Re: Findings of Fact, application of Burlington Tennis Club to add two (2) 301x 60'
paddle tennis courts to an outdoor recreational facility, 12 East Terrace.
On the 23rd day of July, 1996, the South Burlington Planning Commission approved
the request of Burlington Tennis Club for site plan review under Section 26.10 of the
South Burlington Zoning Regulations based on the following findings:
1. This project consists of adding two (2) 301x 60' paddle tennis courts to an
outdoor recreational facility. The ZBA on 6/24/96 granted a conditional use permit
for the proposed expansion.
2. This property located at 12 East Terrace lies within the C1 District. It is
bounded on the north by Staples Plaza, on the west by single family residences along
East Terrace, and on the south and east by undeveloped property.
3. Access/circulation: Access is provided via a 36 foot curb cut on East Terrace.
No changes 'Proposed.
Circulation on the site is adequate.
4. Coverage/setbacks: Building coverage is 2% (maximum allowed is 30%) . Overall
coverage is 20% (maximum allowed is 70%) . Front yard coverage does not apply since
the only frontage the property has on East Terrace is the 50 foot r.o.w.
Setback requirements are met.
5. Landscaping: The minimum landscaping requirement, based on building costs,
is $90 which is being met. Proposed plantings include Burning Bush.
6. Parking: There is no minimum parking requirement by standard for outdoor
recreation. There are at least 10 parking spaces including one (1) handicapped
space. Since the paddle tennis courts will only be used during the winter months
when the regular tennis courts are not being used, staff believes that adequate
parking will be available. A bike rack is also being provided.
7. Sewer: No additional sewer allocation is needed.
8. Traffic: No additional traffic is expected due to the fact that the proposed
paddle tennis courts will be used only when the other facilities are not being used.
9. Lighting: Exterior lighting will consists of 12-1500 watt quartz halide flood lights
mounted on poles with a maximum height of 20 feet. The applicant has submitted a
lighting study which demonstrated that no light will be measurable beyond 70 feet
from the courts. The courts are 100 feet from the nearest residential property line.
10. To be certain that glare (i.e., the light source) will not be visible from
adjoining properties, the lights should be tipped straight down as much as possible.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning Commission
approves the site plan application of Burlington Tennis Club to add two (2) 30'x 60'
paddle tennis courts to an outdoor recreational facility, 12 East Terrace, as depicted
on a plan entitled "Site Plan, Burlington Tennis Club, 12 East Terrace, South
Burlington, VT 05403, Paddle Tennis Project," with a stamped "received" date of
May 15, 1996, subject to the following stipulations:
1. All previous approvals and stipulations which are not superseded by this
approval shall remain in effect.
2. Prior to issuance of a zoning permit, the applicant shall post a $90 landscape
bond. The bond shall remain in effect for three (3) years to assure that the
landscaping takes root and has a good chance of surviving.
3. All new exterior lighting shall consist of downcasting shielded fixtures so as not
to cast light beyond the property line. Any changes in lighting shall be approved
by the City Planner prior to installation. The proposed lights shall be tipped
straight down as much as possible to assure that glare (i.e., the light source) will
not be visible from the adjoining properties.
4. For purposes of calculating road impact fees under the South Burlington impact
fee ordinance, the Planning Commission estimates that the proposed use will generate
zero (0) additional vehicle trip ends during the P.M. peak hour.
5. The applicant shall obtain a zoning permit within six (6) months pursuant to
Section 27.302 of the zoning regulations or this approval is null and void.
6. The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer prior to occupancy of the paddle tennis courts.
7. Any change to the site plan shall require approval by the South Burlington
Planning Commission.
