HomeMy WebLinkAboutBATCH - Supplemental - 1800 Dorset StreetMEMORANDUM TO: SOUTH BURLINGTON PLANNING COMMISSION FROM: STEPHEN PAGE, PLANNING ASSISTANT RE: ALEX BLAIR RIGHT OF WAY APPROVAL DATE: MARCH 51 1976 Request is for approval of a right,of way, approximately 1,000 feet in length to a landlocked parcel of 6 acres more or less. This parcel was originally set off in 1930 and is presently non -conforming due to the 10 acre minimum lot size of the AR district in this area. The request is being brought to the Commission at this time because the land over which the right of way is shown will soon be coming up for sale through an estate, and passing out of the family. Consequently, it would be preferable for the applicant to negotiate the right of way with the administrator of the estate at this time, rather than a disinterested third party in the future. The width of the right of way must be at least 20 feet, as required by State law. However, I would recommend at least a 60 foot width for the following reasons: 1) filling and culverting required where a minor stream is crossed plus room is needed for plowing snow. 2) 60 feet has been required in similar situations in the same neighborhood. 3) zoning may change to allow higher density and possible subdivis'.on of the property. 4) the easterly extension of Allen Road, as shown on the Comprehensive Plan, passes near enough so that this right of way could eventually serve that purpose. If the Commission chooses to approve the request, I would recommend the following: 1) approval by a formal resolution, specifying the nature and location of the easement. 2 2) approval is for access to one single family dwelling before a building permit is issued, an easement deed running in perpetuity (to be approved by City Attorney) and a plan showing the easement in relation to Dorset Street and the property in question must be submitted. 3) In the event that a building permit for more than one dwelling unit is requested by the applicant, subdivision review is required, and a contract which specifies the number of units to be served by the right of way and absolves the City of any maintenance responsibilities shall be executed.
