FINDINGS OF FACT & DECISION / i75" 25%-7 §� STATE OF VERMONT COUNTY OF CHITTENDEN P - O©'� CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of MBL Associates to amend a previously approved planned residential development involving 202.2 acres of land and consisting of 161 single-family lots and 60 multi -family units, Dorset Street. The amendment consists of minor boundary adjustments caused by a more accurate survey. On the llth day of November, 1997, the South Burlington Planning Commission approved the request of MBL Associates for revised final plat approval under Section 204 of the South Burlington Sudivision Regulations based on the following findings: 1) This project consists of amending a plan previously approved on 10/13/93 and amended on 5/10/94 and 8/8/85 for a planned residential development involving 202.2 acres of land and consisting of 161 single family lots and 60 multi -family units. The amendment consists of minor boundary adjustments caused by a more accurate survey. The only issue affected by the application is lot size. 2) Lot size: The minimum lot size requirement is 12,000 square feet. The Planning Commission previously approved a number of lots which were less than the 12,000 square foot requirement. The more accurate survey results in a total of 46 lots which do not currently meet the 12,000 square foot requirement to be further reduced in lot size. This reduction in lot size ranges from one (1) to seven (7) square feet. The Planning Commission may approve these reductions in lot size under Section 6.607 of the zoning regulations. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planing Commission approves the revised final plat application for M.B.L. Associates to amend a previously approved planned residential development involving 202.2 acres of land and consisting of 161 single family lots and 60 multi -family units, Dorset Street. The amendment consists of minor boundary adjustments caused by a more accurate survey, as depicted on a four (4) page set of plans, page one (1) entitled "Dorset Farms Dorset Street South Burlington Vermont Perimeter Property Plat ," prepared by Lamoureux, Stone & O'Leary Consulting Engineers, Inc., dated 8/29/97, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. -1- 2. Pursuant to Section 6.607 of the zoning regulations, the Planning Commission approves the reductions in lot size of the 46 lots which do not currently meet the 12,000 square foot requirement and which will be further reduced in size from one (1) to seven (7) square feet. 3. Any change to the site plans shall require approval by the South Burlington Planning Commission. 4. The final plat plans shall be recorded in the land records within 90 days or this approval is null and void. The plans shall be signed by the Planning Commission Chair or Clerk prior to recording. Prior to recording the final plat plans, the applicant shall submit a copy of the survey plats in digital format. The format of the digital information shall require approval of the City Planner.
