Dear Mr. Kerr:
It is my understanding that you wish to withdraw your application for permission to
allow the use of a recreational vehicle for living purposes. To withdraw this
application you will need to send a letter requesting that your application be
withdrawn.
(Unfortunately, we cannot refund your application fee. This fee is used to pay for the
legal notice that is required by law. Since the City has already incurred this cost, we
cannot refund your application fee.

The following information must be shown on the plans. Please submit five (5) copies and one reduced
copy (11 " x 17") of the plan. Failure to provide the following information will result in your application
being rejected and a delay in the review before the Development Review Board. If submitting a final
plat amendment, please submit only pertinent information. Please provide (on separate sheet) a list of
all abutters to the project property and mailing addresses.
o Complete survey of property by a licensed land surveyor drawn to scale (20 ft. is preferred).
o Name, license number, seal, and contact number of licensed land surveyor & date prepared.
o Survey data (acreage, property lines, zoning boundaries, watercourse, base flood elevation, etc.)
o Location of easements, public lands, r.o.w.s, sidewalks, and public or private street (w/names)
o Five foot contours (existing and finished)
o Location and size of any existing sewers (including septic tanks) and water mains, culverts and
drains on the property to be subdivided.

Stipulation 3(c) as follows: The Plans shall be revised to delete the farm
fence along the Marceau boundary." Mr. Farley seconded. Motion passed
unanimously.
4. Continued Public Hearing: Final Plat Application #SD-03-45 of Magic Hat
Brewing Company to amend a planned unit development consisting of three
buildings on two parcels totaling 6.73 acres. The amendment consists of
adding a 16'x32' concrete pad to place two 30-foot high grain storage silos, 5
Bartlett Bay Road:
Mr. Russ said the silos are for storage of materials. Having them onsite will
reduce truck trips because the applicant will be able to buy in quantity.
Mr. Belair said staff has no issues with the request.
Ms. Quimby moved to approve Final Plat Application #SD-03-45 of Magic Hat
Brewing Company subject to the stipulations in the draft motion. Mr. Boucher
seconded. Motion passed unanimously.
5. Public hearing: Application #CU-03-14 of Kieran & Jennifer Killeen seeking
conditional use approval under Section 14.10, Conditional Use Review, of the
South Burlington Land Development Regulations. Request is for permission to
allow an accessory residential unit, 11 Beacon Street:
Mr. Dinklage noted that he is a neighbor of the applicant but saw no reason to
recuse himself.
Mr. Killeen said the unit already exists. They plan to modify the access and
rent it to someone over age 55. The unit is approximately 250 sq. ft.,
including the bathroom.
Mr. Belair noted there is no record of the unit ever being approved. Mr.
Dinklage said he recalled it being approved when the former owner of the
property was there.
Mr. Bolton asked about covenants which require those homes to be for one
single family use only. Mr. Dinklage said this is like renting a room to a
border, and he didn't feel it conflicted.
Ms. Quimby moved to approve Application #CU-03-14 of Kieran and Jennifer
Killeen subject to the stipulations in the draft motion. Mr. Boucher
seconded. Motion passed unanimously.
6. Public Hearing: Application #MS-03-04 of Michael Kerr seeking conditional
use approval under Section 14.10, Conditional Use Review, of the South
Burlington land Development Regulations. Request is for permission to allow
the use of a recreational vehicle for living purposes, 47 Dumont Avenue:
Mr. Belair indicated he had received a voice mail from Mr. Kerr asking to
withdraw the application. Mr. Belair said he wrote a letter to Mr. Kerr
asking for a written notice of withdrawal but hasn't received it yet. He

recommended continuing the application.
Mr. Boucher moved to continue #MS-03-04 of Michael Kerr until 7 October. Ms.
Quimby seconded. Motion passed unanimously.
7. Site Plan Application #SP-03-29 of Chittenden County Transportation
Authority to install a bus shelter along Shelburne Road, 1110 Shelburne Road:

Mr. Peterson reviewed the locations of the shelters on the plans.
Mr. Boucher asked if there will be any snow removal issues. Mr. Peterson said
there shouldn't be.
Mr. Belair said there is no history of problems with shelters. He also noted
they are on state highways.
Mr. Dinklage asked if CCTA would address any vandalism issues that arise. Mr.
Peterson said absolutely.
Ms. Quimby moved to approve Site plan applications #SP-03-29, SP-03-20 and SP-
03-32 of Chittenden County Transportation Authority subject to the
stipulations in the draft motions. Mr. Farley seconded. Motion passed
unanimously.
10. Public Hearing: Final Plat Application #SD-03-48 of White Rock
Development, LLC, to amend a previously approved 30-lot subdivision. The
amendment consists of a planned unit development application for lawn
encroachment in the rear of lots #13, 14, and 15 pursuant to Section
12.01(C)(4) of the Land Development Regulations, 620, 636 and 654 Country Club
Drive:
Mr. Burke reviewed the history of the development and showed changes made to
the original plan.
Regarding the 3 lots in question, Mr. Burke indicated that they went to the
Natural Resources Committee which gave their blessing to what the applicant
wants. Staff also approves. The 3 lots get a minimal back yard. There is
also a stipulation that no pesticides may be used there.
Mr. Dinklage asked why the unusable land isn't deeded to the city. Mr. Burke
said a portion of the 100 ft. setback still belongs to John Belter (from the
back lot lines to the river).
Mr. Bolton said buyers of the lots should be told of the location of the flood
