Re: Miscellaneous use application #MS-02-03 of John P. Larkin to build within the
restricted area defined in the Southeast Quadrant Map under Section 6.501 (h) of the
South Burlington Zoning Regulations. The applicant has proposed constructing a single
family residence with a building envelope of 80 feet by 87 feet entirely within the
restricted area, 1955 Dorset Street.
On the 16t' of April 2002, the South Burlington Development Review Board approved
the request of John P. Larkin for approval under Section 6.501 (h) of the South
Burlington Zoning Regulations based on the following findings:
1) This project consists of a request to construct a single family residence with a
building envelope of 80 feet by 87 feet entirely within the restricted area, 1.955
Dorset Street. This project was last approved at the 9/19/2000 Development
Review Board hearing. The approval has lapsed. The applicant is seeking re -
approval of the same project.
2) The owner of record is John P. Larkin.
3) This property is located within the Southeast Quadrant on an undeveloped parcel
within the restricted area. The parcel is bounded by single-family dwellings on the
north, south, on the west by Dorset Farms, and on the east by Dorset Street.
Criteria of Section 6.606
4) In the initial application in 2000, the previous applicant submitted a report
addressing these criteria. The proposed house has setback similar to the adjacent
houses, but may be twice the scale of the existing homes. This will provide for
continuous open space behind the existing and proposed homes. There are no
known natural resources on this parcel and have little potential for agricultural
use, therefore the applicant did not address these criteria with this application.
5) Access/Circulation: Access is provided via a single 20 foot wide curb cut on Dorset
Street. Circulation is not an issue.
6) Setbacks: The building envelope meets all setback requirements.
7) South Burlington Water Department: The applicant was made aware that they must
be in compliance with all South Burlington Water Department recommendation
prior to obtaining a zoning permit.
DECISION AND CONDITIONS
Based on the above Findings of Fact, South Burlington Development Review Board
approves miscellaneous use application #MS-02-03 of John P. Larkin to build within the
restricted area defined in the Southeast Quadrant Map under Section 6.501 (h) of the
South Burlington Zoning Regulations. The applicant has proposed constructing a single
family residence with a building envelope of 80 feet by 87 feet entirely within the
restricted area, 1955 Dorset Street, as depicted on plan entitled "MBL Associates
Property South Burlington Vermont Site Plan "dated 01/11/00, with a last revised date of
10/31/00, with the following stipulations:
1) All. previous approvals and stipulations which are not superseded by this approval
shall remain in effect.
2) Impact fees shall be paid at the issuance of a zoning permit including the Dorset
Street Waterline impact fee.
3) The applicant shall obtain a zoning permit within six (6) months pursuant to Section
27.302 of the Zoning Regulations or this approval is null and void.
4) Any changes to the site plan shall require approval by the South Burlington
Development Review Board.
