HomeMy WebLinkAboutSD-00-16 - Decision - 0009 0005 Ethan Allen Drive#SD-00-16 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, final plat application of Robert Shand to subdivide a 4.58 acre lot into two lots at 5 Ethan Allen Drive. On the 18th of April, 2000, the South Burlington Development Review Board approved the final plat application of Robert Shand under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1. The proposed subdivision will create two lots: a 2.22-acre lot (#1) and a 2.36-acre lot (#2). Lot One is developed with a 12,050 square foot light manufacturing/warehouse building. The preliminary plat was approved on February 15, 2000. 2. The owner of record of this particular property is Robert Shand. 3. The property at 5 Ethan Allen Drive is within the IC District. It is bounded on the north and west by Shamrock Road. Ethan Allen Drive borders the eastern edge of the property. The lands of John Belter bound the property on the south. 4. Access/Circulation: There are currently three points of access. An existing 18' curb cut on the eastern portion of Lot One currently provides access from Ethan Allen Drive to the existing building on that lot. A second point of access is located east along Ethan Allen Drive. This 30' curb cut serves Lot One. The third point of access is along the southeastern edge of Lot One. This point of access was previously an unapproved curb cut, but will be realigned resulting in a 20' curb cut slightly north of the existing access. This realignment will provide access to Lot Two from Ethan Allen Drive along the southeastern edge of Lot One. 5. Lot Size/FrontaM Lot One and Lot Two both exceed the 40,000 square foot minimum lot size requirements. Both lots also meet the minimum 120 feet frontage requirement. 6. Coverage/Setbacks: Lot One's proposed building coverage is 12.5% (maximum allowed is 301/6). Overall coverage is 24.6% (maximum allowed is 701/6). Front yard coverage is 19.5% (maximum allowed is 30%). Lot Two's proposed building coverage is 9.7% (maximum allowed is 30%). Overall coverage is 17.9% (maximum allowed is 70%). All proposed setbacks are met. 7. C.O. District: An ecologist was retained to delineate the boundaries of a wetland along the southern portion of Lots One and Two. The plat illustrates the wetland area and a 50' wetland buffer. The wetland buffer has been delineated across the entire property as per the requirements of the Conservation and Open Space. No encroachment is proposed. 8. Floodplain Overlay District: The final plat illustrates that the southern portion of Lots One and Two are within the 100-year floodplain overlay district. No construction proposed within the floodplain. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves the final plat application of Robert Shand to subdivide a 4.58 acre lot into two (2) lots of 2.22 acres and 2.36 acres, 5 Ethan Allen Drive, as depicted on a plat entitled, `Final Plat for Two Lot Subdivision Vermont Custom Sheet Metal owned by Robert Shand #5 & #9 Ethan Allen Drive So. Burlington, Vermont," prepared by Vermont Land Surveyors, dated 5/25/99, last revised on 3/1/00, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) The plat plans shall be revised to show the changes below and shall require approval of the Director of Planning & Zoning (hereinafter Director). Four (4) copies of the approved revised plat plan shall be submitted to the Director prior to recording. a) The site plan shall be revised to use a variety of line symbols to depict property lines, right-of- way lines, easement lines, etc. b) The final plat plan shall be revised to provide metes and bounds information for the proposed r.o.w. 3) Any change to the plat plan shall require approval by the South Burlington Development Review Board. 4) The final plat plan shall be recorded in the land records within 90 days or this approval is null and void. The plan shall be signed by the Board Chair or Clerk prior to recording. Prior to recording the final plat plan, the applicant shall submit a copy of the survey plat in digital format.
