11. The Permittee, and any assigns and successors in interest including any purchaser or tenant, shall install and maintain water conserving plumbing fixtures in any building constructed on the 21 lots including but not limited to low -flush toilets, low - flow showerheads, and aerator -type or flow -restricted faucets. All deeds for these lots shall require the installation and maintenance of the same. GRD, Inc. October 10, 1997 a) The proposed use will not adversely impact the capacity of existing or planned community facilities. b) The proposed use will be located in the IC District and will be in keeping with the commercial character of the existing area. c) At planned maximum capacity, we expect traffic to and from our facility to be approximately 38 cars per day. Total trip -ins at maximum capacity is expected at 76 phis 19 for the shuttle, bringing the total trip -ins to 85 per day. An estimated 70% of this traffic will be vehicles already using Airport Parkway and Lime Kiln Road. These estimates are based on a storage capacity of 300 vehicles. Our facility will actually help to reduce traffic congestion in the residential areas of Airport Drive and White Street by diverting cars away from the Airport and to the IC District. Our customers will store their vehicles at our facility and use our shuttle van to get to and from the Airport (ie., van pooling). We will encourage our customers to take Exit 15 off Interstate 89 onto Route 15 and Lime Kiln Road to access our facility. The proposed use is far under the traffic flow already approved for the Industrial Park and surrounding roads. Peak traffic hours will be 5:00 a.m. to 7:30 a.m. (incoming), and 7:00 p.m to 10:30 p.m (outgoing). d) We plan to pursue the use of an electric van to use as our primary shuttle vehicle. We will need to obtain government support for this endeavor. e) No buildings are proposed at this lot. Use will be vehicle storage only. The Commission asked me to send you a memo clarifying their review procedure. In their review, they applied only the site plan criteria, and specifically, did not consider potential impact of the project on the safety of the Airport Parkway/Ethan Allen Drive intersection. The Commission's approval should not be construed as either support or non-support of the project as it relates to off -site traffic impacts, or any other conditional use criteria. There is sufficient area and natural drainage to meet our needs at the present time. This lot is a storage lot only and will not be open to the public. Only employees of ALPF will have access to the lot. All business transactions will take place at our Commerce Avenue location. g) We still plan to pursue the use of an electric van to use as our primary shuttle vehicle. Aesthetics of Vehicle Storage: ALPF proposes storing up to 175 vehicles on lots 65, 60 & 55 on Ethan Allen Drive. The Industrial Park is already approved for outside vehicle storage. The purpose of forming IC Districts is to centralize commercial applications, thus moving them away from residential areas. We feel our proposal addresses this. The properties in question are, for the most part, tucked away from the view of travelers on Lime Kiln Road and Airport Parkway as well as residences, unlike that of the airport parking on Airport Drive. We feel this proposal will have a positive impact on the aesthetics of South Burlington neighborhoods by storing vehicles in an Industrial Park which is zoned for such a use. The parking area as planned is a grassed are, non treated ground surface, the oil drippings from long term stored cars are dispersed by sheet drainage, beyond the stored area, across the undisturbed grass area and are obsorbed into the soil and will eventually be broken down by sunlight. This is presently State of Vermont policy for parking lots or stored car areas. 02. Belter Jr., requesting that all applications for projects in the Ethan Allen Farms Industrial Park (Land Use Permit #4C0643 and amendments) be required to include Mr. Belter as a co -applicant due to his status as the original developer of the industrial park and his subsequent interest in maintaining control over the allocations of parking, vehicle trips and water and wastewater flow for the park. Environmental Board Rule 10(A) states: ... The application shall list the name or names of all persons who have a substantial property interest, such as through title, lease, purchase or lease option, right-of-way or easement, in the tract or tracts of involved land by reason of ownership or control and shall describe the extent of their interests. The district commission or board may, upon its own motion or upon the motion of a party, find that the property interest of any such person is of such significance that the application cannot be accepted or the review cannot be accepted or the review cannot be completed without their participation as co - applicants. The District Commission will deliberate on whether Mr. Belter should be included as a co - applicant in this application and in all other applications for the Ethan Allen Farms Industrial Park. If the Applicant or any other party has concerns about including Mr. Belter as a co -applicant, please submit your concerns in writing by December 1, 1997. I am proposing to process this application under our "Minor" application procedures pursuant to Environmental Board Rule 51.
