Re: Findings of Fact, application of MBL Associates to amend a
previously approved planned residential development consisting of
121 single family lots and 60 multi -family units, Dorset Street.
The amendment consists of adding berms and landscaping to conform
with the state Environmental Board's approval.
On the 8th day of August, 1995, the South Burlington Planning
Commission approved the request of MBL Associates for revised final
plat approval under Section 204 of the South Burlington Subdivision
Regulations based on the following findings:
1. This project consists of amending a previously approved planned
residential development consisting of 161 single family lots and 60
multi -family units. The amendment consists of modifying the
landscaping plan to conform with the state Environmental Board's
approval. This project was approved by the Planning Commission on
10/12/93 and amended on 5/10/94. The sketch plan was reviewed on
7/11/95.
2. This property located on the west side of Dorset Street
immediately to the north of the Shelburne Town line lies within the
SEQ District.
3. Landscaping: This is the only aspect of the project which is
changing. Berms and additional landscaping are proposed to screen
the project from the street and adjoining property owners.
Landscaping value has increased from $158,485 to $655,240. The
value of the two (2) trees per lot remains at $96,600. The plan
has been revised since sketch plan, at the Public Works
Superintendent's request, to remove all non -street trees from the
street right-of-way.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the revised final plat application of MBL
Associates to amend a previously approved planned residential
development consisting of 121 single family lots and 60 multi-
family units, Dorset Street. The amendment consists of adding
berms and landscaping to conform with the state Environmental
Board's approval, as depicted on a three (3) page set of plans,
page two (2) entitled, "Southeast Summit, South Burlington,
Vermont, Landscape Plan", prepared by Michael Lawrence &
Associates, dated November, 1994, last revised 7/27/95, with the
following stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. Prior to issuance of any zoning permits, the applicant shall
post the following landscape bonds to cover the installation cost
and value of all proposed landscaping: (a) a $52,500 bond for
multi -family site landscaping, (b) a bond in an amount to be
determined by the City Planner for the proposed street trees and
site landscaping and (c) a $96,600 bond for the proposed two (2)
trees per single-family lot. The bond(s) shall remain in effect
for three (3) years from the date of planting to assure that the
planted landscaping has taken root and has a good chance of
surviving.
3. The final plat landscaping plan shall be recorded in the land
records within 90 days or this approval is null and void. The plan
shall be signed by the Planning Commission Chairman or Clerk prior
to recording.
