HomeMy WebLinkAboutSD-06-85 - Decision - 0232 Autumn Hill Road#SD-06-85 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING JEFFREY & ELIZABETH GOLDBERG FINAL PLAT APPLICATION #SD-06-85 232 AUTUMN HILL ROAD - 5 LOT SUBDIVISION FINDINGS OF FACT AND DECISION Jeffrey & Elizabeth Goldberg, hereafter referred to as the applicants, are seeking a two- year extension to a previously approved five (5) lot residential subdivision expiring October 7, 2006 pursuant to Article 15 of the South Burlington Land Regulations, 232 Autumn Hill Road. The Development Review Board held a public hearing on October 3, 2006. David Burke represented the applicant. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicants are seeking a two-year extension to a previously approved five (5) lot residential subdivision expiring October 7, 2006 pursuant to Article 15 of the South Burlington Land Regulations, 232 Autumn Hill Road. 2. The subdivision received its last approval on September 16, 2003. The South Burlington Land Development Regulations allow that "an approval may be extended for up to two additional years if, after a public hearing, the Development Review Board determines that the developer has, since final plat approval, been diligently and consistently pursing financing or other approvals necessary for the project." 3. The applicant has submitted a narrative describing the status of the project since its original date of approval. The applicant meets the standards of diligently and consistently pursuing financing or other approvals necessary for the project. The narrative included indicates that the Goldbergs have been pursuing financing 4. The owners of record of the subject property are Jeffrey & Elizabeth Goldberg. 5. The subject property is located in the Southeast Quadrant (SEQ) Zoning District. 6. Dave Burke, representing the applicants, stated at the public hearing that the Goldbergs have been diligently and consistently been pursuing financing for their project, but have been unsuccessful. - 1 - #S D-06-85 DECISION Motion by Gavle Quimby, seconded by Roger Farley, to approve Final Plat Application #SD-06-85 of Jeffrey & Elizabeth Goldberg, subject to the following conditions: 1. All previous approvals and stipulations shall remain in full effect, except as amended herein. 2. This project shall be completed as shown on the plat submitted by the applicant, and on file in the South Burlington Department of Planning and Zoning. 3. Any changes to the final plat plan shall require approval of the South Burlington Department of Planning and Zoning. 4. This approval shall expire five (5) years from the date of the original decision (October 7, 2003).
