FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Findings of Fact, preliminary plat application of Robert Shand to subdivide a 4.58 acre lot into
two lots at 5 Ethan Allen Drive.
On the 15th of February, 2000, the South Burlington Development Review Board approved the
preliminary plat application of Robert Shand under Section 203 of the South Burlington Subdivision
Regulations based on the following findings:
1. The proposed subdivision will create two lots: a 2.22-acre lot (#1) and a 2.36-acre lot (#2). Lot One
is developed with a 12,050 square foot light manufacturing/warehouse building.
2. The owner of record of this particular property is Robert Shand.
3. The property at 5 Ethan Allen Drive is within the IC District. It is bounded on the north and west by
Shamrock Road. Ethan Allen Drive borders the eastern edge of the property. The lands of John Belter
bound the property on the south.
4. Sketch Plan review for the project was on September 21, 1999.
5. Access/Circulation: There are currently three points of access. An existing 18' curb cut on the eastern
portion of Lot One currently provides access from Ethan Allen Drive to the existing building on that lot.
A second point of access is located east along Ethan Allen Drive. This 30' curb cut serves Lot One. The
third point of access is along the southeastern edge of Lot One. This point of access was previously an
unapproved curb cut, but will now be realigned resulting in a 20' curb cut slightly north of the existing
access. This realignment will provide access to Lot Two from Ethan Allen Drive along the southeastern
edge of Lot One.
6. Lot Size/Frontage: Lot One and Lot Two both exceed the 40,000 square foot minimum lot size
requirements. Both lots also meet the minimum 120 feet frontage requirement.
7. Coverage/Setbacks: Lot One's proposed building coverage is 12.5% (maximum allowed is 30%).
Overall coverage is 24.6% (maximum allowed is 70%). Front yard coverage is 19.5% (maximum allowed
is 30%). Lot Two's proposed building coverage is 9.7% (maximum allowed is 30%). Overall coverage
is 17.9% (maximum allowed is 70%). All proposed setbacks are met.
8. C.O. District: An ecologist was retained to delineate the boundaries of a wetland along the
southern portion of Lots One and Two. The preliminary plat illustrates the wetland area and a 50'
wetland buffer. It is required that the wetland buffer be delineated across the entire property as per
the requirements of the Conservation and Open Space District and any possible encroachment be
noted. If encroachment is proposed, the applicant will be required to address Section 3.503 of the
Zoning Ordinances.
9. Floodplain Overlay District: The preliminary plat illustrates that the southern portion of Lots One
and Two are within the 100-year floodplain overlay district. There is currently no construction
proposed within the floodplain.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board approves the
preliminary plat application of Robert Shand to subdivide a 4.58 acre lot into two (2) lots of 2.22
acres and 2.36 acres as depicted on a plan entitled "Preliminary Plan for Two Lot Subdivision and
Site Plan Vermont Custom Sheet Metal," prepared by Vermont Land Surveyors, dated 5/25/99, last
revised on 1/4/00, with the following stipulations:
1. All previous approvals and stipulations that are not superseded by this approval shall remain in
effect.
2. The plat plan shall be revised prior to final plat submittal as follows:
a) The wetland and associated buffer shall be delineated across the entire property as per the
requirements of the Conservation and Open Space District. If encroachment into the
wetland buffer is proposed, the applicant must address Section 3.503 of the Zoning
Regulations.
b) The final plat shall show aclean out where the two proposed sewer services connect.
3. The applicant shall submit a final plat application within twelve (12) months pursuant to Section
204.1 of the zoning regulations or this approval is null and void.
