Re: Findings of Fact, application of MBL Associates to resubdivide
85 lots and relocate the overflow and RV parking areas within a
planned residential development consisting of 161 single family
lots and 60 multi -family units, Dorset Street.
On the loth of May, 1994 the South Burlington Planning Commission
approved the request of MBL Associates for revised final plat
approval under Section 204 of the South Burlington Subdivision
Regulations based on the following findings:
1. This project consists of the resubdivision of 85 lots and
relocation of the overflow and RV parking areas within the
previously approved 221 unit PRD. The sketch plan was reviewed on
April 12, 1994. The purpose of the resubdivision is to comply with
requirements of the State Water Quality Division to minimize
impacts to the wetlands and buffer zones.
2. Access: No changes proposed.
3. Density: No change. The project will still consists of 161
lots and 60 multi -family units.
4. Lot size: The total number of lots remains unchanged. The
smallest lot size previously approved was 7200 square feet (the
minimum requirement is 12,000 square feet). This will continue to
be the smallest lot size. The number of 7200 square foot lots will
be reduced and the number of lots meeting the minimum will be
increased by one (1).

5. Recreation path: The recreation path along the east side of
lots #1-8 will be slightly relocated to the west to move the path
out of the wetland buffer. Sheet 3 of the subdivision plat should
be revised to show the recreation path easement in its revised
location.
6. Parking lot: The multi -family overflow and RV parking areas
are being relocated. These two (2) parking areas will be
consolidated and moved to the easterly portion of the multi -family
site.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the revised final plat application of MBL
Associates to resubdivide 85 lots and relocate the overflow and RV
parking areas within a planned residential development consisting
of 161 single family lots and 60 multi -family units, Southeast
Summit, Dorset Street as depicted on a 47 page set of plans, page
two ( 2 ) entitled "Southeast Summit, Overall Site Plan", prepared by
FitzPatrick-Llewellyn, Inc. and dated October 1992, last revised
4/14/94, and as depicted on a nine (9) page subdivision plat, page
one (1) entitled "Southeast Summit, Plat of Subdivision of Lands of
MBL Associates, Dorset Street, South Burlington, Vermont", prepared
by FitzPatrick-Llewellyn, Inc. dated January 6, 1994, last revised
4/15/94, with the following stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. The final plat plans shall be revised prior to recording to
show the changes listed below and shall require approval of the
City Planner. Three (3) copies of the approved revised plans shall
be submitted to the City Planner prior to recording.
a) Sheet 3 of the subdivision plat shall be revised to show
the recreation path easement located easterly of lots #1-8 in
its revised location as shown on the engineering drawings.
b) The engineering plans shall be revised to add a stub to
M.H.9 for future extensions to the north.
c) The engineering plans shall be revised to show an
additional fire hydrant on Floral Drive (Street "D") at lot
#124 in a location approved by the Fire Chief.

3. The final plat plans, including survey plats, shall be recorded
in the South Burlington Land Records within 90 days or this
approval is null and void. The plans shall be signed by the
Planning Commission Chair or Clerk prior to recording.
