Dear Mr. Bowen:
Please be advised that based on information available to the City, you have commenced land
development on your property at the above address without obtaining a permit from the City as
required by Section 27.10 of its Zoning Bylaws and 24 VSA 4443(a)(1). Specifically, you have
initiated the following activities on the above -described property.
Extended the garage structure to approximately three (3) feet of the rear property line without a
zoning permit.
You have seven (7) days from the date of this letter to discontinue this violation and take appropriate
remedial action. Specifically, you must accomplish the following:
Remove all structures within 25 feet of rear property line as approved by the Zoning Board of
Adjustment on September 11, 1978.
If you do not accomplish the actions directed in this letter within seven (7) days of the date of this
letter, the City may pursue this matter in court. In such court proceeding, the City will be entitled
to seek appropriate injunctive relief and fines of up to $100.00 per day for each day your violation
continues beyond the seven (7) day period provided in this letter.
If the violation described in this letter occurs within twelve (12) months of the date of this letter, you
will not be entitled to receive a further Notice of Violation from the City before the City pursues
further enforcement proceedings.

No. 5 Appeal of Irene Casey

SEPTEMBER 11, 1978
Appeal of Irene Casey seeking a variance from Section 11.00, Dimensional
requirements of the South Burlington Zoning Regulations. Request is for
permission to construct a detached 24' a 24' garage to within twenty (20)
feet of the northerly rear yard line, at 22 Wright Court.
Mr. Ward said that the area was zoned R4 and that the minimum required.
rear yard was 30' where 201 is proposed. A variance was granted in 1973
to construct an addition to the building to within 20' of the rear line.
The existing 19' a 21' garage will be removed in order to put up the new one.
Mrs. Casey said that the new garage would be 24' wide by 21' deep, not
24' deep, but they will stay 20' from the rear line. She said that when her
husband died she needed income from the house, so she made the addition into
an apartment. She felt that putting the garage in the place intended would
be more attractive for the neighbors and would also let light into the
apartment, which would not be let in if the garage were farther forward.
She also noted that her rear line abutted the cemetary and that none of her
neighbors objected to the plan. One part of the garage will be for the tenant.
The appeal was granted unanimously.
No. 6 Appeal of Larry and Rolande English
Appeal of Larry and Rolande English seeking a variance from Section
13.67, Swimming pool requirements of the South Burlington Zoning Regulations.
Request is for permission to construct a 16' x 32' swimming pool to within
six (6) feet of the rear yard line, at 29 O'Brien Drive.
Mr. Ward said the area was zoned R4 and that the lot in question was
set off under the 1964 ordinance, where the minimum lot size required was
10,000 square feet. The minimum yard size for having a swimming pool is
15' and the proposed in -ground pool would be within 6' of the rear yard line.
This is a corner lot.
Mr. English said this was the only place he could put a pool because
it was a corner lot. If he moved it towards Barrett Street, he would not
need a variance but it would look like it was in the front yard for the
people on that street. Mr. English showed the Board the steps to the raised
deck on the back of the house and the sidewalks which would prevent him
from putting the Pool much closer to the house and towards Barrett Street.
There will be a stockade fence around the pool and 3' sidewalks on both sides.
Mr. English said the housewouldlook funny if he removed the deck to make
way for the pool and added that it would not be economically feasible to do
that. He said that if the pool had to be drained, a truck would come and
take the water out and put it right back in later. The neighbor most affected
is 30' from the property line and his home has no windows on the side that
faces the pool.
The appeal was approved unanimously.

Appeal of Raymond Bowen and Sandra Thurston seeking a variance from

Request is for ,permission to construct a 24' x 44' detached garage to within
six (6) feet of the easterly side yard and twenty-five (25) feet of the rear
yard, at 18-20 Elizabeth Street.
Richard Ward told the Board that the area was zoned R4 and that the
minimum side yard required was 15' where proposed and existing is 6'. The
minimum rear yard is 30' and proposed is 25'. The existing 22 1/2' x
18 112' garage will be removed and the new one erected in the same location.
The garage will not encroach farther on either the side or rear yards.
Mr. Bowen said that he and Miss Thurston owned a duplex jointly and
that they both owned two cars, one of which was driven only in the winter
and one driven only in the summer. The tenants in the other side of the
duplex have one car, so there are 5 cars now on the property. Since the
garage is very small, all of the cars are parked in the driveway now. The
existing garage is 27-28 years old and in very bad shape. All the neighbors
favor the change, he said. They want to have a garage with one side for
the tenants to use and one side in which they can park the two cars that they
are not using in that season. It would be a 4-car garage.
The appeal was granted unanimously.
No 8 Appeal of Winooski Valley Park District
Appeal of Winooski Valley Park District seeking approval under Section
2.10, Conditional uses of the South Burlington Zoning Regulations. Request
is for permission to construct a public recreation area on a parcel of land
containing eight (8) acres located along the Winooski River off Poor Farm
Road, land owned by Griswold Corporation.
Since this appeal and the one following were similar, the Board discussed
them separately but decided to vote on both together.
No 9 Appeal of Iinooski Valley Park District
Appeal of Winooski Valley Park District seeking approval under Section
3.20, Conditional uses of the South Burlington Zoning Regulations. Request
is for permission to construct a public recreation area on a parcel of land
containing forty-nine acres located along the south bank of the Winooski
River off Berard Drive and Airport Parkway.
Mr. Ward said that #8 was located in the Flood Plain District and that
public or commercial recreation was a conditional use under Section 2.10.
The proposed use will involve construction of a canoe access, picnic and
parking area. The parcel contains 8 acres of land.
Mr. Russel Agnee said that he was South Burlington's representative
on the Park District, which is a municipal corporation of which the city
is one of the 5 members. He said that this would be a rental property and
that if it is approved, Bureau of Outdoor Recreation money would be used in
setting it up. A parking area for 12 cars will be made and a gravel road
constructed. The area is flooded annually. There will be a few picnic tables
and a chain across the road at night.
Pis. Debbie Bookchin said that they did not expect a great deal of traffic
certainly not enough to have an adverse impact on the roads in the area.
She did not think this would affect the character of the area and said that
