subdivision will require a city street.

Vermont on Tuesday, June 23 1981, at 7:30 P.M. to consider the

to Hinesburg Road would be close to the intersection and that he would be
happier if, until the intersection or the road were fixed, the development
take place toward the Kennedy Drive side of the lot and that access to it
be from there. he said phasing might be the answer.
Mr. Walsh shared the concern about the number of units. Mr. Jacob
wanted to look at the site first and Mr. Levesque wanted the City Engineer
to look at it.
Nr. Bob Ryan said that 3 112 years ago he had contacted the city to
see if there was any interest in buying that land from him. An appraisal
was done, but it was more than the city wanted to pay, so the land was not
bought.
Mr. Poger suggested that until Hinesburg Road was widened or made safer
or the intersection improved, the access to that road not be opened.
The applicant was told that a sidewalk would be required.
Application by Richard and Dawn Derridinger for sketch plan review of a
subdivision to create 1 ten acre lot on Dorset Street in the southeast
quadrant
Mr. Spitz showed the area on a slide. he said there was a right of
way across the Yawney property and that in 1975 t;iere had been discussion
about which right of way to use. The applicant wanted availability of
the right of way in case the other one was blocked off and he was granted
use of it. The proposal is to have the right of way also serve this 10
acre pzircel. Mr. Yawney, who was in the audience, said that as far as he
knew, the Derridingers had the right to use the right of way.
Mr. Bob Cain represented the Derridingers and said there was no question
that they had a right of way across the Yawney land and he added that they
will locate the house on the lot so as not to create any setback problems
from the stream on the land.
It was noted that the Commission usually allowed 3 houses on a private
right of way. When the 4th one went in, a city street was required. Mr.
Cain said the owners were aware of that.
Application by Ridgewood Estates Development Inc for general discussion of
chances for a revised final plat
Mr. Spitz said this project had received approval for phases 1, 2 and
3 from the Planning Commission and approval for the overall project from
both Council and Commission in the mid-70's. The approval was for 112-114
units of which 13 were single family homes. They now want to make those
single homes into multi -family units. There are some access questions -
a through road to Dorset Street and a right of way for Economou. A pedestrian
easement location will have to be determined and the recreational vehicle
storage area will have to be screened.
It was noted that the Commission had originally asked for a bikepath/
walkway and what it had gotten was a gravelled area.
Mr. t'age showed the location.of the existing units and the proposed
layout for the rest of the project. It is 57 acres and 114 units are proposed.
There will be a more economical layout and more amenities in the new area.
Mr. Levesque noted that there were no trees in the present project, and
he felt that for every tree the developers took out for the new units, they
should put one more in in phases 1 and 2. He said the equivalent dollar
value should be planted. Kr. Poger agreed the area would look better with
some trees. Mr. Page said they would save as many trees as possible and he

STIPULATIONS
For the Final Plat Application of Richard and Dawn Derridinger for a sub-
division consisting of one 10 acre lot on Dorset Street in the southeast quadrant
as depicted on a plan entitled "Portion of the Property of Richard K. and Dawn

Stipulations:
1) Soils test data and survey information shall be combined on one map.
2) A 20 feet easement for a pedestrial trail to be located within the 50 foot
conservation zone on the west side of the brook shall be indicated on the final
plat.
3) An offer of dedication for the pedestrian easement shall be provided prior to
issuance of a building permit.
4) A complete septic system design, prepared by a professional engineer, shall
be provided prior to issuance of a building permit.

A map of the area is enclosed. Applicant is proposing to subdivide a 10-
acre lot (#2) which will be served by a right-of-way across the Yawney property.
Existing house (lot #1) is served by a r-o-w across Demers but also has potential
use of the r-o-w across Yawney.
A minor stream apparently crosses lot #2. Its location will have to be
verified. Also, percolation data must be available for final review.
There are no proposed city streets across the property, but there are 1 or
2 proposed pedestrian trails.
3) Ryan
This 12 acre property is long and narrow and has frontage on both Hinesburg
Road and Kennedy Drive. Neither entrance is ideal. The Hinesburg Road access
(shared with Church of. God), must cross a CO zone and is approximately 350 feet
frcxR the Kennedy Drive intersection. The Kennedy Drive access (shared with
Sugar Tree Condos) must also cross a CO zone, go up a sharp incline, and then
cross City property. However, the use of only one entrance would also not be
ideal for this long, narrow parcel.

On page 3, in the second paragraph, it should be noted that "Mr. Jacob
did not object." Ar. 'dalsh said he agreed with Mr. 'Woolery's position on
the issue - he did not want dorms but did not object to offices or classrooms.

Mr. Spitz said the lot was being created out of a 43 acre parcel. This
lot will use the right of way over the Yawney property. The septic system
will probably have to be designed before a building permit is issued.
Mr. Spitz said a brook cut across the middle of the proposed lot and
that there was a pedestrian trail requirement on the Lang property tc the
wont. He sut-gested a pedestrian trail on the west side within the 50'
CO sc tback.
I;r. Collins, re,;r cc,nnting the Derridingers, said his clients strongly
objected to the pedestrian trail requirement. He said the requirement made
sense for a large development, but this subdivision is to allow a person to
guild a single family home only. That home will be close to the brook and
he felt it was an imposition and a hardship to have a trail running through
there. He said that if the trail were put in, the person might not buy the
land.
Mr. Spitz said a mound septic system might not be required if all
requirements could be met by another system.
I�1r. Collins said the pedestrian trail did not have to be next to the
brook, which he felt was more of a drainage Swale. It is open field there
and there is a private airstrip in the area.
Yr. Jacob agreed running, the trail through the middle of the lot did
not make sense. Mr. :'alsh a, -,reed and asked if a compromise could be made.
Mr. Spitz mentioned having it along the west edge of the property. Mr.
Mona asked about havint; the trail str^ddle the west property line of the 10
acre parcel and Mr..pitz said that was not a problem for the city. He said,
though, that if the trail ever did go in this location, it would be easier

to define it if it were next to the brook.
Mr. adoolery noted that if' the land out in that area did not develop
f'%.,;t, the traAl link:Y would not come together fn7t and he felt it mif�ht be
years before there was a need to define the trail in the area. He added
that, if people could not tell physically where the easement was, the city
should not use it until some money was invested for markers or a fence to
define the area. He felt that if a fence were needed eventually, the city
should bear the expense for it.
Mx— Collins asked about having the trail on the west boundary of the
Derridinger property. Mr. Mona said that to do that the trail would have
to run up the south line, over the west line and then back on the north line
to come out in the vicinity of the brook.
Mr. Krassner said the trail committee liked to have trails along the
streams in the city because that area is zoned CO and no building can go on
in the area anyway.
Mr. Walsh felt the trail system was designed to improve the quality of
life in the city, but not at the expense of the residents.
Mr. Spitz noted that there were trail links on both sides of this property.
"r. Collins noted that if the trail went all the way to the west side
of the Derridinger land, and it went both north and south as Mr. ;Kona had
said, it would ring the Derridinger land.
Mr. Ilona said it seemed that the least offensive alternative would be
to run the right of way from the stream on the left side of the pond to the
west line of the 10 acre parcel, to the iron pipe at the northwest corner,
and then go back to the stream.
Mr. Levesuge felt that people who bought land in the city had an
obligation to the city and that part of that included the trail requirement.
Mr. Woolery wanted to be able to,if desired later, change the location
of the trail upon further Derridinger subdivision, but he wanted a trail
to be located somewhere within the parcel. Mr. Spitz said location changes
could be made until the easement was accepted, which would not be for some
time. He did not feel trails in open areas could be used until they were
ief'tned, and that would take some money. Mr. Foolery hoped the trails would
never be gravelled and would be used for walking paths.
Mr. Collins°proposed that, if the trail had to be, it straddle the
west edge of the'10 acre parcel - 7 112' on the 10 acre parcel and 7 1/2'
on the Derridinger parcel. Mr. '.,:ona noted it would still have to swing north
and south so the city would have the option of rejoining it with the stream
both aides of this area. Mr. Collins noted that there was a state-an:I.roved
airotri, in the area and he did not know whether i�edestrians near the strip
would be a problem. Ile said that if it turned out to be a problem, they would
come b.l-;ck.
Xr. ai.00lery moved that the South Burlington Planning Commission approve

Before the motion was amended, stijulation #4 contained the words
"prepared by a professional engineer" after the word "design". Xr.
Levesque objected to those words and Mr. Ewing agreed a system could be
designed by a non -engineer just as well as an engineer. The words were
deleted.
The motion carried unanimously.
Preliminary discussion of application by Mery Brown for a revised Stonehedir

final a��roval related to a land swap to create additional city parkland
Mr. Spitz explained that there would be a land swap in the area which
would create a rectangular park in the area. Federal funds are involved in
the project. Mr. Spitz explained that land would be trF,ded between ?Brown
and Nowland and that would necessitate a change in the Stonehedge layout.
Mr. rage said there would be a rearrangement of the previous units,
utilities and roadways. Sewer will be tied to Andrews Avenue. The general
concept of utilities and streets is the same. The water line will be taken
from near cluster A and tied into the existing main in the cul-de-sac. As
far as roads, they will continue the concept of phases 1 and 2. They will
be publicly owned and maintained, 24' wide in a 60' right of way, without
curbs. Access for emergency vehicles will be improved because the parking
areas ::re looped to the main road, except in cluster H. There will be one
covered and one open parking space per unit and the units will be the
townhouse type on two or three levels.
Mr. Woolery asked about screening around the boat and trailer parking
and was told Mr. Page saw no problem with that.
Mr. Mona asked if the members had any problems with the proposal and
none were raised.

was told there was a disagreement between the planner and fire chief on the
need for that. Mr. Mona asked about a scenic overlook but Mr. Spitz did
not think it could be required.
Mr. 14cClary, a resident of the F cluster, did not object to the layout
but hoped attention would be paid to storm drainage. He was happy with the plan.

Mr. Spitz said there would be no meeting on July 28.
Mr. Walsh reported that a site visit had been made to the area behind
Econolodge and it was the opinion of Messrs. Poger, Ewing and himself that
any through road was optimistic and that short roads into the area might
be preferable. He felt the zoning behind the Econolodge should be commercial
and behind Patchen Road it should be residential as far back as practical.
Mr. Towne asked the Planning; Commission's opinion on roads in the city.
He said the City Council. of which he is a member, would be discussing the
old Cross Rd.

Dear Sir:
I respectfully submit the following statement regarding my position
concerning the variance and the right -of. -way in question:
I withdraw my objections to the granting of the variance. Should
the Commission grant the variance, I suggest that certain stipula-
tions concerning future development and the use of the right-of-way
be included as the Commission sees fit and appropriate, i.e.,
similar to the action taken concerning the other right-of-way dis-
cussed at the June)Oth meeting.
At the June/Oth meeting I made reference to the availability of
200 feet of frontage. After reconsidering the situation, I have
concluded that it would be in my best interests not to sell any
frontage. Because of the area involved, and in light of the other
right-of-way on the north end yf the property, the ten -acre require-
ment as a building lot may be/jeopardy. I would prefer to see the
variance granted than for me to relinquish any part of the lot.

drainageway.
The drainage area affected drains approximately 400 acres.
This would mean the installation of a culvert with an opening
of 2$ square feet to carry the flow. This is equivalent
to a 6' diameter culvert.
