FINDINGS OF FACT AND DECISION
Site plan review application #SP-18-17 of Allen Brook Development, Inc. for after -the -fact
approval to amend a previously approved plan for a 39,535 sq. ft. building consisting of: 1)
35,535 sq. ft. of warehouse & distribution use., and 2) 6,000 sq. ft. of retail warehouse outlet
use. The amendment consists of: 1) adding a section of sidewalk, 2) replacing a regular parking
space with a handicapped space, 3) relocating two (2) HVAC units, and 4) adding a dumpster
enclosure, 6 Ethan Allen Drive.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant, Allen Brook Development, Inc., seeks after -the -fact approval to amend a
previously approved plan for a 39,535 sq. ft. building consisting of: 1) 35,535 sq. ft. of
warehouse & distribution use, and 2) 6,000 sq. ft. of retail warehouse outlet use. The
amendment consists of: 1) adding a section of sidewalk, 2) replacing a regular parking
space with a handicapped space, 3) relocating two (2) HVAC units, and 4) adding a
dumpster enclosure, 6 Ethan Allen Drive.
2. The owner of record of the subject property is Allen Brook Development, Inc.
3. The subject property is located in the Mixed Industrial - Commercial Zoning District.
4. The application was received on April 17, 2018.
5. The plan submitted is labeled "Lots 19, 20, & 21 Ethan Allen Commercial Park South
Burlington Vermont," dated 5/5/17, last revised on 4/6/18, and prepared by O'Leary — Burke
Civil Associates, PLC.
DIMENSIONAL REQUIREMENTS
6. No changes to coverages or setbacks proposed. .
SITE PLAN REVIEW STANDARDS
Only the standards below are affected by this application. All other standards will continue to be
met.
Bicycle Parking

8. The plan complies with Section 13.14 of the LDRs to include the new type and location for
bicycle racks, to accommodate two (2) short-term bicycle parking spaces (100% of
requirement).
Vehicular Parking;
9. The existing uses require a total of 36 spaces and 40 spaces are being provided including
three (3) handicapped spaces.
Dumpster;
10. A new dumpster enclosure is proposed within the fenced outdoor storage area.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-18-17 of Allen Brook Development, Inc., subject to the following conditions:
1. All previous approvals and stipulations which are not changed by this decision, will
remain in full effect.
2. This project must be completed as shown on the plans submitted by the applicant, and
on file in the South Burlington Department of Planning and Zoning.
3. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility
lines, services, and service modifications must be underground.
4. The applicant will be responsible to regularly maintain all stormwater treatment and
conveyance structures on -site.
5. The applicant must obtain a zoning permit within six (6) months to construct the site
modifications pursuant to Section 17.04 of the Land Development Regulations or this
approval is null and void.
6. All exterior lighting must be installed or shielded in such a manner as to conceal light
sources and reflector surfaces from view beyond the perimeter of the area to be
illuminated.
7. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior
to use or occupancy of the structure.
8. Any change to the site plan will require approval by the South Burlington Development
Review Board or Administrative Officer.
