HomeMy WebLinkAboutVR-97-0000 - Decision - 0006 Duval StreetSTATE OF VERMONT COUNTY OF CHITTENDEN q1 %— CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the loth day of February 1997, the South Burlington Zoning Board of Adjustment heard testimony regarding a variance application of Bryan & Vivian Companion, 6 Duval Street. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findings of Fact The area in question is zoned R-4 District. Section 25.00 requires a minimum front yard setback of thirty (30) feet. The appellant is proposing a second story (28'x 38') and a 8'x 38' front porch. The front yard setback would be approximately fourteen (14) feet. (' nnol»cinn Lot size set off in early 1960's at that time conformed with subdivision and zoning by-laws. The addition will not alter the essential character of the neighborhood, is in keeping with the neighborhood (average setback from the curb being 35 feet) . Physical circumstances are limiting, a variance is necessary to construct any size front porch. Addition is reasonable to current housing standards. Increase in living area is required by appellant. Addition vs. relocation is a main consideration. Based upon the findings and conclusion setforth above, the Zoning Board of Adjustment hereby grants the applicant request to construct a 81x 38' porch to within approximately fourteen (14) feet of the required front yard, located at 6 Duval Street. ll /I , _ A Chairman, FEB 2 South Burlington Zoning Board of Adjustment
