FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Findings of Fact, site plan application of Robert Shand to construct a 10,000 square foot warehouse
of which 200 square feet will be dedicated to office space.
On the 18th of April, 2000, the South Burlington Development Review Board approved the site plan
under Section 26.10 of the South Burlington Zoning Regulations based on the following findings:
1. This project consists of to constructing a 10,000 square foot warehouse of which 200 square feet will
be dedicated to office space
2. The owner of record of this particular property is Robert Shand.
3. The property at 5 Ethan Allen Drive is within the IC District. It is bounded on the north and west by
Shamrock Road. Ethan Allen Drive borders the eastern edge of the property. The lands of John Belter
bound the property on the south.
4. Traffic: The traffic impact fee, as set by the 1987 subdivision and creation of this lot, will be
$880.
5. Sewer: The applicant has requested a sewer allocation of 350 gallons per day. The applicant
will be assessed a per gallon fee.
6. Ldsopping_ The minimum landscaping requirement, based on the cost of construction, is $6,000. A
total of $3,218 worth of landscaping has been proposed. This presents a $2,781.88 shortfall. The
applicant has submitted a contractor's bid for the landscaping that meets the minimum landscaping
requirement.
7. Lighting: Cut sheets for the proposed lighting have been submitted. All lights are downwardly
shielded and approved by the Director of Planning and Zoning.
8. Parking: A total of six parking spaces are required and eleven are being provided, including one
handicapped space. A bike rack is also being provided.
9. Dumpsters: The dumpster storage area is screened.
10. Other:
■ The plans should illustrate the various property lines and rights -of -way with different line
hatching.
■ The metes and bounds for the 50 ft. r.o.w. should be provided.
■ Finished contour lines should be provided to ensure that there will be not filling in the C.O.
District.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board approves the site
plan application #SP-00-08 of Robert Shand to construct a 10,000 square foot warehouse, 5 Ethan Allen
Drive, as depicted on a plan entitled, "Site Plan for Lot #2 Vermont Custom Sheet Metal owned by Robert
Shand #5 & #9 Ethan Allen Drive So. Burlington, Vermont," prepared by Vermont Land Surveyors, dated
5/25/99, last revised on 3/1/00, with the following stipulations:
1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect.
2) The site plan shall be revised to show the changes below and shall require approval of the Director of
Planning & Zoning (hereinafter Director). Three (3) copies of the approved revised plan shall be submitted
to the Director prior to permit issuance.
a) The site plan shall be revised to show additional landscaping to meet the minimum landscaping
requirement.
b) The site plan shall be revised to show the finished contour lines to ensure that there will be no cut
or fill in the C.O. District.
3) Prior to permit issuance, the applicant shall pay the road impact fee of $880.
4) All exterior lighting shall consist of downcasting fixtures. Any change to approved lights shall require
approval of the Director prior to installation.
5) Prior to issuance of zoning permit, the applicant shall post a $6000 landscape bond. The bond shall
remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of
surviving.
6) The Development Review Board approves a sewer allocation of 350 gpd. The applicant will be
required to pay the per gallon fee prior to permit issuance.

7) The abandoned curb cut shall be replaced with a new concrete barrier curb. The new curb cut shall be
a depressed concrete curb.
8) There shall be an accessible manhole where the two sewer lines connect.
9) The building shall sprinkler the building or install an alternative fire protection method approved by the
Fire Chief.
10) The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the
zoning regulations or this approval is null and void.
11) The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior
to use of the building.
12) Any change to the site plan shall require approval by the South Burlington Development Review
Board.
