HomeMy WebLinkAboutMinutes - City Council - 08/09/2019 - Special City CouncilSPECIAL CITY COUNCIL 9 AUGUST 2019 The South Burlington City Council held a special meeting on Friday, 9 August 2019, at 4:30 p.m., in the Conference Room, City Hall, 575 Dorset Street. Members Present: H. Riehle, Chair; M. Emery, T. Barritt, D. Kaufman (via telephone) Also Present: P. Conner, Director of Planning & Zoning; A. Lafferty, Deputy City Attorney, Leo Nadeau, Michael Mittag, Penne Tomkins, Susan Hartman, Rosanne Greco, Gerry Silverstein, additional members of the public 1. Pledge of Allegiance 2. Instructions on existing building in case of emergency Mr. Conner provided instructions in the event of an emergency. 3. Agenda Review: Additions, deletions, or changes in the order of agenda items No changes were made. 4. Comments and questions from the public not related to the agenda No comments were provided 5. Public Hearing, Council discussion and possible action related to extending the time period during which Interim Zoning bylaws are in effect. Mr. Kaufman moved to enter into a public hearing. Ms. Emery seconded. Motion passed 4-0. Ms. Emery moved that the Council approve and extend the duration of the South Burlington Interim Bylaws by the three-month period ending November 13, 2019. Motion seconded by Mr. Barritt. As the motion was during the public hearing, Ms. Emery and Mr. Barritt agreed to table the motion until following the public hearing. Motion to table the motion approved 4-0. Ms. Riehle read a statement provided to her from Mr. Chittenden, who expressed regret for not being able to attend. In his statement he stated that he appreciated the work being done by the volunteers in the community. However, since he did not vote in support of adoption of Interim Zoning, he would not support extending it. Ms. Tomkins asked that the Council extend the Interim Zoning bylaw to allow the Committees to finish the work they were doing. Mr. Kaufman’s phone call was disconnected at this time. Mr. Nadeau asked the Council to think twice about Interim Zoning. He said he felt the future of properties of landowners such as he are in jeopardy. He said he has attended many meetings during Interim Zoning, perhaps more than any other citizen. He has heard passion about wildlife and about natural resources. E has not heard passion about rights of owners of open space. The work has been focused on the southeast quadrant. The work has put all of this on the backs of a few landowners, he said. He cited proposed 100-room hotels and the O’Brien development being greater in volume than Cider Mill I & II, and yet has heard no concerns about providing services to those. He asked that with the extension to Interim Zoning, to have the committees finish their work quickly, and asked the Council to keep this in mind before extending Interim Zoning again in 3 months. Ms. Kaufman’s telephone connection was restored partway through Mr. Nadeau’s input. Ms. Greco said that the Interim Zoning committees are looking beyond the southeast quadrant. A primary reason for her, she said, is natural resources. She said she was in favor of an extension, not to delay development, but to complete the work on updating the Land Development Regulations or city policies. Mr. Silverstein said that once open space is gone, it is gone forever. He asked the community to do what is difficult, to look forward to what it will look like in the future. Ms. Hartman said she was in favor of extending Interim Zoning. Ms. Emery moved to conclude and exit the public hearing. Mr. Barritt seconded. Motion approved 4-0. Ms. Emery moved to un-table the motion to extend Interim Zoning. Mr. Barritt seconded. Motion approved 4-0. Mr. Kaufman stated he supported extending Interim Zoning. Ms. Riehle called the question. Motion passed 4-0. 6. Other Business: Nor other business was discussed. As there was no further business to come before the Council, Ms. Emery moved to adjourn. Mr. Barritt seconded. Motion passed 4-0. The meeting was adjourned at 4:55 p.m.
