Mr. Bresee said the Rec Path Committee will look at this. Mr. O'Leary said they are looking for a parking waiver. Spaces will be designated. Mr. Dinklage suggested identifying a parking area to be paved only if needed. Mr. Kupferman asked if these would be owned or rented units. Mr. Larkin said he would prefer to sell them. C14"Sketch plan application #SD-05-16 of O'Brien Home Farm LLC and O'Brien Family Limited Partnership to amend a previously approved planned unit development consisting of 117 multi -family residential units in 16 buildings. The amendment consists of constructing: 1) eight 8-unit multi -family residential dwellings, and 2) two 35-unit multi -family dwellings, for a total of 134 additional units, Eldredge Street: Mr. Boucher said he would like to see a Master Plan for the entire parcel. Mr. O'Brien showed what is now existing. Mr. Dinklage noted that one feedback from the development on Lot #2 is that it would have looked much nicer if they had cut down fewer trees. Many people have commented on this. The Board will pay a lot of attention to that this time. They will want to know what will be cut and what will be preserved. Mr. Dinklage also indicated the Board would be more able to talk about compromise if they know the whole picture. He noted this is a very large building very near the road, and buildings 1 & 2 are right up against the right-of-way so they have no backyards. Mr. Dinklage felt this doesn't make sense. There was also concern with the 2 curb cuts closest to Kennedy Drive. Mr. O'Brien felt the height of the larger buildings would be 49 feet. They will know after sketch. There will be parking under both buildings. Mr. Dinklage asked about wetlands. Mr. O'Brien showed the wetlands and the 50-foot buffers. The Board asked to have wetlands delineated with a fence. Mr. Dinklage also said the Board agreed with staff on the need for more open space. Mr. O'Brien said ledge outcropping forces the infrastructure into a little area. This makes for a more linear design. Mr. Dinklage felt it was pretty ugly. Mr. O'Brien said they looked at a double -sided row of single family homes and also at more of an idea of what was built on Dorset Street with buildings right up to the SLIM 15 MARCH 2005 sidewalk, but they needed parking behind the buildings. They also looked at a more conventional town house but didn't get in enough units for an R-12 district. Mr. Dinklage suggested treating the whole area as a PUD. He indicated there is concern with where traffic will be dumped. He suggested building the road to T into Kennedy Drive. He noted there will be a traffic light there someday. Mr. Dinklage said his gut feeling was that the applicant wouldn't be able to squeeze all the proposed units onto this property. Mr. Kupferman agreed. Mr. O'Brien noted the problem with the downhill slope. He showed members a "walkout basement" situation and showed how that plan would look. 6 units would face the forest. There would be no parking behind the buildings, and there would be less impact on the forest. Mr. Dinklage showed the area of his concern. He asked that screening be maximized. Pursuant to Section 15.13(B)(1) of the Land Development Regulations, municipal water service must be extended to serve the proposed development. In making this finding, the DRB may rely on evidence that the project will be covered under the General Permit for Construction issued by the Vermont Department of Environmental Conservation. 3. The proposed project shall adhere to standards for erosion control as set forth in Section 16.03 of the South Burlington Land Development Regulations. In addition, the grading plan shall meet the standards set forth in Section 16.04 of the South Burlington Land Development Regulations. The project incorporates access, circulation and traffic management strategies sufficient to prevent unreasonable congestion of adjacent roads. In making this finding the DRB may rely on the findings of a traffic study submitted by the applicant, and the findings of any technical review by City staff or consultants. The applicant is proposing a 30' wide public street, in a 60' wide right-of-way, extending from Kennedy Drive to Eldredge Street. Access to the eight (8) eight -unit multi -family buildings is proposed via two (2) 30' wide curb -cuts off of the public street extending from Kennedy Drive to Eldredge Street. Access to the two (2) 35- unit multi -family buildings is proposed via a 24' wide curb -cut serving an underground parking facility, a 30' wide curb -cut accessing a parking lot, and a 24' wide curb -cut accessing a parking lot. All three (3) of these curb -cuts are off of the public street extending from Kennedy Drive to Eldredge Street. Staff recommends that the applicant consolidate the two (2) proposed curb -cuts near the easterly property boundary, closest to Kennedy Drive, and move it as far away from Kennedy Drive as possible. 4. The plans should be revised to eliminate one (1) of the curb -cuts along near the easterly property boundary, closest to Kennedy Drive, prior to submittal of the preliminary plat application. 5. The applicant should submit a traffic impact study for the proposed project with the preliminary plat application. The project's design respects and will provide suitable protection to wetlands, streams, wildlife habitat as identified in the Open Space Strategy, and any unique natural features on the site. In making this finding the DRB shall utilize the provisions of Article 12 of these Regulations related to wetlands and stream buffers, and may seek comment from the Natural Resources Committee with respect to the project's impact on natural resources. 6. The plans submitted with the preliminary plat application should include delineations of any wetlands on the subject property. CITY OF SOUTH BURLINGTON 4 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING \drb\sub\obden\sketch 134 unit.doc The project is designed to be visually compatible with the planned development patterns in the area, as specified in the Comprehensive Plan and the purpose of the zoning district(s) in which it is located. Staff believes the proposed development is in keeping with the goals for high -density development within the Residential 12 (R12) District, as set forth in Section 4.05(A) of the Land Development Regulations. However, staff does not believe that the layout of the proposed eight (8) eight -unit buildings meets the intention of the Land Development Regulations. These building should be clustered in order to accomplish a more efficient use of the property. Open space areas on the site have been located in such a way as to maximize opportunities for creating contiguous open spaces between adjoining parcels and/or stream buffer areas. The layout of the proposed project, mainly with regard to the eight (8) eight -unit buildings, does not accomplish an adequate open space plan. This project can be designed in a manner that will yield a reasonable number of units, while providing adequate open space areas. In response to the open space concerns of this project, the Director of Planning and Zoning, Juli Beth Hinds, drafted a memorandum to the applicant dated February 17, 2005 (attached). 7. Prior to submittal of the preliminary plat plans, the project layout should be revised to provide adequate and functional open space areas. The layout of a subdivision or PUD has been reviewed by the Fire Chief or his designee to insure that adequate fire protection can be provided. 8. The plans should be reviewed by the South Burlington Fire Chief, prior to preliminary plat approval. Roads, recreation paths, stormwater facilities, sidewalks, landscaping, utility lines and lighting have been designed in a manner that is compatible with the extension of such services and infrastructure to adjacent properties. The City Engineer will review the details of the proposed infrastructure and improvements. The applicant is proposing an 8' wide recreation path. Although the new standard width for recreation paths is 10', staff suggests approving this recreation path at 8' wide, so that it integrates with the existing 8' wide paths on the adjacent properties. Roads, utilities, sidewalks, recreation paths, and lighting are designed in a manner that is consistent with City utility and roadway plans and maintenance standards. 9. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. 10. The plans should be reviewed by the City Engineer, prior to preliminary plat approval. CITY OF SOUTH BURLINGTON 5 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING \drb\sub\obden\sketch 134 unit.doc The project is consistent with the goals and objectives of the Comprehensive Plan for the affected district(s). Staff feels that the proposed project could be in compliance with the Comprehensive Plan, if the layout was revised to increase functional open space on the subject property. SITE PLAN REVIEW STANDARDS Pursuant to Section 14.03(A)(6) of the Land Development Regulations, any PU D shall require site plan approval. Section 14.06 establishes the following general review standards for all site plan applications. - The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. Staff feels the project accomplishes a desirable transition from structure to structure. However, the open space areas will need to be increased in order for the project to accomplish a desirable transition from structure to site. According to Table 13-1 in Section 13.01(B) of the Land Development Regulations, the proposed project requires a minimum of 302 parking spaces. The plans show a total of 264 parking spaces, 78 of which are located underground. This represents a shortage of 38 parking spaces, which will require a 12.6% parking waiver. 11. Staff recommends that the Development Review Board grant the applicant a 38 space, 12.6%, parking waiver. Pursuant to Section 13.01(1) of the Land Development Regulations, the proposed project will require seven (7) handicapped -accessible parking spaces. 12. Pursuant to Section 13.01(G)(5) of the Land Development Regulations, the plans should be revised to depict several bicycle racks, prior to submittal of the preliminary plat plans. Parking shall be located to the rear or sides of buildings to the greatest extent practicable. The parking layout of the two (2) 35-unit buildings is adequate, but the parking areas serving the 8- unit buildings should be to the rear or sides of the proposed buildings. Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or adjoining buildings. The proposed buildings will have a maximum height of 40'. Newly installed utility services and service modifications necessitated by exterior alterations or building expansions shall, to the extent feasible, be underground. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. The applicant should submit building elevation plans with the preliminary plat application. Proposed structures shall be related harmoniously to themselves, the terrain and to existing buildings and roads in the vicinity that have a visual relationship to the proposed structures. Again, the applicant should submit building elevation plans with the preliminary plat application. In addition to the above general review standards site plan applications shall meet the following specific standards as set forth in Section 14.07 of the Land Development Regulations: The reservation of land may be required on any lot for provision of access to abutting properties whenever such access is deemed necessary to reduce curb cuts onto an arterial of collector street, to provide additional access for emergency or other purposes, or to improve general access and circulation in the area. Staff does not feel it is necessary to create access to the properties that abut the subject property. Electric, telephone and other wire -served utility lines and service connections shall be underground. Any utility installations remaining above ground shall be located so as to have a harmonious relation to neighboring properties and to the site. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). 14. The plans should be revised to depict any dumpsters proposed for the subject property, prior to submittal of the preliminary plat application. Landscaping and Screening Requirements 15. The applicant should submit a landscaping plan and budget in accordance with Sections 13.06(F) and 13.06(G) of the Land Development Regulations, prior to submittal of the preliminary plat application. 16. Pursuant to Section 13.06(B)(4) of the South Burlington Land Development Regulations, the plans should be revised to show the location of snow storage areas, prior to submittal of the preliminary plat application. There are a number of good examples of open space and recreation amenities in developments around South Burlington. This letter outlines the City's basis for recreation and open space planning as it applies to the O'Brien Home Farm. The principle that should be kept in mind is that the development of a large number of residential units -- in the case of the O'Brien Home Farm, 117 multi -family units in phase I and a sketch plan application for another 139 multi -family units in phase II -- necessitates adequate provisions for the recreation and open space needs of the residents who will occupy those units. Based on the City's average household size of 2.31 persons per unit from the 1990 Census', Phases I and II of the O'Brien Home Farm project will lead to roughly 591 new residents occupying this property. The City's Capital Budget and Program (see p. 13) sets a standard of 7.5 acres of developed parkland (i.e. land that has been graded, planted, and otherwise managed in such a fashion that its principal function is as a recreational area, rather than simply unmanaged, undeveloped land) per 1,000 persons. With a projected new population totaling 591 residents, phases I and II of the O'Brien Home Farm generate a combined need for 4.4 acres or 193,197 SF of developed park land. I have attached a spreadsheet showing these calculations and also the estimated number of school pupils that the project will generate, based on the City's 2001 Capital Budget and Program. i The City uses the average household size of 2.31 persons per unit for projecting the resident population of multi -family units. The higher average family size of 2.93 persons per unit is used for single-family units. Mr. Patrick O'Brien February 17, 2005 Page 2 of 3 The City's Comprehensive Plan (see P. 71) recognizes a wide variety of types of private and public lands and facilities that are needed and that are provided by developers, the City, and private clubs. All of these types of facilities and park spaces are described in detail in the Plan. You will see that there is quite a variety of spaces and land uses that qualify as "developed parkland," from "mini -parks" intended "...for passive use such as picnic areas, plantings and sitting areas," to neighborhood parks of five to ten acres, to community parks of between 20 and 5o acres. South Burlington's residents, and developers who build here, benefit from the wide variety of recreation spaces available and the value that is generated when people have access to excellent recreation facilities. You had asked previously what I meant by "private recreation facilities" that are made available only to members of a homeowners' association or other Appendix C, Table 2 of the Plan (p. 154-5) then lists the private recreation facilities that developers have provided in conjunction with new housing throughout South Burlington. You will see that developments of many sizes and types, from the Vermont National Country Club to Ridgewood Estates, Stonehedge, The Landings, Treetops, Georgetown, Forest Park, Meadowbrook, and Indian Creek, just to name a few, have incorporated private recreation facilities as planned amenities that help fulfill the recreation needs of the residents who live there. I am sure that your next question will be "Well, we will pay recreation impact fees and we will be required to build recreation paths — doesn't that fulfill our obligation?" In short, no, it does not. Phase I and the proposed Phase II of the O'Brien Home Farm Project will create a dense neighborhood of nearly 60o residents. To meet the City's clearly articulated and legally adopted standards for varied, accessible recreation space, some of the developed parkland will have to be provided within walking distance of these housing units. This standard is especially rigid for multi -family developments: in single-family neighborhoods, private yards and lawns are understood to provide some of the appropriate and necessary recreation space. In multi -family developments, the appropriate and necessary recreation space and facilities must be provided on common land that has been planned for this purpose by the project's developers. My recommendation to you is to read Chapter io (Recreation) and Appendix C, Tables 2 and 3 of the Comprehensive Plan for more detailed guidance on the City's policies and the various types of developed park land. You should continue to consult with the recreation department as to different types of ways to meet this obligation (i.e. public vs. private facilities or a combination thereof). However, I will suggest that the idea of providing a "pocket park" located on a thin strip along the roadway, as had been proposed at some point during Phase I, will continue to be unacceptable. If O'Brien Brothers believes that it may be mutually beneficial to go beyond the basic standards for developed parkland outlined above in conjunction with this project, and seeks a partnership with the City to do so, we will be happy to discuss this further with you. B&B $2,625.00 Total $5,639.97 SITS PLAN 1E:E3C�1:Z(DW A40r12.1E1EM1=NT THIS AGREEMENT, executed in triplicate by and between Homestead Design Inc. , hereinafter referred to as Developer", the CITY OF SOUTH BURLINGTON, hereinafter referred to as "Municipality", and the Merchants , hereinafter referred to as "Bank". WITNESSETH: WHEREAS, Developer has received site plan approval from the MUNICIPALITY'S Planning Commission for the development of property located at Hayes Avenue , as depicted on a site plan entitled " Stonington Circle ", dated 2/14/03 , and prepared by Krebs & Lansing WHEREAS, Developer is required by said approval, at its own expense, to complete certain improvements; and WHEREAS, the parties to this Agreement wish to establish an escrow account to secure the obligations of the Developer as set forth in the City approval; and WHEREAS, the Bank executes this Agreement solely in the capacity of escrow agent. NOW THEREFORE, the parties hereby, covenant and agree as follows: 1. DEVELOPER will, at its own expense, complete the following construction as depicted and in accordance with the specifications set forth in said site plan and related documents: Landscaping L-1 2. The Developer shall complete the improvements set forth in Paragraph one no later than _10/31 /06 3. DEVELOPER shall replace or repair any defective or improper work or materials which may be recognized within three (3) years after completion of the improvements set forth in Paragraph one. For the purpose of this Agreement "completion" shall be deemed to have occurred when the MUNICIPALITY has inspected and approved the construction of all the improvements required by this Agreement and issued written notice to the DEVELOPER that the construction is complete. 4. For the guaranty of Developer's performance of all requirements hereinabove set forth, and prior to the issuance of any zoning permit for Stonington Circle , Developer and Bank agree that the sum of $50, 141 .60 shall be set aside and held in escrow by the Bank and shall be available for payment to the Municipality in accordance with the terms herein set forth. 5. If the Municipality shall file with the Bank a statement that the Developer is in the judgement of Municipality in default under the terms of this Agreement, the Bank shall from time to time pay monies from said escrow fund to the Municipality, in amounts not to exceed a total enabling the Municipality to ' complete improvements and requirements set forth in this Agreement. 6. The Municipality will promptly submit to the Developer a copy of such statement as it files with the Bank. The consent of the developer to such payment by the Bank to the Municipality shall not be required. The Bank shall incur no liability to the Developer on account of making such payment to the Municipality, nor shall the Bank be required to inquire into the propriety of any claim by the Municipality of default on the part of the Developer or into the use of such funds by the Municipality in completing such improvements. 7. The Municipality shall not file with the Bank a statement of default until thirty (30) days after notice has been sent by it to the Developer by certified mail, return receipt requested, setting forth its intention to do so. 8. All monies released by the Bank to the Municipality pursuant to paragraph five (5) shall be used by the Municipality solely for the purpose of performing obligations imposed upon the Developer by that portion of this Agreement upon which the Developer is then in default. Any work to be performed by the Municipality pursuant hereto shall be let on a contractual basis, or on a time and material basis or shall be performed by the Municipality with its own work force and equipment or shall be accomplished in such manner as in the judgement of the Municipality shall accomplish the work most expeditiously and economically. 9. If monies are released by the Bank to the Municipality pursuant to paragraph five (5) and it shall later develop that a portion of the released monies are surplus to the Municipality's needs, any such surplus shall be refunded by the Municipality to the Bank to be held and distributed by the Bank pursuant to the terms of this Agreement. 10. The Bank will not refuse or delay to make such payments to the Municipality when requested by the Municipality by the appropriate statement, and Developer will not interfere with or hinder such payments by the Bank to the Municipality. Said statement shall contain a certificate of compliance with the notice requirements of paragraph seven (7) of this Agreement. 11. This Agreement shall terminate and shall be of no force or effect upon performance of all requirements contemplated hereby, and the completion of the warranty period set forth in paragraph three (3) . 12. The sum of $50,141 .60 shall be maintained in escrow until certification to the Bank by the. Municipality of the completion of the warranty period set forth in paragraph three (3) . 2 13. This Agreement shall not only be binding upon the parties hereto, but also their respective heirs, executors, administrators, successors and assigns.
