HomeMy WebLinkAboutSD-08-35 - Decision - 0000 Eldredge Street#SD-08-35 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING O'BRIEN FAMILY LIMITED PARTNERSHIP & O'BRIEN HOME FARM, LLC FINAL PLAT APPLICATION #SD-08-35 FINDINGS OF FACT AND DECISION O'Brien Family Limited Partnership and O'Brien Home Farm, LLC, hereafter referred to as the applicants, are seeking final plat approval to amend a previously approved planned unit development consisting of 117 multi -family residential units in 16 buildings. The amendment consists of revising the property line of lot #4 to allow the as -built curb and paving of Eldredge Street to be completely within the City right-of-way, Eldredge Street & Hinesburg Road. The Development Review Board held a public hearing on Tuesday, August 5, 2008. Stephanie O'Brien represented the applicant. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicants are seeking final plat approval to amend a previously approved planned unit development consisting of 117 multi -family residential units in 16 buildings. The amendment consists of revising the property line of lot #4 to allow the as -built curb and paving of Eldredge Street to be completely within the City right-of-way, Eldredge Street & Hinesburg Road. 2. The owners of record of the subject property are the O'Brien Family Limited Partnership and O'Brien Home Farm, LLC. 3. The subject property is located in the Residential 12 (R12) Zoning District. 4. The plan submitted is entitled, "Final Plat O'Brien Home Farm Old Farm Road South Burlington, Vermont", prepared by Krebs & Lansing Consulting Engineers, Inc., dated Feb 25, 2002, last revised on 6/9/08. 5. The purpose of the application is to transfer a small amount of land (approximately 230 square feet) from Lot 4 to the City Right of way. This is necessary so that al: of the built curbing and pavement on Eldredge Street will be within the City Right of Way. Director of Public Works, Bruce Hoar, has been involved in the discussions and has stated that he finds the approach and the plans acceptable. 6. There are no changes to the dimensional requirements as part of this application. All requirements are met. #SD-08-35 DECISION Motion by �E �i�� seconded by G�� L to approve Final Plat Application #SD- -35 of O'Brien Family Limited Partnership and O'Brien Home Farm, LLC, subject to the following conditions: 1. All previous approvals and stipulations shall remain in full effect except as amended herein. 2. This project shall be completed as shown on the plat submitted by the applicant and on file in the South Burlington Department of Planning and Zoning. 3. Any changes to the final plat plan shall require approval by the South Burlington Development Review Board. 4. The final plat plan (survey plat) shall be recorded in the land records within 180 days or this approval is null and void. The plan shall be signed by the Board Chair or Clerk prior to recording. Prior to recording the final plat plan, the applicant shall submit a copy of the survey plat in digital format. The format of the digital information shall require approval of the South Burlington GIS Coordinator.
